Dumb cops tried this with my sister. She was not wasted, but over the limit. Called an uber and was waiting in her car, charging her phone which was almost dead. They approached her, gave her a DUI, and lied about seeing her driving. My sister got an attorney who tore them a new one in court. They changed their stories a couple times, lost all credibility and charges were dropped. A few weeks later I was called for jury duty. Gave this as an example of why I dont like cops in a case that was almost the same as my sisters. I was dismissed.
Your sister could have saved herself all that drama by locking her keys in the trunk (where she COULD NOT ACCESS THEM without help) and sitting in the BACK seat. The cops have heard "but I want gonna drive," from to make drinks to believe it anymore. Do you know that if you leave a bar drink and convince a cop in the parking lot that you aren't to drink to drive and then have an accident, THEY could both be charged with manslaughter? It worse.

Actually as long as the keys are in your hand and you touch the handle to get in a vehicle (exactly what happened) you can get arrested for dui without even the driving part. Even if you're getting in the passenger seat like this woman was doing. You would have to unlock your car via clicker and go to the back seat if you really didn't want issues. 😅

First of all her keys weren't in the ignition so they couldn't give her a DUI in the first place it's perfectly legal to sleep off a drunk in your car as long as you're not in a paid parking area without paying as long as her keys did not enter the ignition she would have been perfectly legal and there was nothing to stop her for now if she had gotten in the car and began to drive away then they could have pulled her over but not before

It might hard to make it stick because she never got the chance to sit down but that would be something the DA’s would decide if they could argue in court, not the police on the spot.
I just watched this episode of "The Rookie" They didnt let her go because she had cancer, she sat in the drunk tank until she sobered up and was released, which is when she explained that she had a few drinks after hearing her cancer diagnosis because she wasnt sure how to handle the news and wanted to forget.

If you park a car in the street in the USA with the traffic direction and it is a left hand drive car (the standard) the drivers side will be in the road. Also, just look at the steering wheel when they are walking to the sidewalk, you can see it on the side of the car she was getting into
Opening the passenger door of a vehicle is not being under the operation of a vehicle in the eyes of the law. Her stop was pretextual and even though technically it might have devolved into a DUI. She did not have the reasonable suspicion to charge her under a DUI at that time even if she was over the legal limit. That case would be thrown out in a minute
St John police showed me mercy , big time I was diagnosed with cancer and I was coming from Fredericton to be admitted to St John hospital my sticker expired I was crying and there was a smoked joint in the car he saw it he asked if I was ok and I told him about just finding out I had cancer he showed true compassion and let me go to the hospital
Sometimes cops can be decent. I got pulled over on Monday. Had no idea why I was being pulled over. I had hit 2 detours and Google maps took me to the wrong place. I had no idea where I was. The cop asked where I was heading, and told him I had a follow up appointment following heart surgery. He was able to tell me how to get there. I had apparently missed a speed limit sign. He didn't give me a ticket. Believe me, I was grateful.
For anyone interested, DUI =driving under the influence. However the exact law states operating a motor vehicle under the influence. The law as intended meant driving the vehicle but the police choose to interpret the law in a way that gets them an arrest. Case above she opened the car door = she is operating the motor vehicle by opening the door. Laws need to be written in a very clear way to be understood but lawmakers love to use fancy word play so the law can be interpreted in multiple ways causing confusion and misinterpretations.
I don't know if IRL a cop could give you a DUI for opening the door, but in america they can give you it for sitting in the front of a car (not sure about passenger seat) while drunk if the car keys are kinda close. So even with the car turned off and keys not in ignition they can give you a record for DRIVING under the influence. Where I live (nowhere near america) luckily it works a lot differently and only if you actually MOVE the vehicle while drunk you can get something equal to DUI. Look up how it works in your country, but I assume america is once again an exception.

Never happened to me, but someone I knew they had been stumbling out of the bar and got into their car to take a nap until they sobered up. She didn’t put the keys in the ignition, she just pulled back the driver seat. A cop rolled by and decided to interpret that as a DUI.

