Constitutional rights don't vary over time unless an amendment changes it, and we still have the 2A saying the right shall not be infringed with no later amendment saying the 2A is null and void or in some way limited. Also, the 2A doesn't speak of the rights of the state to have a militia. It doesn't say the right of the militia, it doesn't say the right of the state, it says the right of the people. This Beermann guy is a knucklehead.
