In the video Jordan was playing a Cm7 chord for that minor bluesy sound, and an Eb7 for the brighter sound. This scale can be used over lots of different chords, but sounds really good over 7th chords.
Great question! These are notes that are "outside" the key signature. They are technically called "non-diatonic" in music. While they key signature is a great starting point for figuring out what notes to play, the best thing about music is that there's really no rules!

There is a key signature with those two accidentals, however, so the necessary follow on is what makes this set of five notes C related instead of that other key?
