Legal action for what? Copies clothing designs is nothing new, has been going on for a long time (long before the cheap market). Legally she has no grounds. The sketches of the garments were not stolen and they are not copying graphics. Anyone can take a garment and break it down into the pieces of cloth to copy the design with other fabric. When legal action can be taken is when the actual artwork is stolen or the knockoff is trying to claim it is the original brand product but cheaper (counterfeit). Copying an actual piece of clothing style is considered a dupe just as in the makeup industry when brands copy other brands to follow with the current color story trends.
I also heard Shein is using cheap labor. Not to mention I have sensory issues too so when we first bought from them (and never again) the fabric of their shirts specifically was scratchy despite the fact it was loose fitting
not just cheap labor...the only way they can pump out thousands of NEW items every single DAY is by exploitation and slave wages. but they don't want you to think about that.
this. a lot of people who make clothes have this happen and i’m convinced that the companies they send the design to sell it to big companies. it’s probably in the contract in very small print that they have rights or something, otherwise this is a lawsuit that unfortunately won’t go anywhere due to the extensive resources these companies have. remember that guy that had his design stolen by balenciaga? yeah, that was years ago, and he spoke up about it… he’s missing to this day.
Or shein has an algorithm that rips designs from popular media and they order one single piece of the item and dissect it to get the patterns. It's almost like we forget about how a sewing pattern is made.
In the past I ordered off of shein before I knew anything. Then I found your videos, a couple years back and then found out they stole your designs!!! I instantly stopped ordering from them and I am so sorry they are doing this to you! You don't deserve this at all!! I hope you know how inspirational and beautiful you and your company are! 💖
I never ordered from them because I heard they went, or are, going through an investigation because they, and temu have allegedly been using child labor
My friend has an Etsy shop, she crochets and also does patterns for sale, she’s unique and has amazing designs by her. She posted shein has stolen her patter :( it’s so sad. She’s not even that big of a seller yet shein does it to tiny sellers.
I heard they've been doing these with a lot of people. I genuinely feel for you and them rn I can't afford to get your products but I'll never purchase from such companies who steal people's ideas like this in broad daylight, I have been following you for a long time. I like your ideas and the execution.
It's about quality as well. My daughter invested in one of your sweaters and I practically have to put her in the washing machine with the sweater, she loves it so much. It's still in great condition, I bet the Shein stuff doesn't last as well.
My friend shein 5 jeans and 4 shoes and 20 tops can't even tolerate plain water 😂. She thought them in almost good prices not very very cheap price at all. But it was still so bad. 1 products okay but over 20 products. We literally celebrate her day when she deleted shein app 😂.
I have ordered prior but never will again. Some items come with seams coming undone. Forget about washing before wearing, you’ll never get a chance to wear the item
You are absolutely correct! The sweaters shrink and pill really quickly. Even the sizes and quality are not guaranteed when you purchase multiples of the same item in different colors. I’m single with growing kids and very little money, so this is my “go-to” while I’m working on my financial situation. I’m an ex-seamstress who thrives on quality, so I can’t wait to get back into stores to shop clothes made with the “good” fabric! 🎉🎉🎉
I’ve gotten quite a few things from shein in the past (been like 2 years since I ordered from them), and I only have like 1 top left that is actually in great condition and I wear it all the time. But I’ve had so many tshirts from them that pilled after the first wash and just got worse every time I washed them, every fitness set with leggings was see through, all the kids clothes had issues, and I was just too nervous to actually order jeans from them. I’ve spent hundreads of dollars there and to only have 1 thing that has lasted is really sad
This is how they can sell clothes so cheap. 🤦🏻♀️ They don't need expensive and time consuming designers, they just need somebody who can copy and draw. 🤬
@JonseyTyansi yeah and did she actually get compensation for her design or? A lot of times they hold those competitions to get free work. They say you didn't win yet a couple months later youre work is on the website. While shein does have some original work they do steal a lot of others.
I just don’t get why this store is outright stealing the designer's work instead of simply making a deal with them. If they like the designs, they could easily reach out and set up a contract to pay for using those designs, rather than resorting to theft it’s so frustrating and unfair! Companies really do just be greedy sometimes.
I've been ignoring all the dupes for ages and I FINALLY bought a piruette skirt and cross leggings from you. Easily the best purchase I have ever made 😭💕 I went and sweat my body off at the theme park in those leggings and didn't feel a single drop of it! No chaffing, no itchy tight feeling, no scratchy feeling from thigh fabric rubbing when I walk. Just pure enjoyment! I also fit our fat theme park cut in the pocket the whole day without stretching out the pockets! I was worried about the skirt shorts not being long enough to cover the chaffing bits but they do! So excited to wear that one next time! Your products are worth every penny!
All of my friends love shopping there because of how cheap it is, but I don't care how broke I am, I will never shop with Shein. They don't even at the VERY least give credit for every design that they stole
I can totally feel you. I had my startup company and we were selling really well on a design when a few months later SHEIN made the exact same product at only 1/10 of its price. Nobody was buying my design anymore …
You sue them 😡! You are the best out there! You have acknowledged and addressed problems that we girls /women have been facing since ages and you brought in rugged fail proof solutions (after application of your mind and experience) and turned them into a reality via your designer clothes which were clearly an amalgamation of Comfort + Aesthetics + Feel +Functionality which no one in the market has ever achieved yet that too in the affordable price range! I am an admirer of you and your work ever since I laid my eyes on them! And these videos literally make me want to sue them and get in the legal battle (whatever it takes to stop them from. Copying your work! Or infringement of patents)!
It's really hard to sue Chinese companies, also takes a lot of money to sue in the US as well. Best thing to do is spread the word and don't support Shein no matter what
Plus she only has two of the required patients. She can force them to take down two of the designs but the rest are still technically fair game… it’s a murky situation especially with the child labor and unfair working conditions allegations and it’s been all but proven. SHEIN is just a big mess of a company
@@JessicaTaylorIO yup. Chinese companies like to steal and we can't do anything about it. Chinas culture is to get rich quick, so they cheat and steal and their society finds it normal.
Unfortunately they won't be helpful. The last time this happened Shein told her what to do to prevent it from happening again but she just refuses to do it because she gets more media focus with these types of videos.
@@magic1623 What do you mean she refused to do it? Two of her designs are now patented because of what Shein did, and you can't just fill out a form and get a patent for clothing designs. It's the industry that refuses to do the work, not her!
Clothes are often un patented. If not, Levi’s could be the only brand alllowed to make jeans for example. Only specific innovations can. And good luck suing a Chinese company. They don’t care and won’t get pursued there. Shein has an algorithm scraping social media to find any new clothes, they get added very rapidly to their catalogue and start getting produced immediately.
Patents are extremely expensive and pretty much useless in the fashion industry because trends change so quickly. Plus, she’s not exactly reinventing anything that would be worth patenting anyway. It sucks but the industry has thrived off of stealing designs.
Het stuff is fast fashion quality now as well to be clear. When she got bigger she moved to a fast fashion factory in China (it comes with 'made in china' stuff on it now).
The only problem with that is you can't actually copyright clothing designs, meaning the shape and construction of a clothing item. Unless Shein were using her trademarks, like the names of the designs or the names of her company or her logo, there's actually nothing she can really sue over. That's the precedence that allows companies to sometimes go after knockoffs, but it's not because they copied the design of the shoe or purse or whatever else, it's because they are using the trademarked name/logo. It makes sense if you think about it. Imagine how much of a problem it would be if someone owned the design for a generic T-shirt, or owned the concept of pants. It would be a huge issue. Unfortunately, it allows companies like Shein to steal designs, put their own branding on it, and sell it for profit.
@@Jazzatic2011there’s definitely grounds for something. But was that also Shein ? You won’t get anything from suing a Chinese company, especially for copyright/proprietary purposes. (If they used her pictures in advertising or the site it’s different) you can’t own the shape of the clothes, so anyone can make it including massive fast fashion brands that use an algorithm to copy as much clothes as possible.

