    Hello again People. I have an update on my experience. My i-129f has taken 13 months to get approval from USCIS. I think the next step is NVC. Just wanted to give a heads up to everyone about what might of delayed my case. We met online thought a dating site. The misunderstood was that they might have been an International Marriage Broker. That was not true but raised a suspicion with USCIS. Thank you for your RUclips video.

    Since k1visas takes so long they should atleast allow us to visit our spouses in the US without thinking of suspicious act or scrutiny. It's just we can't handle the distance and the long process of the visa application. So to visit my fiance in the US what other visiting visa should I apply for?

      Sorry, but the only visa you are likely to get is the K1 fiance visa. If you are eligible today, you should have your fiance submit as soon as possible. The sooner started, the sooner it is over.

      @@Visacoach yes we did submit our k1 application in December but the wait is long which is why I'm considering visiting while we wait. It's just way to much of a waiting period, but thanks for responding

      You can apply for a B1/B2 visitor visa at any time. The cost is only $200. You might be one of the lucky ones. Good luck!

    I will tell you my experience. We are at 325 days and our application has not moved from the initial letter that stated they received our paperwork and payment. My attorney requested and interview with a supervisor but was denied. Was told that is no longer an option. My attorney is going to send an email and see if that gets a response.
    For those wandering our case is solid and has plenty of evidence of our relationship.

      You case is currently at the 10.5 month mark. This sadly is normal for USCIS which is taking 9 to 11 months for most cases. Hopefully you will hear good news soon.

      I've been waiting 12.5 months which is normal apparently. I only have my NOA 1. I know they'll stretch the waiting time, they always do when I'm days away from the mark.

    Please make a follow up to this. I (US Citizen, Veteran Iraq/Afghanistan, Dallas TX) have a Russian fiancé and things are very difficult due to the current political situation. We can get her an appointment basically anywhere other than the Moscow embassy but I'm not sure how the current situation would delay this. Is an immigration attorney pretty much always required?

      Peace and friendly relations between countries is what is required for smooth processing of cases. Sorry, your fiance, is not resposible for what the Russian government is up to, however, that issue will trickle down to slow and make more frustrating her case, Not any cause of her own, not anything an attorney or consultant can fix. Just the current atmosphere.

    I looked up and picked evidence from the end of 2017 (the time we started talking to each other), do you think it is too much? Is there any chance that the officers will deny our documents because it's too much than their requirement of "2-year period"?

      When working with my couples I provide them a personalized checklist of all the documents and evidence that based on their situation I recommend to include in the application. I spend a lot of time to review and insure that "the right amount" of evidence is presented. Sorry, that takes experience and knowledge, and there is no simple answer to provide here.

      You can get denied if the consular officer feels that is appropriate, regardless of what evidence you submit.

    From Philippines we got approved January 2022 and we are waiting patiently thanks for the update. as a Filipino who will live there in the future i know USA will really appreciate people who patiently wait for their turn ‘coz if it was God who want it to happen,… it will happen.     How can we tell how backed up the embassy’s where we will be interviewing are?
    And does the petitioner and the beneficiary have to go to the interview??

      Contact the consulate, contact other applicants that are in process, hire professional help that has experience and familiarity in dealing with the destination consulate. The beneficiary is required to attend the interview. Only in the rarest of circumstances is the sponsor asked to attend too.

    Hello! I have a question. I am wanting to know if it’s best for my fiance to apply for a tourist visa and then once he’s in the states with me apply for a change of status.. or if it’s better to just directly apply for the fiance visa. Also: while the fiance visa is processing: is he allowed to visit me? We currently live in Europe together but I’m returning back to the states next week :( he is Argentinian/ Italian (has citizenship in both countries). Any advice would be super helpful! Thanks in advance

      Applying for a tourist visa and the "intent" is to adjust status, is considered immigration fraud. The "best" path is to follow the rules. You can apply for a fiance visa and he can reasonably and following the rules join you in USA in about a year. Or you can marry and he can reasonably and following the rules join you in about a year and a half. He is "allowed" to visit if he has a visitor visa. However it is sometimes hard to get a visitor visa, due to suspicion of applicants planning the same type of fraud you were considering. BEST path is to follow the rules.       She doesn’t need a visa, with her Italian citizenship she can apply for a ESTA, it’s a e online visa and she can visit you all the times she want even if you made the application…

      If you don’t mind, can you do a update later? I’m in the similar situation, and scared on what to do. I don’t want to mess anything up. I have colleges who go married, and his wife got denied. People are saying it’s because she has too many citizenship (2 like your BF) so that is considered high risk. But he’s former military, and we make good money. So I’m so confused and worried why they got denied. IN any case, it seems like the K1 visa is better. Since they can come into the country with the intent to marry, and then you can apply for the permanent.
      But what I’m trying to say, it make sure you HIRE someone, and get all the information BEFORE you do anything. One little thing can mess everything up, and that not even considering the person who is approving the visa. But good luck! And hope it goes well.

