    Registered USPTO patent attorney, J.D. Houvener from Bold Patents Law Firm, explains how to know if your idea is patentable!
    Below we have provided resources and timestamps with brief explanations for each aspect of this subject.
    Quickly find what you are looking for by clicking on the timestamps below.
    ➡️1:26 Idea vs. Invention
    ✔️It’s important to know that ideas and inventions are NOT the same thing.
    ✔️To be an invention, you must have both the idea for a product and an idea of how it works.
    ✔️Inventions require novelty, utility, and non-obviousness.
    ➡️2:23 Novelty
    ✔️A patent examiner will search extensively through prior art to ensure your invention’s novelty.
    ✔️Make sure you have a search done first so you won’t be taken by surprise!
    ➡️4:40 Utility
    ✔️It might sound obvious, but your invention must be useful in some way.
    ✔️If you have major claims, you may require evidence that your invention really works.

    Thanks! Now I'm fairly certain at least a few of my brilliant ideas are patentable 😈 Rahahaha! Excellent! * steepling fingers * And there's a niche market lacking innovation that I can appeal to. I just discovered I'm an innovator 😅 Never thought of myself that way.

    Question: if you had an idea to change the material of a household item. The best comparison is how we started making poster board out of a plastic ribbed structure. Could they / did they patent that idea/invention.

    • @boldpatents

      Absolutely yes. Could look at protecting it as a composition of matter and/or a structure/assembly

    • @boldpatents

      For most individuals and businesses that pursue patent protection, the goal is monetary. However, if your goals are more philanthropic, then you can still seek patent protection to assure that another doesn't get a patent on it and prevent access to it. Basically, you can control who may make, use, and sell the invention if you have a patent...even if you're not going to charge a royalty or enforce your rights on certain uses. The choice/power is yours.

    Good Morning Mr. Governor:
    I have an idea concept and love your informational videos. I have been contacted by several inventor companies and signing NDA for info on my idea. I'm really protective of my idea Bec it's not expenses to make but will generate serious income. That being said, I guess I need someone to bring my idea 💡 to life. Should I hire I guess a Designer Engineer to create it. Then a Patent Designer to draw it to submit a fully Engineered & Design drawing of my invention for a pre patent? Please help I don't know what comes first to protect my idea before revealing to protect it. Thanks Again

    • @boldpatents
      @boldpatents  2 года назад

      Hey Wardell. Great questions. You can hire both a designer and a patent attorney at the same time to help you work on your invention. However, my recommendation is to hire a patent attorney to help you research and file for protection on your invention first. Once you are patent pending, then you can (and should) work with a designer to help you get a final market-ready design prior to going to market. Yes, you should work with a business attorney to draft a custom nondisclosure agreement (NDA) to use with any and all third parties (including engineers and designers). We can help introduce you to them. If you'd like to work with our firm, please schedule a 15 min screening session where we see if you're a good fit for us: calendly.com/business-consultations/am06-youtube

    +Bold Patents - Intellectual Property & Patent Law!
    Hello, If my product is different in multiple ways but has the same dimensions as my competitor's Patent pending product, should I also change my product's length dimension just to be on the the safe side? Thank you

    • @boldpatents
      @boldpatents  3 года назад +1

      We would need to consider both your product and the competitor's product of course to provide an opinion on infringement. That said, if your competitor has a design patent, then the look/aesthetics is more important as to infringement, but if they have a utility patent, then it's all about functionality. Set up a screening session with us and we can dig in. boldip.com/contact/

    Howdy! I have a proposal for an existing professional sports league which would drastically alter the way the season is scored--instead of wins and losses, I have a new format. This is not a physical product obviously, but a novel concept which (I believe) has utility. Is this something to consider for a patent? Thank you, and what a wonderful resource this channel is, for lay people to take the first step. Thank you kindly.

    I want to ask about Novelty. If someone published an online articule for example saying indoor wall mounted aircons should be made with a superellipse shape blow air at a 20,30,40 degree angles for them to nicely warm people in the room. And they go on to show researh data of superellipse shaped arcons warming up rooms at 20,30,40 degree angles. They dont patent anything its just an article.
    Then you happen to have a similar idea without reading that article and made a proto type but yot idea is a circular shape and you want to file a Utility Patent.
    Will that idea be concidered NOVEL?

    • @boldpatents
      @boldpatents  Год назад +1

      It would be novel if no one has ever used a circular shaped wall mount aircon. However, the tougher question is whether an eliptical shape disclosure would make a circular shape obvious. My gut says yes, BUT if in the prior disclosure for example, if there is language about how "a circular shape will not work..." or teaches against a circular shape, then there may be some opportunity. we should evaluate the disclosure more carefully under confidentiality. As I am not a software professional i cannot make it. So if i disclose this idea with any professional to make it he can easily steal it. So can I patent my unique idea and then ask some company to develop it for me . Is this possible?

    • @boldpatents

      No, you do not need to develop the software to secure patent protection on it. However, you will need to be abl to describe the invention in detail, and describe the functional steps

    Hello, my name is Julio Roosberg and I have many inventions, and would like to know how I could make the right steps to patent my invention or make it a reality. It can be used in many fields but it solves many civil aviation and millitary accidents and disasters. In snow, rain, storms, smoke, mountain terrain crashes in Alaska, in the night especially Aircraft Carrier desasters. It has the abillity to make any aircraft Carrier 100% stealth in battle allowing only the fighter pilot to find the carrier. No need for any type of lights whatsoever. It will eliminate freindly fire in battle combat. no enemy can infiltrate and dress like a soldier you can detect it. No friendly fire from air assult bombing, all pilots will be able to see all alies on the ground. no Snow pileups, Able to see all other vehicles in the mist(by mandetory). Firemen can find each other in 0% visabillity in smoke fires, and cheaper than any avaible products.