Now, not only will I never buy from them, but I tell anyone who mentions them the shady ish they do and convince anyone and everyone I can not to shop there either. It may not seem like we’re winning the war but some of us are out here winning mini battles for you. ❤
A friend of mine heard about Shein and posted on Facebook asking people's opinions of it, and I was the one person who said I wouldn't shop there because they're very shady. But there were so many people talking about how great and cheap it was that my comment fell on deaf ears. 😔
I love that you're not bending to the standards of women's clothing today. Your clothing isn't slutty. It's cute and comfortable and can be worn on any daily occasion. 💜 Also. I do NOT shop from SHEIN anymore. Sadly, your designs are not the first to be stolen by them that I have discovered. Their customer service is horrible and scamming. When I was ordering clothes from there in the past, more than once did I find the word 'help' written in what looked like sharpie on the sewn in tags of the clothes...... The company seems really flipping shady, and when I made several attempts to report them however I could and bring attention to them online, nobody seemed to really care. 😬 It's good that this video was made, and I hope it brings more attention to the company than what my attempts did. 😅
I get bombarded by ads for Shein so I decided to look at their website one day. I noticed that they had stolen your designs and had copies of LV handbags and Chanel bags. I've never been so disappointed and disgusted by a "clothing?" company in my life. I cannot fathom how they're allowed to get away with it.
Hey cassey! I just wanted to say that all your designs are unique and beautiful and that SHEIN will never get them as perfect as you! You’re amazing keep going and ignore them! Your hard work will be worth it! Love you! ❤️
You have to contact the Antitrust and the copyright company and report them, but most important need to have a "Prototype" of your logo design registered in Italy works like that to report them legally! so sorry: people fight a lot to pursuit their goals and companies steal their ideas it's so bad!! Wish you luck to stop this situation ... 😢😢😢