    Hello Fred Wahl, I wanted to ask a question. If it happens that your fiancé's full time job is to be a family member's caregiver at home but has savings from his former job .He's a care giver because of the family member's medical condition and he also manages his entire assets and investments but he hopes to get a job of his own soonest. Can he still file for the K1 visa now if he wants to using his savings and having a family member as a joint sponsor if need be. Or what till he gets a new job outside before filing .Is there a way out? Thanks for your response.

The consultant or attorney working with your who understands the intricacies of your fiancee's financial situation should be able to answer this.       Usually you don't hear anything but "Thanks for your application", followed 9 to 11 months later with "Your case is approved by USCIC and has been sent to the State Department"

      Typically the K1 fiance visa process takes about a year from submission to interview. AT the interview is where your financial evidence is presented. So no job now, no problem. No job at the time of the interview, and no cash assets, home equity or co-sponsor, then a big problem.

      Quarantines in India are on and off. When on the consulate's backlog grows. When off the consulates backlog decreases. US citizen petitions are consistently much faster to be approved than petitions for permanent residents.

    Hi! I have a valid ESTA (currently residing in Austria and an Austrian citizen) valid until November 2023. My fiancé submitted our k1 visa papers on January 30, 2022, and we received a text message with a receipt number on February 7, 2022. Pre Covid, I would visit her in the US twice a year. I finally got to to visit her again in December of 2021, on my valid ESTA (this trip was prior to us submitting the K2 visa papers). My question is, is it possible for me to visit her in the summer while the papers are in process, with my valid ESTA? If so, what should I prepare just in case I get additional questions at immigration? I’ve tried calling customs while I was in the US and every person gave me a different answer; one said that it would be best for me to wait until the K1 visa is approved, another said that my ESTA and a K1 visa are separate documents and that I shouldn’t have a problem.
    I hope that someone can give me a clear answer for this, reading the 9-12 month wait for NOA2 from some people is making me so anxious!

      Each entry is at discretion of the inspecting officer. If he feels you are a risk to overstay he will turn you away. So yes it is possible to visit using your Esta. and yes it is also possible you will be turned away. As far as obtaining advance permission, that is not going to happen, and in practice the only way to find out is to attempt to cross the border.

    Hello, thanks for the video, I would like to ask you about a K-1 visa appointment. My fiancé/petitioner is in the US and I received a letter from the NVC saying The NVC received your fiancé (e)’s/spouse’s approved I-129F petition from USCIS. NVC will now forward the petition to the U.S. Embassy or Consulate (the status is Ready on CEAC now). The U.S. Embassy or Consulate will contact your fiancé (e)/spouse when they are ready to process his or her petition.
    So, my question is does this means that;
    1. we have to wait for another mail/email from NVC/embassy to fill Ds-160 and schedule an appointment
    2. Or should we directly fill out the DS-160 and schedule an appointment?

      Quite right. There are no shortcuts, there is doing a proper job with the application and focusing on each step to accomplish them on a timely manner. Plenty of opportunities to mess up and slow the process, no magic way to shorten it.

      As the consulate in Abu Dhabi that handles Dubaii cases has not suffered extensive Covid shut downs, you probably will experience normal processing times of around a year plus.

    My US spouse and i have 2 kids ( 2years and the last one is a newborn 1 month)
    In 2020 we filed joint tax, in 2021 she preferred to file married separate and this year too
    we have same spending account and happily married
    I applied I-751 last year July.
    My question is will i get issues with USCIS about my case about that?

      Sorry, that you neglected to do a proper job with your application. That is the problem with tackling this once in a lifetime, extremely complicated issue on your own. Sorry, but once your rocket has launched, there is very little anyone can do to modify trajectory and outcome. Now you just have to wait for the journey to run it's course. Sorry, you want to hire me at the "get go", so mistakes are avoided and your case goes smoothly.

      Currently USCIS is taking on average 9 to 11 months to complete their review of most cases, so you probably will hear from them soon or within a few months.

    Hello Fred Wahl, For this two year requirement of meeting in person, does it mean that you have to visit, chat/ talk with your fiance for two good years before filing your petition. Or does it mean that if you visit, talk/ chat with your fiance for let's just say three months , four or even five months and you're in love with each other and want to get married, especially now there's no covid restriction for travel to meet each other, you can proceed to filing the petition instead of waiting for complete two years. I need clarity

    Thank you for this informative video. You stated there is a backlog in the Philippines so the approved I-129F is warehoused at the NVC. Do you know what what the wait time is for Mexico City? The DOS lists wait times for NIV appointment times for Mexico City , but not for IVs. Thank you in advance for your answer.

    Hello sir. But I think your worng about the nvc processing time. I have a k1 visa that's been approved. The visa has been at the nvc for close to a year. The u.s. embassy in manila is still telling me, as far as my last update which was a month ago. That the u.s. embassy in manila is still closed and not process k1 visa. Even thow the manila embassy is process k1 I don't think they are taking on new case. People should know that it could take way more than a year if your going to process a k1 in the Philippines. I would suggest a more accurate time line of 2 years plus.

