    In US news and current events today, Muslim woman Shahin Indorewala and CAIR are suing Fast Trak Inc after Indorewala says she was denied a job because of her religion. If this is true it would be one of the clearest discrimination in the workplace examples.
    Shahin Indorewala: Everything was going well. [The job interview] lasted about 15-20 minutes and then she explained to me the roles, the hours, how to progress within the company and she said that there would be a two hour lunch break, to which I said, ‘That’s kind of a long lunch break, but is it possible for me to take a shorter lunch break and instead take five minutes throughout the day to pray? And I asked her for two 5 minute prayer breaks, which would amount to 10 minutes total because I pray 5 times a day in accordance with my sincerely held religious beliefs and she promptly ended the interview. She said, that’s not going to work. We have fixed hours here.
    Indorewala had come infor a 2nd interview with Fast Trak management
    Shahin Indorewala: As we were walking back to the office, I thought why don’t I talk to somebody else in charge, maybe they’ll be able to help me out. So we were at the front desk in the office and the CEO Ramses Gavilondo was at the front desk. [...] The assistant manager, she handed him my resume and she said the hours don’t work for her. And it was kind of like he already started looking over my paper and marking stuff up. So I quickly asked him, do you think you can accommodate my five minute prayer breaks and instead I’m willing to take a shorter lunch break? And he said ‘what?’ And I repeated myself very calmly. I thought he just simply didn’t understand. But the way he was asking me, the way he said ‘what’ was also very condescending and I said, well because of my religion I have to pray 5 times a day. And 2 of those prayers are going to happen within the within the hours of the work that you guys told me because it was from 11:00 a.m. to 8 p.m. I believe and I would have at least 2 to 3 prayers that I would have to pray. So I asked him, can you guys accommodate me and I’m willing to take a shorter lunch break? And he said religion, we don’t want that here. And then he pointed to my head scarf and he was making all sorts of like hand movements and becoming very loud and I was still like calm. I was just trying to explain to him the situation. And he was just like religion, we don’t want that here. We don’t want these religious shenanigans here.

    As a boss I find this ridiculous. I have had to accommodate my nursing mothers with extra breaks and shortening up lunches, I have accommodated my Muslim employees by letting them shorten up their lunch and taking their prayer breaks, it is no different than accommodating my smoking employee so they can take a smoke break. It's called being a team leader. And my employees love me and are better workers because I treated them as individuals.

      Sure, but did you do these things under duress of the law... or out of choice?
      By law, it is Employers, not Employees that have the right to set the working schedule.
      Do you also give your employees 2 hour lunches? I know we don't. I'm sure this company has the schedule they have for a reason.

    I'm confused about the comments here, she said she would have shorter dinner breaks to compensate for 2 5 minute breaks to prey. She is offering to work longer? Or perhaps only 1 hour 50 minute dinner break and the other 10 minute cut into 2 so she can prey for them. This literally means she works and breaks equal time as to the other employees. I hate religion and all religious fairy tales and myths, but this is harmless. People are just getting on the hating Muslims bandwagon aren't they.... The problem is all those smokers who take breaks not within their dinner breaks, I gurantee you that company allows cig breaks not within this 2 hour break.

      @tart70 I have never had a job where the employees pick their daily schedule, so I wouldn't know.
      How about you? Do you set your own scheduled at work?
      What about the company that is in this clip... does it allow it's employees to set their own daily schedule??
      That last question is really the only one that counts by the way ;-)

      Religion does not change that, never has.
      You are simply misunderstanding the Civil Rights Act and it's jurisdiction.

      @@aking3624 I do believe what is going on here is the misunderstanding of your rights vs the rights of your employer.
      Your employer does have the right to set time schedules and dress codes... both of which are very important rights to any employer.
      If an employer's time schedule conflicts with your own personal schedule, than there is no need to even apply, let alone complain O_o

      The expensive lesson will be when this lady finds out that EMPLOYERS (not employees), are the ones who have the RIGHT to set the working schedule. They also have the RIGHT to fire any employee that can not meet that schedule, let alone not hire them O_o

      @@andricrypto2852 I agree that the CEO came off as a jerk. She may be better working else were for that fact alone.
      Though the statements the guy said sound offensive, they are actually accurate. Per our company guide lines, we are not to discuss religion or politics at the office. Doing so can get you fired.
      Ironical enough, most companies adapt a no-religion/no-politics policy in order to comply with anti-discrimination laws.
      By doing this, you pretty much eliminate the possibility of one employee feeling they are being treated differently than the others.
      His statement of "we do not do religion here" can actually help him in court.

      They do not have smoke breaks at this company. They only have one big lunch breaks, with no other breaks. It's just the way this company has it's set schedule.

    Don't be biggoted. People are often distracted at work, slack off, take unscheduled or secret smoke breaks, hide to play on their phones and the list of negligence goes on.
    There is no legitimate reason why one can not exercise their way of worship, especially for the devout, if it is not harming anyone. Which it is not.
    Let those bigoted businesses go out of business. Don't seek employment or services from those employers. That will hurt their bottom line far more than a break to worship.