Have you considered designing the Ultimate Tights? They could be paired with a lot of your skirts for the girlies who want less skin showing, and i *know* you can give us something better than those easy-to-tear mass produced stuff. Maybe something that looks better too! On a similar note, maybe a cute but thin undershirt with varying sleeve lengths! As a fellow designer I can feel the rage radiating from this video and I completely understand. It’s is so messed up and the way copyright and patents work is just so shit when it comes to fashion because they don’t fall neatly into either of the possible defendable categories and are therefore hard to protect. Also because Shein is a purely online based store from another country it’s pretty much impossible, and they just get away with it. If you have ever thought about purchasing counterfeit clothes *especially* counterfeit of smaller designers *JUST DONT!* You wouldn’t like to have your work stolen I’d imagine
If you don't patent things that can easily happen. There's no ethics in business. I heard someone was walking in Walmart looking at products and actually patented something that was ALREADY IN THE STORES ON THE SHELF that someone else developed produced and was selling. They pursued it and now for the next 7 years they will get paid a cut for everyone of those that the other people made. Read it in the 4-Hour work week by Timothy Ferris and I believe it to be true.
She has patented her design thankfully, I saw 2 videos about it but I don't know exactly how many design received the patent approval... patent process is gruesome
Legally they can change 5 items to make it different from the design. It can be something as small as a button, a slightly different color, a somewhat longer length, or even the stitches or stitch length used. The fashion industry is crazy and designers need to be protected from copyright and theft better. Learned all this in some of my fashion merchandizing classes.

A lot of fast fashion brands do copy styles. Zara and H and M will get inspired from run way styles and bring us the cheaper “dupes.” Sometimes these stores do get sued for copying but most of the time it’s over looked.
This has been happening to a lot of companies for ages. It sucks but it’s unavoidable. A lot of Amazon “dups” that everyone is raving about are made the same way, shein just happened to be the one that got caught.

