I always love how politicians cause a problem, then need money to fix the problem they caused, then want accolades for "fixing" a problem, that wasn't a problem, until they caused the problem.

I would say per the definition they do qualify and should be tried in "open court". However, it will come down to the interpretation of "shall only consist in levying War against them" by the court. I would personally lean towards the direction that Kennedy and Fonda are guilty of treason based on what I know at this time which may be incomplete/biased based on the information in the news on the subjects. I try to follow the constitutionally defined version as best I can.
