This is my favorite episode of the original series. Too many cases all at once. The cops screw up. There's no justice, no closure, no relief. Just like real life.
And just like in real life, not held accountable for their complicity in his murder.
Like where was Grandma when he was arrested? Like where was the lineup for the Girl and Grandma. Like yes that is him or nope I don't see him.
There was closure five years later in a crossover with SVU
All he had to do was tell the truth. But big bad Dead daddy apparently still called the shots. Wow!

Thank God the mom knew about his relationship if not they may never found they have the wrong person still it was too late if only the lawyer or the police knew he will still be alive, this is such a sad ending and I hate that they tried to plead guilty when they didn't have enough evidence since anyone said he did it nor the girl or the old lady

They released a 2 parter for this in season 1 of l&OSVU where they catch the guy.
He chose to go to jail, he just had to say where he was, if he was worried about his mom, the police were not going to tell her, besides, she already knew.
This is where a half way prison should be used for people who are on trial. They shouldn't be put in with people who are convicted criminals, that are serving life sentences. Or at least separated. Being innocent, but being treated like you are guilty, when it's meant to be innocent until proven guilty. Very scary.

in my country, at least in the bigger cities, there are separate facilities for each group
@@otaviofrn_adv new york city is one of the largest cities in the world. Rikers is one of the largest transport complexes in the world. Assaults and murder of uniformed guards and medical staff are incredibly common. Due to democrat catch and release policies criminals are not put away and consider prison a bed and breakfast or even a resort accommodation.
@@otaviofrn_adv I'm not American, but with all the TV shows & movies I've watched they appear to be all together, & haven't heard anyone say it's wrong.
Rikers' Island is a *jail* - where people who get arrested are held for arraignment, or for people who get convicted of crimes whose sentence is 1 year or less. A *prison* (like Attica, which they sometimes mention on this show) is where people are put after they're convicted for crimes where their sentence is longer than a year. So yes, in theory they are exactly segregated like you wanted. This is also pretty standard in the US generally.
However, Rikers also houses prisoners who have long sentences but are being transferred, or who are awaiting a court appearance in the city. So there can be some overlap with people convicted of the worst crimes. Plus, someone charged with murder - but not convicted yet - would be there, because they're still considered "innocent" under the law. Rikers is also very rough as jails go. In theory they keep a tighter watch on high-risk inmates, but in practice not so much.
I'm surprised a few heads didn't roll in the department for this. The police department and DA office would probably be vulnerable to lawsuits from Scott's mom. And judging by how much she cared for him, I wouldn't put it past her to do everything in her power to see the head of everyone involved with her son's death roll from the prisoner who shanked him to all the officers of the law who put him in a position to be shanked.

I think it's cute that you believe there's such a thing as accountability for *any* law enforcement organization, far less the NYPD.
If this story had taken place in 2023, there would be some form of lawsuit. This was 1994.
As a society we've normalized the way we mistreat prisoners. We take their names away and reduce them to numbers. We then proceed to treat them worse than prisoners of war. And when someone steps up and says, "Prisoners deserve better!" someone always dismisses the mistreatment by yelling back, "They shouldn't have broken the law!"
But the question I always want someone to answer is, "But what if the person was innocent? Everyday there are organizations getting people out of jails and prisons that never should have been there in the first place! So how can we justify mistreating people just because they're behind bars?

They later wrapped up the unsolved case involving the murders that Scott Hexter was believed to have committed six years later in a crossover with SVU.
Was it the one with the "Buddy Holly glasses"? Because that's all I could think of each time they said "thick black glasses"...
What was disgusting about this episode is that the guy in prison was so paranoid about being revealed as a homosexual he ended up being shanked, why that happened to him pissed me off.

Some people have the opinion that Scott has only himself to blame. I do not dispute the fact that Scott could have saved himself. I want to point out that
A. Scott is under no legal obligation to provide the authorities with his whereabouts
B. Scotts' refusal to cooperate does not change the fact that the authorities botched their investigation.
C. The authorities choose to proceed with the prosecution of Scott. Despite the fact that one witness did not identify him as the killer. The other could not be located (this witness was the old woman who did not recognize Scott). The DA office wanted to offer a deal even after doubt was raised about Scott guilt.

@@jamesdc9595 if that true than we would have a 99% conviction rate based on confessions with full sentences applied like Japan. Japanese prisons like to use the inmates as slave labor in various tasks say a fishing boat and if the boat sinks well who cares if the prisoners were shackled to their work stations
he had a corrobated alibi that he could have used but didn't. he was confrontational and evasive. He lied about a hit and run. It is not the prosecutions duty to defend someone accused of a crime, its your defence lawyer and yourself to defend you, that how the law and the court works, you have the right to a lawyer, you have the right to defend yourself in court if you fail to do that then its your fault you get convicted.