      @@2bRealist I get it. No matter what i say, you will say "well that is not how the rest of business works" or "that is not how a well run business works". Basically a no true Scotsmen to anything i say, thus invalidating any place (of the many in America) that do allow their employees to take smoke breaks, or at the very least look the other way when an employee says "hey, i need to step outside for a min". If _you_ want to run your own business like that im fine with that. I never liked all the smoke breaks my coworkers took while i covered for them. But just because _you_ would never allow it does not mean many places do.

      By law... every employer must give access to their employees the list of employment rights. Most business would post them on a wall for all to see.
      Next time you get a job.. or when you finely get a job... take your time and read your rights, then come back to me with the part that says you have a right to a prayer brake ;-)
      for the record. It is your employer, not you, that has the right to set any schedule, just like it's up to the employer, not you, that has the right to set a dress code.
      If you can not meet the requirements of the job... why even apply??

    Wow... I know there’s always and always will be discrimination in the hiring process and workplace, but I find it shocking how overt this company was and did not even try to hide their racist/prejudism... they could’ve just continued and ended with “we’ll contact you if you’re selected” which is what most racist HR people say to sweep you under the rug.

      2bRealist what’s your point lol? I work for a private company myself that was more than happy to accommodate my time without giving any problems along with many other people and their religious beliefs. Common Courtesy is universal no matter what company they are and employers should always try to work something out with someone who’s is trying to work for them.

      It's not about your belief... it's about your ability to work under the circumstances. This place may have a fixed schedule or a strict dress code, or both. If your lifestyle doesn't fit the job... why apply in the first place?? O_o

      There is a reason that EMPLOYERS (not employees) have the RIGHT to set the working schedule.
      I'm sure those 5 minutes during the regular working time is far more valuable to the Employer than the 2 hours set aside for lunch. What that reason is does not matter. They have a set schedule... the only question at hand is... can you work with that schedule or not? She could not, and therefore did not get the job.

      @@littlemonster6052 To that I agree, but we differ in that I do not believe you have the right to force someone to hire you, and at your own terms... in this case, her own work schedule.
      The great thing about America, is that she doesn't have to... she has the freedom to seek employment from anyone.
      The flip side is that everyone has the freedom of choosing their employees.
      My father is catholic. Religiously wears his rosary around his neck everywhere he goes... except work. At work he wears a tie.
      No one is forcing him to wear the tie, as no one is forcing him to work there... but it is his choice.
      Just like this lady has a choice of taking the job with it's current schedule, or fine one that better meets her schedule.

    Religious Discrimination & Reasonable Accommodation
    The law requires an employer or other covered entity to reasonably accommodate an employee's religious beliefs or practices, unless doing so would cause more than a minimal burden on the operations of the employer's business. This means an employer may be required to make reasonable adjustments to the work environment that will allow an employee to practice his or her religion.
    Examples of some common religious accommodations include flexible scheduling, voluntary shift substitutions or swaps, job reassignments, and modifications to workplace policies or practices.

      Actually yes since I have worked in the middle East (UAE) I am under the law equal to everyone no matter their religion btw prayer breaks for every religion is respected because of the laws here

    I m soo hurt I have never face religion discrimination before ... all my non Muslims frds are so helpful and loving . And today I was praying as always in my library it just take 5 mins to complete my prayers . And they said you can't pray here . This is govt land and authority's dont allow to pray here . And 1st time I realised it's so hurtful to manage to pray prayers in this world .

    I would believe this young lady only if she speak also about how Muslim country like Saudi Arabia treat other religion too. You are not allowed there to pray or practice anything aside Islam. We were prohibited aswell to celebrate Christmas even in simple Way. Young Lady say something please.

    As an Indian I find this hilarious, I mean you do you even have to ask for a 10 minute break? We would take multiple breaks for chai (tea) and namkeen (snacks) and won't even care!
    And As a Muslim I will pray when it's time to pray, I don't need to ask a creation when the command is of my Creator. Period.

    I actually met this guy during one of those interviews where you're sort of young and duped into thinking you are interviewing for a real job. Sparing the details, this story doesn't actually capture the truly horrible nature of the little "ceo" guy. One of the rudest, least professional people I've ever met in that sort of setting.

    she could do 5 minute Duhr prayer during those two hour break (lunch time)... and after 4 PM when the work is over, its not too late for her to do 5 minute Ashr prayer, since Maghrib prayer usually starts at 6 PM. she got 2 hours of free time before Maghrib....

    You work when you are supposed to work. She wanted special treatment and when she was told no this is the schedule didn't like it. She is the employee and doesn't decide her own schedule. Her employer decides that. Religion should be left at home and the company doesn't have to accomodate her. There are other jobs out there and she went after someone else after being told she wasn't getting the job. You don't do that. Her pray breaks weren't going to be allowed so why did she go harass the ceo.

    Here's the problem.
    It's an appication process .
    She wasn't an employee.
    If she'd had. Been then this might be plausible as discrimination but she wasn't hired.
    She made her beliefs an issue not the company.
    Since she would have been supposedly given two hour off for lunch. Why notvsinply her breaks then?
    Normally im for people who have bern discriminated but in this case, the company seemed within their rights not to hire her even if they about it the wrong way.