We were always told by cops and parents the best think to do if you have a few too many is sit in the car and sleep it off You have to be miserable to arrest someone who might just be relaxing in their car

In reality the moment they detained her would have been grounds for false imprisonment based on the office "assuming" she WAS intoxicated WITHOUT PERFORMING a CONCLUSIVE test. The only reason why I'm focused on what you would consider a MINOR detail is in fact a MAJOR CRITICAL detail in the fact that in TRUTH officers have infringed upon people's rights by automatically detaining and charging them WITHOUT DUE PROCESS under the law. Take for example the real life case and consequences of a woman who was a bys driver and a male cop decided to pull her over because he LIED and INSISTED she ran a red-light by failure to yield. Then looked into her PROTECTED MEDICAL HISTORY and decided she was driving under the influence(a D.U.I.) and charged her, detained her in a jail cell, contacted her employer and was PROMPTLY FIRED. You want to know what medication it was for?..........seizure medication. It has been posted on RUclips however, I'm not sure if she was able to sue for WRONGFUL termination much less sue on the grounds of a gross misconduct of the law for violation of her civil rights as well as a violation of her right to privacy under HIPPAA law either. Point is the officer had no probable cause much less a true reason to detain her based upon a bullshit assumption.
It isn't DUI until the engine turns over. Legally she could sit in driver seat blacked out drunk with the keys in the ignition but as long as the engine doesn't get turned on all she could be guilty of is drunken disorderly or parking violation.
I love how deceiving cop shows are. You don't get "less drunk" by waiting an hour or two... you get MORE drunk. Cops will intentionally wait hours to give you a breathalyzer because even if you were under the limit when you got pulled over, you'll fail at the station an hour or two later. This happen to my brother two weeks ago except for he wasn't drunk at all he changed one lane and passed all the test when it was time for him to take the blood test the cop didn't have his camera on telling my brother to shut up and cursing at him when my brother was calm when he was arrested he told the officer he needs to get numbers out his phone the officer told him again to shut up in front of other cops.
In order to be a DUI you have to turn on the car. Opening the door does not constitute one. Imagine you realise you're drunk and shouldn't drive and decided to get something from the car before taking a bus to head home. But even then the law is stupid. I have realised I was a bit too tipsy so I sat in my car and took a nap. Had the AC on so the car had to be on. But I had no intension of driving it. But in America that would be a DUI because I'd be operating a car technically. The lakw should account for if the car is in gear or not.
I know many people who got dui’s for sleeping in their car in the bar parking lot instead of driving home. Police only need probable cause to arrest. Meaning the only way you’re getting out of that DUI is if your car keys are nowhere near you at all. Inside the bar or with a friend who is not drunk. If the keys are in the car, in your pocket, on the car, in the ignition, or even on the ground next to the car, that’s a dui. Cops don’t give breaks. Released pending da review just means she won’t spend the night in a cell. She still getting a dui.

I was a juror for a DUI case about 6 years ago. The officer sat outside of a quinceanera for "2 hours" (his testimony), and he arrested the first guy who opened his driver door. He said, "He's Mexican, so I knew he would be drunk." One of the other jurors even went on a tirade in the deliberation room about how, "It didn't matter if the man was actuality drunk, he probably committed another crime the cops didn't find yet." The judge still refused to replace him with the stand-in. It was absolutely wild that I was the only juror who refused to vote him as guilty. The other jurors were more angry about not being able to "make it fast and go home." Some places still care about race more than reality.
This is why I never get put on a jury. I make it clear that I can't say if I will be able to follow the judge's instructions until I hear them. I'm voting with my conscience before the law.