The shaky ID alone would have had this tossed, and the way that Hexter was basically railroaded into a wrongful incarceration (resulting in his needless death) *SHOULD HAVE* resulted in a massive lawsuit. Showing Hexter's face, and **ONLY** his face, to a potential witness is against **ALL** police procedure!!! 😒😒
This was definitely a blatant case of guilty until proven innocent. I mean even after their investigation revealed another vehicle **exactly like his** with very similar plates. *THAT* right there should have made the D.A.'s office AND the investigators go "Maybe we're wrong about this one.."
Realistically, the cops have their heads too far up their own asses to even consider that they are incompetent assholes.
Ordinary, I Iike Briscoe and Logan, but I didn't like how they were determined to believe that Hexter was their guy even after doubt was raised he was the killer.
Schiff wasn't any better, either.
I'm aware that Hexter didn't help his case by not providing an alibi, but back then it was still a stigma to come out of the closet. Even with the alibi, the police still believed they had their man.
It was only when the homeless lady told them that Hexter was too young to fit the description that they realized they had the wrong guy. But unfortunately, for Hexter it was too little, too late.
Briscoe and Logan did deserve to miss out on the ball game they were so anxious to get to throughout the episode.
That was already just a formality. They were already in the process of trying to get him out because they were finally able to get his alibi. It’s awful what happened but because he wouldn’t tell them his whereabouts there was just no way they could’ve done anything else. He was picked out of a lineup and had no alibi.

A non Law & Order kind of episode that you love to see the Law & Order characters in. Plus Robin Tunney, so you can't beat that.
Watching this clip makes me miss Briscoe and Logan, IMO they were the best cop duo on the show.

I really don't like that when it came to arresting circumstantial evidence was enough but when it comes to letting them go they seem to have a stronger threshold.

thing is. when you are gonna release someone you suspected of murder. you need at least SOMETHING that points to them being somewhere else at the time. the only evidence to him being innocent was evidence he refused to give them and kept lying to them. if he had told the truth he would have been out after their first talk and they would have already been searching for the guy who WAS responsible. in a way he had only himself to blame
@@comicsans3421 That's not my point though ( I see yours and your are right). It's not just this case. What I mean is that when they arrest many times they don't even have enough for trial, they arrest based on circumstantial evidence but when they are ready to release they basically need to make sure they are wrong. Even in certain cases where they don't have a motive and they have a weak case they'll arrest but when it comes time to release they gotta know.
To bring things home here (sorry for the length of this comment). I'm just saying the episode "We like Mike" Season 7 ep 20 really shows how arresting a person can affect their life and the lawyers just be like (well our bad) and still expect him to help them. It's just one of those things like the lawyers don't take into consideration sometimes the lives of the people involved.

While I agree that the evidence was circumstantial, if he could have provided an alibi, as long as someone else could have corroborated the alibi of him being somewhere else, he wouldn't have been arraigned. While it's not his fault that the evidence appeared to that point that he was guilty, it is his responsibility to clear his own name. This says more about how Americans viewed/view homosexuality and how someone should be ashamed and hide who they are rather than tell the truth.
@@hunterlee4412 I understand your point. I'm not actually saying that he wasn't responsible. I'm simply pointing out that even when it looked like it wasn't him they had to make sure before letting him go. However, when it comes to arresting they don't have to make sure they just have to have a hunch and little evidence. I used Season 7 ep 20. Another episode I believe is the Finale for season 7 where they have almost no evidence on the guy and then arrest and try him anyway. They then only let him go after it becomes obvious it was someone else.

no, it does not work like that. They will crush his character, it was not in 2023 so it will be easy to do. Then he did not present his alibi etc. I am against violent protests, but remember that police were getting away with the murder of African Americans all the time until the protestors touch the capital. Now they get fired all the time, and even go to jail. Seeing the police so concerned about taking someone that was not 100% cooperative will be ludicrous if the reality was not so sad.
@@veedocapone Because Law & Order is one of the best shows ever that at depicting the daily happenings of crime in NYC, with a lot of the episodes based on real cases. Just pointing it out because I don’t think there was a connecting episode to this one that concluded how that affected the department, like quite a few episodes had.

@@ItsSkeletorand by doing so with the circumstantial evidence pointing to him he would still be in jail. If you won't prove your innocence until trial then you will have to accept if you don't make bail you will be in jail until the trial in concluded.