    Her religion says she must pray 5 times of a day, what if his religion says he can't give work to people who pray 5 times a day? Everyone's spiritual beliefs are different. Some people see a hijab, and think culture. Others see it and think of oppression. If we really want to move society forward, we need to respect others beliefs, but also be modest about our own. Leave your religion at home. Keep it out of the workplace. It's her constitutional right to be a Muslim, and it's his constitution right to hire whoever he wants.

      Does his religion say that though? It's his constitutional right to hire whoever he wants as long as he doesn't violate the Civil Rights Act of 1964, which he did. I see the logic behind your hypothetical argument but the reality is that he doesn't answer to a god that told him not to hire her. He's answering to his prejudice in a way that's diminishing equality of opportunity of employment for a particular demographic. That is not his constitutional right.

      @@2bRealist As I just explained, it is about religion because he's essentially telling an entire section of the population, "You can't work" by refusing to allocate ten minutes, TEN MINUTES, from one part of the work day to another part of the work day. That's a requirement of all Muslims. If he can prove that the allocation, not removal, but allocation of ten minutes in a nine hour work day would disrupt the work day significantly, then it would be legal. But just saying "I don't feel like it" isn't enough.
      I cannot stress THIS enough. The employer has the right to set the working schedule, UNLESS his schedule(or strictness to said schedule) breaks federal law.

    *I understand her plea, but I also understand the politics of a company, in order to be fair to everybody the ideal is that everybody rest at the same time, if you need to pray 5 times a day and you're working you can do a couple of things, you can pray the times that you need to fulfill your quota on your break, or you can pray in your mind while you're working, or simply you need to choose another job that accommodates to your schedule, it had nothing to do with your religion or your beliefs, now what this CEO said about this problem showed his bias and discriminatory behavior, so no he didn't do this for his company but for his own prejudice self*

      There are certain times in a day that prayers should be done. I went to a school where our tests and timetable was arranged so we can accommodate Muslim students, even thought there were only about 20 of them. It really isn't that hard, compared to whole days taken out for Christmas, Easter and Good Friday, two 5 min prayer breaks a day is really not much.

      @@nehamaharaj3368 i dont think any work place should accomdate religion. Athiests dont get days off so why should religious people? I think the bussiness made the right decision. We accomodate people far to much and as we keep acomodatring more and more we are ruining the country.
      Everyone is offended and no jokes or laughter is heard anymore. Its sad we have become so fearful to speak.

      @@nehamaharaj3368 also you say it is that much. But eventually you look back at the start before any accomodations and you realize it was 50 or more tiny little accomodation and it is huge now. Just look at isreal in 1948 to now. They keep doing little tiny land grabs and have almost doubled thier starting size and everyone wonders why palestine hates them. I would almost argue they are acting like germany in ww2 taking small pieces from other countries.

      @@libertarianwhohatesdemsand5741 mattemo I feel that's more PC culture than accommodating diversity. And Athiests choose not to believe in a religion, just like a Christian chooses not to be Hindu. Every religion has their own days which they do certain things in name of their religion, it's not just a holiday to do whatever.
      There's also a fine line between discrimination and prosperity of the company. Like the legislation said, only if the request is detrimental to the company, can it be refuted. But how does 10 min a day (which she is willing to take out of her lunch break) cause the company to collapse?
      Like I said before, when the typical Christian holidays were given, there was no issue. But when other religions question why they aren't given the same rights, then it becomes a case of "its too much". So I guess you're right. It becomes an all or nothing situation. No prayer breaks, no Christmas. It's about holding an equal standard in my opinion.

The thing is though, what type of concessions are these companies making that becomes detrimental to them? In fact, business studies state that the more a business accommodates their employees, the more productive and loyal they are. Like Google, one would say their employees are wasting time doing non-business related things but they're one of the most successful companies in the world. This company was being unnecessarily strict in their negotiations and they didn't expect her to fight them on it.

    I think the problem is she has to pray at the same time everyday. It’s a big risk. What if there’s a meeting? She would have dropped everything and prayed. I wouldn’t be okay with it either. Religion is important but workplace is not a temple. My dad was a lawyer and he had to work late even on Fridays(shabbat)

      There is a broad area in the religion of Islam in times of prayers, the time of noon prayer in the middle of the day, you can pray within only five minutes, the Muslim can postpone him after two hours of entry time and dinner after sunset in the first appearance of the night, five minutes and extend to midnight, You can pray anytime you want

      Women must not go in Islam to mosques and mosques for men only, but the best for women to pray at home, but while working in the company. If the time of prayer has come. He must pray. There is a time in the middle of the day when the sun is parked over your head, and also there is a prayer before sunset with one hour. As well when the sun goes once, as well as at night, and every prayer does not take you more than five minutes. Such Muslim women had to show this prayer in the contract, so that this was approved. Or refuse this work and search for another company agreed to its religion.

      For example... You'r employer could have a confidentiality clause on an employment contract. There goes your 1st Amendment rights.
      You'r employer could have a gun-free zone around the business. There goes your 2nd Amendment rights.
