      This should be a no brainger. Suits filed I'm every state result in multiple suits in every District Court, Appeals Courts, which at some point should be combined. At this point, SCOTUS shall grant certiorari to at least 1 of them. A class action suit of this magnitude would also force Congress to deal with it, either of their own accoard or after SCOTUS gorges them to.

      I understand it's bullshit.
      5th Circuit Court will hold a hearing on this case in December. Even if they rule that it's unconstitutional it can be challenged. If it is challenged then it can either be appealed for another hearing by the 5th circuit again or somehow sent up to the Supreme Court. We have between 1 and 2 more years before any finale decision is made on this specific suit because the left understands the law and process well enough to drag it out for the maximum amount of time.

I can grantee buying milk isn’t that bad. Secondly you said you can walk into a sporting goods and buy weapons/ suppressor. Hunting is a sport, competition shooting is also a sport. So yes it would make sense they would have them in sporting goods.

      Because the doj is effectively mothballed. It now moonlights as a political crimes unit [shaking down banks or running guns to foreign cartels as Holder did] and if that rico action bores them... full on Stasi escapades- like dispatching frogmen to arrest one sleeping Roger Stone in the dead of night. They don't read the warrants obtained [speaking of fbi under their department], but they are careful to instruct deadly force when engaging an interstate robbery under color of authority [yes, removing items not specified on a warrant is an invention departing from a court order].

    if they are not arms, then the ATF has no justification for regulating and/or banning them.
    if they are not arms, and do not fire a projectile, then they can not be considered "dangerous"
    them being common place, disqualifies them from being "unusual", and even if they were "unusual" that in no way justifies banning/regulating them.
    Their claims are literal contradictions, but contradicting their own claims, as well as fact based reality.

    Oklahoma thanks you for being nice to your neighbors on using a suppressor. They're currently working a bill to give the middle finger to the feds. SB 1551 'provides that a firearm suppressor manufactured and remaining in Oklahoma shall not be subject to federal law or federal regulation.'

      @juanpena753 Firearm Suppressors cannot be considered "dangerous and unusual" since they are in common use by millions of gun owners as well as the US military and law enforcement for hearing protection.
      Furthermore, in 2020 the United States Marine Corps issued 30,000 Knights Armament Suppressors to their basic infantrymen for hearing protection

    So, why hasn't anyone filed amicus briefs pointing out the absurd position of the ATF in regulating and taxing suppressors as firearms, and simultaneously saying that they aren't protected as bearable arms? Heller very clearly defines arms, and suppressors definitely meet that standard.

    I just ordered my first suppressor. Waiting on the ATF to approve it now. Super excited! I've been a gun owner for almost 10 years now and have 10+ guns; I've even milled my own 80% lowers, but I never considered going through the process of filing a form 4, as I was apprehensive about submitting my fingerprints.
    Decided against buying the unlimited single shot trust, as I'd prefer to remain optimistic about the potential for the NFA to be repealed. It would be so nice to buy select fire weapons and suppressors without needing to pay exorbitant licensing and bribery fees.

      It's been since March 20th 2024 I submitted my paper work through a trust still waiting I had my own ffl a state carry permit and have been an armed guard for over 12 years and currently work in my counties school system has armed security i have seen them come back in a couple days through standard trust but not mine

    Still missing the point that the ATF has no jurisdiction to create or enforce laws on anything but firearms - if the suppressor is not arms, they can't charge him with anything anymore then he could be charged with have apples in his fridge.       Your grasp of this case and observation that this particular Defendant needs immediate assistance from a competent attorney, is correct.
      This Defendant's current attorney, certainly appears to lack any familiarity with some of the most fundamentally important 2nd Amendment cases of late.
      Cases which have held hugely, important rulings, set forth by the SCOTUS, dealing with the proper judicial analysis, meaning & application of the 2nd Amendment, by lower courts, faced with a case of (similar impression*).
      (*Ie. a case, with a factually similar issue or judicial question arises), usually in an attempt to fall back on flawed logic or faulty interpretation of the law.
      The ATF seems to have a bad habit of bad thinking!
      In other words,
      "Thinking that going to Church makes you a Christian, is like thinking that standing in a garage, makes you a car!"
      So the Supreme Court has to explain the basic logic to them. Hopefully this fellow will get an attorney to explain BRUEN, HELLER, etc. to them before they find a Judge who while standing in a JIFFY LUBE looks up to see a rack of "AIR CLEANERS" or "OIL FILTERS", NEW IN THE BOX! Which being a Certified Professional, he knows a SUPPRESSOR when he sees one and...., HERE WE GO AGAIN!! LOL!

