Verbal wise, if they are verbally telling you no and you do it anyway, its assault. Battery, there is no verbal warning. Thats why if someone touches you inappropriately, after youve told them no and not to touch you, its considered assault. If someone comes up out of no where and hits you, thats battery.

@@JoeMama-vj8es actually, legal wise its also considered battery. Not false information, im a nationally certified phlebotomist. We went over it a lot in class. It can be considered either assault and battery, or battery because there is no verbal warning. Same goes with legal wise. And if you actually READ my reply to the original commentator, i was pointing out the difference in how to distinguish the two, like they had asked.

It would be simple battery. Assault would be for example "I am going to jab this 14 gauge needle in your neck whether you like it or not".
