      👍 it's way too simple for cops to understand. San Antonio cops average sub-100 IQ. I've had numerous go-rounds with a few of them about 38.02 and every one of them tell me that McmAnus is the one who tells them "ID at all costs immediately because you got called." I tell them "Bullshit. Each time you do it, you're breaking the law and exposing yourself and the city to a federal lawsuit. You need to knock that sh¡t off.” DO they listen? *NO.* It's always "McmAnus tells us, McmAnus says..."

    Even after the lawyer begged the officer to arrest him so that he could collect a nice legal settlement the officer STILL requested his ID again, and told him "that's how were going to do it" It really makes you wonder if these officers use their brain at even 1 percent capacity. Dude was really trying to convince a lawyer who wants to sue him to give up his rights 🤦‍♂️🤦‍♂️

      Because the lawyer HAS TO BE RIGHT when they quote a law or they are open to litigation from their client or discipline from the state BAR. Not so for police. As long as they have a " good faith" belief that they are correct about a law, they are protected.

    So let me get this:
    - his facial features did not match
    - his clothing did not match
    - his shoes did not match
    - his body size did not match
    - his phone number did not match
    - the victim said it was not him
    Cops: Meh..... I think it is him let us arrest him. Than later after they knew it was not him and arrested him illegally: Hmmmmm what can we charge him with so he'll go to jail anyway although he was innocent. And only AFTER media attention everything was dropped.

      Later, during the incident, they got his name. Even tried to call perp's cell phone (hoping suspect's phone would ring) This call was made AFTER victim confirmed suspect perp.

      It was the victim's husband, they knew his name the whole time. They just got their feelings hurt because he stood up for his rights so they wanted to teach him a lesson by not fully investigating whether it was in fact him or not.

      I was thinking the exact same thing. I know they can’t take him to the jail if he looks like the suspect, but if he clearly doesn’t, they should have let him go. If he looks similar to the suspect, THEN transport him or the victim for identifying him. Also, that cop asking for her to have her baby on her lap while they brought her over was a stupid call. I’m hoping when the DA said they were dismissed, I hope he meant from the force.

    The arresting officers wanted the charges dropped too. I guess they figured out finally that they had been on camera and didn’t want to get sued. Should have been fired immediately.       It would be possible that an abused partner might not want to identify them in front of the police fearing future incidents from the abuser. So, in theory, it wouldn't be that crazy for the cops to make sure she is being truthful about it and not lying out of fear. This lady was obviously not afraid of that considering she called the police and was honest about it not being him.

    This same thjing happened to me when I was younger maybe 17 or 18, except I was able to make the cops do the walk of shame and call them idiots. they stopped me in rush hour traffic while jogging in Canada over a supposed domestic dispute in the area. If this ever happens again Ill be sure to hold them accountable.

      But a beard increasing from 'scruff' to "full" in less than 30 minutes, is not possible.
      When I watched the Arresting officer bodycam, just after it happened, the AO says something about noticing the suspect when he left the apartment complex.

      As was pointed out above, the cops had a description, not a name. If they actually thought he matched the description, they would've immediately arrested him. This had almost nothing to do with solving the crime. This had to do with getting the guy's name so they could run him for warrants.

    The fact that the officer is shown on his own body cam fiddling and what appears to be spinning his wedding ring is definitely a sign that he's anxious and feels under duress while his fellow officers are questioning him? Now think about that for a minute, how many times have we heard a police or Sheriff say to someone they've pulled over "why are you nervous,you're shaking" and then imply that they must be guilty of something? The next question is usually some jumbled command I need you to step out of you car so they can distract you while his partner does an illegal search of your vehicle 🤔

    I salute Mr. Ometu for not sitting like a dog and barking when told to speak. We all need to risk it all or risk losing it all anyway. The only thing I'd caution is that you can catch lawful charges by physical actions. Your mouth is your only tool and weapon. Know your rights and don't let anyone take them from you. The Constitution supercedes any other law in the land. That means the Constitution trumps "rules" or "policies" or "requests/demands" or your feelings. Thank heaven that we don't have "feeling enforcement" officers.

      Take a picture was my thought as well but he shouldn't have even had to do that. When the cop was on the phone with the other cop the one said he had just scruff on the chin and the jogger had a huge long beard like wtf. It takes a couple of months to grow a beard like that.

    This is like a fever dream. They grab the guy. It’s not him. They have the witness come to the scene identify him. She says it’s not him. So then they get the phone number for the suspect and call it to see if it is the same guy, even though the witness said that it wasn’t. What the hell?

      Forcing someone to stand in front of a camera and taking pics against their will will is false imprisonment and a 4th amendment violation. They can catch a candid pic of you walking down the street, etc, but they physically can't force you to be in their pics against your will. And if they move you at all to get the pic, it's kidnapping.

And forcibly moving them to a place to get their pic is illegal. The first amendment only gives you freedoms to record up to the point that they infringe on freedoms of others.

    What I found very interesting about this encounter is this: When the officer(s) realized they were wrong, none of them, not one, stopped, and said “Uh oh, we screwed up. How can we make this better?”
    Maybe someone would have said: “Let’s release him and sincerely apologize. Let’s ask for his forgiveness. Let’s give him our names, badge numbers, and the number for the department so he can file a complaint.”
    Why do I say this? Because as a lawyer, I had a couple of situations where I made mistakes, one led to blowing the statute of limitations in a lawsuit. As a lawyer, I had an ethical duty to explain to my client what happened, what I did wrong, and they she should get an attorney to look into her options. I actually told her she should sue me as it was an easy case.
    Law enforcement have no such ethical obligations, however. And now that I think about it, I am unaware of any ethical code specifically for law enforcement officers. Most states, counties, municipalities do have applicable ethical codes in some form or fashion, but I am unaware of an ethical code for law enforcement specifically. I think I will research that!

      They also don't take into account the disruption police are to citizens. They handcuffed on the side of the road while people can see him. It embarrassing stressful and demeaning. Try and put handcuffs on one of them. They beg the arresting officer to not do. Not if front of other cops, family, or in public. All you have to do s comply to be seen if a shameful way.

    An individual is not suspicious just because someone says or thinks he's suspicious.
    No one has a legal obligation to assist police in their investigation and that alone without more is not a probable cause for arrest

      do - I was detained for four hours in Austin TX in 1975 for armed robbery, double homicide, drug deal went wrong. I was threatened three times with being hung for murder. After four hours, they asked the three witnesses, "Could he be 6'1" ?"

    The idiot cop says, "I'm not a betting man, but I'd definitely say that was him," despite the alleged victim clearly stating - on camera - that the detained individual was NOT her husband. You really could not make this stuff up. This extremely poor policing, combined with the juvenile attitude towards conducting a preliminary investigation, probably explains why there are so many innocent people in jails and prisons around the globe today.
