Second, he is being charged with a felony. He has the right to a trial jury, its in the constitution twice. Once in the body and once in the 6th amendment. Even most states you can even request a jury for a misdemeanor or civil case. The fact that you would even suggest there wouldn't be a jury is......what's the word?

For as much as warning shots are talked about, they are rarely legal. Also Assault charges don’t require contact, it’s more about threatening behavior. If there is actual contact or injury it becomes battery.

@@CampVictoria Well, there also has to be a reasonable assumption of "can the person saying they will do (x) actually be able to do it?" And sissy hypnosis is not a real thing, which means Frank could not within reason be able to inflict that upon Boogie, and Boogie just lost his mind over what was basically a non-actionable threat. It'd be similar to if Frank told Boogie he was a vampire who was the reincarnation of Dracula and was gonna suck his blood and Boogie took that as a threat. Not to mention Boogie lost his shit and told Frank to show up at his house multiple times on the Killstream and on DramaAlert so he could legally murder him. The videos of that are still on RUclips. There's also the matter of Frank not trying to break into Boogie's home, and was unarmed and never threatened to physically harm Boogie when they were face to face and that Boogie is barred from owning or generally handling guns due to his self professed mental illnesses and attempts at suicide and self harm. There could definitely be grounds for harassment put against Frank, but Frank did nothing super illegal here. Was he an asshole? Yea. But that's all he was and you can't fire a gun at or near someone just cuz they were an asshole.
Everything you've just said is completely dependent upon the State and Local laws where said event takes place. That being said.....I'd bet there's NO spot in the United States where firing a warning shot NEAR A SCHOOL would be considered legal. That's where Boogie fucked up and that's the charge that's gonna stick. Hassel was electronically documented coming to his house when he was told not to.

Assault is intimidation if there’s a fear, or an attempt to batter someone. Aggravated means a weapon was used in either case or based on the level of bodily harm. Example i threaten to hit you with a bat and or swing it at you and miss, agg assault. If I touch you with the bat agg batt.

I mean he fired a handgun in the air. People have been killed by falling bullets before. Massad Ayoob talked about a case he was an expert in once, where a woman got killed by a falling bullet while out on her front porch. Like everyone else, I normally shake my head when "school zone" gets tacked on a charge. In this case though, it's a big fucking deal. If you want to possess the benefits of a firearm you have to treat it with respect. When you don't, people often die through no fault of their own.

Been trying to get back into him since he started posting again post sobriety.

His mistake was part of the firearm safety rules. You don’t shoot to wound and you never fire warning shots. You shoot to kill or end up with no rights.
The warning shot actually turns you into the aggressor. If you need it and pull it it's to kill no other reason you pull it out and wave it around and fire off a round you are gonna get in trouble