      There is a big world out there. And while my time estimates are valid for the majority of countries, results do vary between countries. Philippines specifically has about a years worth of backlogged cases, so add a year to what I said for worldwide average and that will be closer to what you probably will experience.

    I received my NOA 1 on April 13, 2021. I was approved on August 26, 2022. 500 DAYS! 17 MONTHS. To tell people that they could have a K1 in even 13 months like even the USCIS site states, is incorrect.

      It's called statistics. Statistics look at a population, not an individual case. When I published this video, this was my best forecast for 2022. You may want to go back and find what my forcast was for 2021 when your case was filed. Also depends on Country. If your case was Philippines or another courtry hard hit by covid, then ALL of those cases were delayed due to Covid.

    Can I travel to the U.S. on ESTA while unemployed and while my K-1 is still pending? How high is the chance of denial at the border? I am a Korean citizen who has an ESTA valid until Nov 2023 and has filed for a K-1 on 9/27/2021 (receipt date). It doesn't seem like my K-1 will get approved anytime soon so I wanted to use ESTA to spend some time with my fiance. But my current work doesn't allow more than 2 weeks of vacation so I will have to quit to spend more than that. But I am fearing that quitting work may not bode well for my chance at the border. Should I not quit and just wait it out?

      Quitting your job is a bad idea. Best practice is to wait until the K1 has been granted before taking such action.

On May 10 we got an email from NVC saying "The NVC received your approved I-129F petition from USCIS. NVC will now forward the petition to the U.S. Embassy in Yerevan...".What should we do now? Will the embassy contact us? Is this the welcome letter or should we still wait for the welcome letter? If this is the welcome letter why doesn't it have invoice ID(there is only case number written on it)?

    We use the Rapid visa but it’s seems our case still stagnate in the uscis been 11 months of waiting but we don’t have a news to have a NOA2. Sad 😞 but some application who is late to be submitted are now approved is rapid visa dont have a power to make the process faster? Its like the process is just the same with the people who are make their own application.

Can you travel to other countries? US immigration does not care about your and your partners travels that do not include crossing the USA border.

      I'm in the same situation. I submitted mine December, 2021. I am not sure when I'll receive my "Receipt Number", which is how you can keep track of your case. Only at this time they, USCIS, cashed my check and I've not received anything else regarding my case in the mail... Just a waiting game given the current state of affairs and lack of government offices being open to full staff.

    Me fiancé is an American citizenship. We applied for a I-129 petition (k1 visa) to USCIS last year on April 27th, 2021. Inbetween we got a baby who is 2 month old by now. We still didn’t get an approval for the petition on USCIS level. The processing times on the USCIS website are completely wrong and jumping back and forth, so we have no idea what are they on now.

    2. Since our newborn already got American passport, is it going to speed up the k1-visa process?

      It is a non-immigrant visa. It does not convert into anything. If after entry on the k1 visa, the wedding takes place within 90 days, then the beneficiary can apply for adjustment of status.

      Yes is is confusing. The visa is non-immigrant. However as it normally LEADS to immigration, it is processed by the immigrant side of the consulate.

      If you are asking if you can remain outside the USA with your partner while your case is in process the answer = yes. In fact you can even submit while you are outside the USA, remain outside, then when the visa is granted both of you relocate together to the USA.       That's why I give my clients a detailed list of what documents should be brought to the consulate. Cause when you provide what is needed the visa arrives in about 2 weeks, but if you are missing even one critical document you might wait for a very very long time, as you have experienced.

      That USCIS feels they are being the new "user friendly" USCIS by posting such statistics, my opinion is that they are worthless. And trying to micro monitor your case by viewing such statistics is just crazy making. Most cases take 9 to 11 months from USCIS currently, don't watch the clock, just get on with your life and hope that your case is processed as average or faster than average.

    Hi . I applied k1 visa for month ago by a lawyer ..i have know my fiance for 3 years but we haven't met yet and the lawyer said that he can explain that to USCIS because of COVID so that's means I'll get refuse?? Plz need answer

      In my experience, covid is not a reason that will be accepted in order to waive the in-person meeting requirement. I expect that you have wasted your time and money. After your case is denied, when you are ready to properly proceed, as well as travel to meet your fiance, you can reach out to me at that time to start over.

    Great video thank you. My feelings are they USCIS need to work around covid like most others. There's no reason they still need to be closed or at half staff. 1 130's overseas apps...taking way to long at the hardship of the couple.

    Hello sir, thanks for your video and very helful information. Our reciept date is on July 15th 2021 and we are still waiting for NOA2 but it's taking so long and we know we could not speed up it at moment. We are planning to have a baby and if I got pregnant, will it hurt our case? And what will we need to prepare in this case? Thanks so much

      Getting pregnant from your fiance while your fiance visa is in process should not have any negative effect.

      You can apply after only 1 day. But the longer the relatonship the more likely you can convince the officers that your application is bona fide.

      If the consulate provided you with courier tracking information, sure you can contact the courier service. However normal situation, is you patiently wait, it might take a few weeks to arrive. If a month goes by and you have not received your passport, then chase the consulate.