@@gippooverground8067broke people ESPECIALLY shouldn’t be buying clothes from SHEIN- their items are cheaply made & most end up in a landfill less than a year later. If you don’t have a large budget for clothes you’re better off adding to your wardrobe from thrift stores, yard sales, or other second hand shops. It’s better to spend a little more on quality items that will last longer instead of constantly needing to replace cheap items that fall apart quickly. (Vintage clothing is typically much more durable than anything produced in the last 5 years) For example, I just thrifted a Nike skort for $3 & that money funded a local charity. Super unfortunate this is legal. Even more unfortunate thar many might not agree with this action on their behalf of clearly ripping off your designs... the issue is they are able to charge extremely low prices compared to someone like yourself ( products not as nice clearly) but the sad fact is we live in an expensive world and most people will purchase what they can afford. Stay at home, mom of 2 pregnant with my third, and prices of things are the #1 for me these days . I used to shop it o there and then saw that they were selling HP, Lenovo, asus, Nike, and even woman within WITHOUT COMPANY PERMISSION. The way I know it’s without permission is because I messaged these companies and they said they had “no idea” SHEIN was reselling there products. Especially HO
I think it’s the factories in china who “leaked” the design and construction. In china, it is known that some factories sell the products they make for big brands for profits. For example, I saw the Kiehls facial mud mask on the Chinese internet. The ingredients are the exactly the same since it “comes directly from the factory”. The price is of course a lot cheaper than kiehls price, so they make a lot of profit. The same with clothing brands. Nike, adidas etc. they are not fake, they are legit factories that work on the behalf of these companies. They just decide to sell some of their products by itself. I don’t think there are many regulation about this, it’s more like a black market. And people gain a lot of wealth, which leads to corruption. And Chinese consumers are not very well educated on copy-rights, infringement, or so on. (The Chinese culture just doesn’t respect the name “artist”or art in general, so the laws are very weak, compare to the west) They only focus on the price. It has become better each year and much better than before, but I would say under the influence of consumerism, it is unlikely this would stop in the near future.

@@sweetla4750 so true
Why are you saying “an” legal action? It’s just legal action lmao. Your sentence is grammatically incorrect.
Fr tho
I also heard Shein is using cheap labor. Not to mention I have sensory issues too so when we first bought from them (and never again) the fabric of their shirts specifically was scratchy despite the fact it was loose fitting
not just cheap labor...the only way they can pump out thousands of NEW items every single DAY is by exploitation and slave wages. but they don't want you to think about that.
Part of me is wondering if the factory you are getting your designs made at is actually selling your designs to SHEIN…
More likely than not
this. a lot of people who make clothes have this happen and i’m convinced that the companies they send the design to sell it to big companies. it’s probably in the contract in very small print that they have rights or something, otherwise this is a lawsuit that unfortunately won’t go anywhere due to the extensive resources these companies have.
remember that guy that had his design stolen by balenciaga? yeah, that was years ago, and he spoke up about it… he’s missing to this day.
Or the company is part of Shein
Or shein has an algorithm that rips designs from popular media and they order one single piece of the item and dissect it to get the patterns. It's almost like we forget about how a sewing pattern is made.
It's quite common. If you manufacture in China, you're literally giving blueprints away. @@kabiraningangom1248

This happens to so many people, it sucks especially for the small businesses.
awww that makes us so happy to hear!🥹
Cheap dosent mean everything. I heard that shein has their design team, and I have a designer friend who once participated in their design competition
@@JonseyTyansi Lovely, what about the child labour
@JonseyTyansi yeah and did she actually get compensation for her design or? A lot of times they hold those competitions to get free work. They say you didn't win yet a couple months later youre work is on the website. While shein does have some original work they do steal a lot of others.
they also literally don’t pay their workers.
Nah they rlly trying so badly 💀

They do this to so many indie designers, you should form a class action
this is a great idea!

A friend of mine heard about Shein and posted on Facebook asking people's opinions of it, and I was the one person who said I wouldn't shop there because they're very shady. But there were so many people talking about how great and cheap it was that my comment fell on deaf ears. 😔

As a fellow designer I can feel the rage radiating from this video and I completely understand. China doesnt follow the rules and regulations other countrys do
I used to shop it o there and then saw that they were selling HP, Lenovo, asus, Nike, and even woman within WITHOUT COMPANY PERMISSION.