If they wanted to get her for drunk driving They actually were supposed to wait for her to start the car and then drive because opening the door to your own car when your drunk is still legal. For all we know, she could have been going in to get money out of the glove box or to put something in the vehicle. We don't know what she was going to do in the vehicle. I’ve gotten state police knocking on my car door, I was in the back seat, drunk as piss. I had already threw my car keys on the dash and threw away the bottle I was drinking. But I wasn’t driving. I was let go without any citation or warning.
My grandmother, grandfather, and younger sister all died from cancer; I wish this terrible disease didn’t exist because it took the most beautiful people I’ve ever know away from me. I’ve lost everyone who showed me true unconditional love because of this disease and I occasionally don’t want to be alive because of that. I’m okay now after years of intense grief and pain, but if I had one wish, it would be to stop anyone from feeling what I’ve felt after losing someone so strong and beautiful to a disease like this.

For most vehicles that have push button to start with a wireless key fob that doesn't fit into ignition the key and ignition law either needs to be updated or can simply be tossed out in court as the engine wasn't running.
She wasn't operating a vehicle. She simply opened a car door. Doesn't matter if she intended to drive or not. She never drove. Which, is one of the two requirements of getting a DUI.
It's still considered being impaired. 🤷♀️ doesn't matter if it's alcohol, drugs.. you could even be charged if you had a cast on your leg or arm, because it impairs you.
Realistically, they wouldn't charge her unless she was in the driver seat with the keys in the ignition or in her hands. Otherwise there would be way more DUIs as simply being near a car when drunk would be enough. They have to be able to prove intent or the case gets thrown out and complaints or lawsuits will likely follow

I got pulled over on Monday. Had no idea why I was being pulled over. I had hit 2 detours and Google maps took me to the wrong place. I had no idea where I was.
The cop asked where I was heading, and told him I had a follow up appointment following heart surgery. He was able to tell me how to get there.
I had apparently missed a speed limit sign. He didn't give me a ticket. Believe me, I was grateful.
For anyone interested, DUI =driving under the influence. However the exact law states operating a motor vehicle under the influence. The law as intended meant driving the vehicle but the police choose to interpret the law in a way that gets them an arrest. Case above she opened the car door = she is operating the motor vehicle by opening the door. Laws need to be written in a very clear way to be understood but lawmakers love to use fancy word play so the law can be interpreted in multiple ways causing confusion and misinterpretations.
I don't know if IRL a cop could give you a DUI for opening the door, but in america they can give you it for sitting in the front of a car (not sure about passenger seat) while drunk if the car keys are kinda close. So even with the car turned off and keys not in ignition they can give you a record for DRIVING under the influence. Where I live (nowhere near america) luckily it works a lot differently and only if you actually MOVE the vehicle while drunk you can get something equal to DUI. Look up how it works in your country, but I assume america is once again an exception.

Depends on the state. I agree with you but best advice is look up your local laws or sit in the back and put the keys as far from you as you can to establish you never intended to drive.

Where I live, even if you are just sitting in the passenger seat. No keys in the ignition you may be charged even if you are not driving, by sitting in the vehicle you are considered to be in the “care and control” of the motor vehicle. Also they can show up to your home, or wherever you are at and demand a breath sample. So even of you weren't drunk and you went where ever you were going and slam back some drinks and they show up an hour later, if you blow over... you get charged.
They didn't do her any favors. She was under the limit. Period. If she was over, no one cares that she has cancer. 😢 How I wish that compassion was applied for the public, but it's not.
And regarding dui, what crappy ass state has a law that defines drinking and driving as even opening the car door? Thats just sad. Your not driving till the car is moving with an over the limit person, behind the wheel, and on a public roadway.