    So the ATF claims that suppressors aren’t protected by the 2nd amendment because they are accessories, NOT firearms… but the ATF simultaneously classifies them as dangerous weapons to claim authority to regulate them under the NFA? Seems like a pretty serious contradiction.

    I could see the argument that silencers aren’t arms as they aren’t firearms and therefore could be regulated by 2a but my response to that would be to ask why I still have to fill out a 4473 when I purchase one.

    They are charging a fee and a stamp for something in must country are recommended for hearing safety with in city limits or near farms or recommended while hunting of any type. A suppressor help manage recoil and noise . Basically you can say like a muffler for a car but for a gun.

    Arms == Weapons. The amendments were written in a time of bayonets and swords being among the arms of the day. If it's a weapon or armament it falls under the 2nd ammendment. If it's not it's outside the ATF's purview anyway. Way too much infringing going on.

    What if he was using them for PCP pellet guns to stablize pellet by removing air from the rear of the pellet. Very common practice. BB Guns are not Firearms

      According to the ATF website, even for paintball/airguns they are considered NFA items. Even though you can just order them straight up.
      Basically, it's the same as any other interaction with government: You're not illegal until they decide that you are.

    The atf admits Bruen may play a role? That alone says they know their own argument is invalid.
    The nfa process is internally arduous and I personally have proof of what they're lying about as I have the SOPs for both paper and eforms in-hand!
    There is NO reason for processing to take more than 3 business days.

    If suppressors are not firearms according to the bureau of alcohol tobacco and firearms , then by their own admission, they have no jurisdiction over them at all, hence they have no case at all, without even bothering to mention that their very existence is unlawful according to the constitution , and in the concisely expressed reasons given by the founding fathers of our country's government, these aspects being seriously taken under consideration nullifies the BATF itself, entirely, therefore the supreme court Justice's are compelled to rule them as being rogue to the constitution of the United States of America, and therefore nullified in being defunct !

    All right so my question is when, when is somebody going to look at a judge and go your honor they need to make up their minds!! Are the items firearms or are they accessories they can't have it both ways when is one of you going to bring that too a judges attention because that's what the ATF does like a 3-year-old child that's having a tantrum??

    If suppressors are not bearable arms then they cannot also be considered a dangerous and unusual weapon. If it's not a bearable arm, the ATF has no authority to regulate them. Furthermore, is the NFA itself not keeping with the text, history, and tradition of the 2nd Amendment? It's time for the ATF to be put back in its place, this dog has been off the leash for *far* too long!

    The prohibition on "cans" has ALWAYS been ridiculous. Back in the day, suppressors were used in the shooting galleries at amusement parks, to allow people who were sound-sensitive to be able to enjoy shooting. They were ALSO used by people who had hen houses to allow them to eliminate predators WITHOUT frightening the hens to the point where they'd stopped laying. Now, how "sinister" does that sound, to you?

    The only correct precedent is the 2A. Anything that attempts to interpret, regulate, legislate, or otherwise infringe on that legal contractural restriction against the federal government is wrong. Period. End of discussion.

    ATF: "Silencers are not bearable arms and therefore are not protected" "Silencers are dangerous weapons and therefore can be regulated"
    So SBR/SBS/Machineguns, etc are bearable arms so by the atf's own reasoning they are worthy of protection by the 2A, cant have it both ways. This is why they will lose and we are on the threshold of all of this being stripped away.

    If saftey is not paramount then we need to abolish OSHA and the EPA. SAFTEY is my goal everyday I step out of my door to come back home to my family. Hearing is an integral part of my daily life. Supressors are very integral to a firearm for the lessened DB. Amazing one can get a ticket for too loud of a stereo, exhaust and so forth.

    I was 16 years old setting in the can of a quad 50 on a half track with no ear protection at all nearly 70 years ago. I still hear a little in left ear. Sad that every decision generates more court cases, then more laws that generate more challenges, meanwhile the people lay victims of the ABC agencies because they can't afford court challenges because the Supremes refuse to actually read the 2nd.

    Oh cruel question, buy it now or not to buy. What concerns me is that if buy it now even if had no tax but just registration, that when if becames banned they would know exactly who owns it. Yeah they could also find records of firearms purchases but is not so simple. And them what? Pay $1k or more for a can and it need be turned in for free or buy back for stupid $50 gift card? Doesn’t matter what others say. They all say blah blah no one is taking it from me blah blah, but when shit becomes illegal they quickly low their voice and will turn it in.