No, It doesn't work that way as this was not someone who was awaiting being arraigned on his charges or something extremely short term. He had been charged and while the prison or most prisons do have different areas for people who have been convicted of more dangerous crimes or have been shown to be problematic the person awaiting their trial, which can take easily over a year or more, can be a general population with people who did lesser crimes and are only in for a few months or others who are awaiting trials, but have a history of criminal behaviors. It's impossible to sort everyone and someone who may be absolutely guilty of another crime and looking at life would have no reason to not take out another person while they are already there for a multitude of reason from joining a gan to stay alive on the inside or simply because they know/believe their life is over or they are just a criminal and not good person. If people believed he was actually a murderer they could have done it to take out another "murder" and prove their gusto. The list of reasons is endless and their is simply no way to screen everyone, some people who have already done their time for a previous time and may return are considered to have done that time and have a "clean slate", some people may be guilty and want to fit in or they may simply want to fit into a gang or other group. You never really know.
No separate holding cells I have ever been aware of unless he was well known such as the case was all over TV, a public figure, had threats made towards him and then they put him in isolation, not the other prisoners.

Are the detectives going to be in so much trouble for someone innocent in prison getting killed?
They have enough paperwork to show that they gave him every out and that they investigated and moved to get him out in a timely manner once they knew he was innocent. He had many chances with plea deals, a chance to give a truthful alibi. The mother has a strong case if she wants to sue the state but I don’t see negligence on the part of the cops or the DA’s office
There'll be an investigation but if there's no impropriety they'll be fine.

A cop could gun down a kid in broad daylight while filming it and not see a single day of prison. Theres enough qualified immunity there that everything from accidents to all but the most absolute brain dead of deliberate crimes can be weaseled out of.

The truth would have set him free. The guy wouldn't even tell HIS OWN LAWYER. So he very much chose to be in that situation. His privacy or justice; it should have been clear that he could not have both at that moment.

police didn't have much of anything on him though. he was a short guy with glasses. No witness lineup, no real evidence of anything, just charge him? wasn't good police work.

The cops botched it and it's not necessarily Scotts fault, but he absolutely could've gotten out of it. It would probably be easier the be a known gay man in the world than a known gay man in jail.

There is a local criminal lawyer where I live who says that he is a firm believer that PD would be so much better with a 4 year college education, including any education into psychology as they deal with many people from mental illness to DV, and that it would help them understand the law better as the PD break it all of the time and escalate issues or do not really follow protocols. He loves body and dash cams because PD do make some fairly significant mistakes. He does appreciate what they do and is a strong advocate for them, but believes they do not have the education in order to do the job correctly when it's going to be scrutinized by lawyers in a court of law.
The entire concept of being able to take away someone's freedom and potentially their life based on arbitrary laws some random people decided we should all have to live by forever ago is so ridiculous I'll never get over it

Can you tell me what they did wrong? They found witnesses that put a man that looked like him with a car that looks like his at the murder scene. Dude offered no real alibi, and kept lying to the police. They brought in the girl and tried to bring in the lady to ID. The girl was wrong, but we all know not every ID is correct. In fact, the prosecutor fought harder to get this dude off than he and his own lawyer did. All he said was how can you believe/think I killed anyone over and over? Is that a good defense when facing a murder charge? Ross even questioned his mom to be sure, and Logan even showed the old lady the photo after just to be sure as well. The guy dug himself a huge ditch and kept digging with the lies. Unfortunately he got shanked in prison, and everyone breaks out the hindsight goggles and starts bashing everyone involved, except we can’t victim blame, so we can’t blame the man that essentially put himself there. I get not wanting to come out, but when murders are involved, and you’re the main suspect? You gotta help yourself out to some degree.
You can tell how long ago this was made -- there's a light-hearted reference to someone driving under the influence. (One of the best L&O episodes, to be clear. I love Zelda.)

@@toomanyaccounts there wasn't any sufficient evidence for an address. He didn't get picked out the line up. His gun didn't match the ballistics. His DNA wasn't found on the scene . And you can't lock up people because they won't give you an alibi.

Why don't these people ever ask for lawyers? It's literally the first thing you should do if you are in an interrogation. These detectives bully people into saying things. None of any of this would hold up in court. Even the judge was way out of line saying He kills people for relaxation. They literally bullied and badgered him the whole time. Any good lawyer would get him off on that alone.

If the guy just told the truth, it would've saved him.
It's not that simple, at that time it was even harder for anyone to admit that they're gay. His reasons for not revealing himself went even much deeper than that, he was scared of his father even in death. Also they couldn't find the bag lady, otherwise the whole thing would've never happened.