In reality the moment they detained her would have been grounds for false imprisonment based on the office "assuming" she WAS intoxicated WITHOUT PERFORMING a CONCLUSIVE test. The only reason why I'm focused on what you would consider a MINOR detail is in fact a MAJOR CRITICAL detail in the fact that in TRUTH officers have infringed upon people's rights by automatically detaining and charging them WITHOUT DUE PROCESS under the law. Take for example the real life case and consequences of a woman who was a bys driver and a male cop decided to pull her over because he LIED and INSISTED she ran a red-light by failure to yield. Then looked into her PROTECTED MEDICAL HISTORY and decided she was driving under the influence(a D.U.I.) and charged her, detained her in a jail cell, contacted her employer and was PROMPTLY FIRED. You want to know what medication it was for?..........seizure medication. It has been posted on RUclips however, I'm not sure if she was able to sue for WRONGFUL termination much less sue on the grounds of a gross misconduct of the law for violation of her civil rights as well as a violation of her right to privacy under HIPPAA law either. Point is the officer had no probable cause much less a true reason to detain her based upon a bullshit assumption.

It isn't DUI until the engine turns over. Legally she could sit in driver seat blacked out drunk with the keys in the ignition but as long as the engine doesn't get turned on all she could be guilty of is drunken disorderly or parking violation.

You don't get "less drunk" by waiting an hour or two... you get MORE drunk.
Cops will intentionally wait hours to give you a breathalyzer because even if you were under the limit when you got pulled over, you'll fail at the station an hour or two later.

This happen to my brother two weeks ago except for he wasn't drunk at all he changed one lane and passed all the test when it was time for him to take the blood test the cop didn't have his camera on telling my brother to shut up and cursing at him when my brother was calm when he was arrested he told the officer he needs to get numbers out his phone the officer told him again to shut up in front of other cops.

There’s no justification to arrest her as she never drove
In order to be a DUI you have to turn on the car. Opening the door does not constitute one. Imagine you realise you're drunk and shouldn't drive and decided to get something from the car before taking a bus to head home.
But even then the law is stupid. I have realised I was a bit too tipsy so I sat in my car and took a nap. Had the AC on so the car had to be on. But I had no intension of driving it. But in America that would be a DUI because I'd be operating a car technically.
The lakw should account for if the car is in gear or not.
I know many people who got dui’s for sleeping in their car in the bar parking lot instead of driving home. Police only need probable cause to arrest. Meaning the only way you’re getting out of that DUI is if your car keys are nowhere near you at all. Inside the bar or with a friend who is not drunk. If the keys are in the car, in your pocket, on the car, in the ignition, or even on the ground next to the car, that’s a dui. Cops don’t give breaks. Released pending da review just means she won’t spend the night in a cell. She still getting a dui.

I was a juror for a DUI case about 6 years ago. The officer sat outside of a quinceanera for "2 hours" (his testimony), and he arrested the first guy who opened his driver door. He said, "He's Mexican, so I knew he would be drunk."
One of the other jurors even went on a tirade in the deliberation room about how, "It didn't matter if the man was actuality drunk, he probably committed another crime the cops didn't find yet." The judge still refused to replace him with the stand-in.
It was absolutely wild that I was the only juror who refused to vote him as guilty. The other jurors were more angry about not being able to "make it fast and go home."
Some places still care about race more than reality.
This is why I never get put on a jury. I make it clear that I can't say if I will be able to follow the judge's instructions until I hear them. I'm voting with my conscience before the law.

For all we know, she could have been going in to get money out of the glove box or to put something in the vehicle. We don't know what she was going to do in the vehicle. I’ve gotten state police knocking on my car door, I was in the back seat, drunk as piss. I had already threw my car keys on the dash and threw away the bottle I was drinking. But I wasn’t driving. I was let go without any citation or warning.
I know it is a show, but if it was a man with the same situation, I guarantee they would show the same kind of mercy.

I’ve lost everyone who showed me true unconditional love because of this disease and I occasionally don’t want to be alive because of that. I’m okay now after years of intense grief and pain, but if I had one wish, it would be to stop anyone from feeling what I’ve felt after losing someone so strong and beautiful to a disease like this.

For most vehicles that have push button to start with a wireless key fob that doesn't fit into ignition the key and ignition law either needs to be updated or can simply be tossed out in court as the engine wasn't running.

Otherwise there would be way more DUIs as simply being near a car when drunk would be enough.
