    Malfunction does void all pays and plays, HOWEVER... these machines' progressives are set by HUMANS. The attorney is 100% correct. This isn't a computer glitch. The casino forgot to go inside the machine and adjust the progressive. While yes, it's outrageous to see $1 mill. jackpot on a penny machine, that's not the fault of the machine, it's the casino employees not adjusting the progressive properly.
    The casino really misconstrued the word malfunction to win this case... what a sin.

      mrchumpus-----the machines ARE PROGRAMMED by humans...a computer can only do WHAT it is programmed to do......so, an employee did NOT do their job....therefore the casino is liable.....

    this happen to me! i won a 212,000 jackpot while people around me were clapping even the pit boss across from the game saw it and was clapping then the machine turned off and started the spin again which landed on 40 dollars. When I spoke with the casino and the gaming commission i was told it would cost more to fight it in court then to just let the jackpot go! It was on cameras which are almost every 10 feet away yet the casino called it a malfunction and refused to pay! This was a big name casino "the Belagio" in las vegas! As if a 212,000 jackpot would break them it seems to me they just do not have the money on hand to pay what they claim and legally are supposed to have on hand to pay!..... DO NOT PLAY AT THE BELAGIO IN LAS VEGAS NEVADA!

    It's not a malfunction! It's casino negligence! I've had a dealer screw up the cards before on a "carnival game". I had a very nice paying hand and they forgot to give themselves one extra card and they called it a "malfunction". I argued that with everyone that would listen but they would not pay me. It was a dealer F*** UP not a malfunction! This is not a malfunction either but the casino being negligent and not noticing that they "SET" the jackpot at a million. Anyone who plays video poker would realize that something wasn't right that a 1 cent machine would pay out a $1M! Everyone in town and from around the world would be sitting there if it payed out that high.

      Kris Green , I had that also happen to me at local indian reservation casion in washington state:
      ClearWater Casino!!! - Right when I thought I won more then I could believe $$$$ the security team
      and the casino itself ran to try to void it and they did so saying it was an error on the Dealer and how
      the cards were delt!!! Beware of indian reservation casino's!!! Such utter BS!!! And even with a story
      like this, I agree with you there as well...

      except if it was a true mistake on the dealer, and it goes against the rules of the game...then it's against the rules. That is different then having the wrong payout displayed.

On that same machine it says they do not payout over XXXX amount of dollars. In this case I believe it was 20 Thousand. You and everyone here knows this was a malfunction.

    In my view, the Casino is obligated to ensure its machines are working properly. Failure is on their head, and they should be the ones to pay for that mistake.
    If I go to use an ATM at a bank, and suddenly the machine starts shooting out $100 bills, in my view, that's my money now. It was the bank's responsibility to maintain the quality of their machines, and without me doing anything illegal or nefarious, the machine failed.

    As a casino frequenter myself. She should now what the jackpot should be on the game she's playing.If she hit the royal she should win what it pays and obviously the million dollars was not what the jackpot pays.Whatever the error she should not win the amount show.If a lawyer can get her the million there must be an absurd legal loop hole cause the answer is obvious to me.The amount shown the million is incorrect.

    I was told by a person in my state on the gaming commission that a malfunction can me anything they want it to be. She won, they need to pay her. But a Million bucks off a small dollar bet isnt' likely. They still should pay her. They didnt' upgrade the machine, its not a malfunction in terms of the machine acting up. Like the guy said its human error.

    You have to be on at least a $25 machine to see a progressive over $1 million in my experience. The casino should just cough up the dough. A malfunction is a mistake that is beyond the casino's control. This wasn't that kind of mistake. They fucked up, just like the guy who blows his kids college fund. Therefore, they should pay up.

    When I was a manager at a tribal casino I had a customer do this. A malfunction price popped up and the customer(a regular) knew damn well that it was a malfunction price, and still tried to claim it. Most regulars know the machines and payout better than the employees.

    I would be surprised if they didn't pay.... I had this happen in Lake Tahoe, where the NICKLE machines were supposed to be QUARTERS. Every nickle in, 5 credits on the screen and payouts same! I made several thousand dollars cycling nickles through the machines that night!

      +Dick Trickel Exactly. This has been tested in court many times and has never won. It is not the casino cheating you out of a huge win. What this is pure and simple is failure to upgrade the firmware on the machine. It is a malfunction caused by human error. People really just don't get it. This is not even news worthy.

    Every VP machine I have ever played gives you the top jackpot at the top right of the screen. One credit two credits and so one up to the last credit. There are usually five credit levels. No casino is going to pay out a million dollars on a penny machine ever. Plus she was playing pennies and there is no way a dollar bet wins a million bucks.

    I think all malfunctions should pay since, the public are taking risk with their money, therefore i think the casino should acknowledge their risks with this scenarios since, they are purposely putting that machine on the floor to try and make money at a risk someone might win, someone in this scenario did win, pay up.
    It now is their problem since, THEIR machine malfunctioned and the women got very lucky since, this does not happen often.

      +Oliver White Yet they didn't win. The payout was a human based error malfunction. The machine did not have the ability to pay over 20K so 1 million was an impossible win. Therefore the player did not win 1 million. They simply won the 800 dollar progressive.

      +Arizona Flutist A human error by the player is supported by the player. A human error by the casino is supported by the casino. They are responsible for the good setup and maintenance of their machines. Any malfunction is a failure to properly manage the equipment. The only valid reason for the casino not to pay is to have proof of cheating.
      The casino should be forced to pay AND face a fine for bad maintenance plus a review of the incident by the gaming committee to decide if they can keep their licence. Then they can support the cost or seek compensation from the manufacturer depending on the real cause of the problem.
      If bad maintenance is considered rightful cause to not pay, this means the casino has an incentive NOT TO maintain the slot machines so they have an opportunity to void any big win whenever they want.
      As long as the player is concerned the contract with the casino at slot machines is "you put money in, you don't cheat and you get the amount displayed on the screen". If the casino says the machine is malfunctioning and refuses to pay then they must cancel all previous plays on this machine and reimburse every single coin that was put in it.

    When people are actually playing on these machine, malfunction voids all pays is at default. Meaning pretty much the machine don't pay at all. Patrons are losing 99 percent of the time. Anyway compensate her with something like $20,000 instead.

    Say the gambler is drunk and malfunctioning... Shouldn't he/she be allowed to get their money back? Or is it the gambler's responsibility to gamble responsibly? My question is rhetorical but if they're ready to fleece you, why can't you take their money when they malfunction or make a mistake? Ask Phil Ivey...

    This is a crock of shit. The casino can at any time arbitrarily say the machine malfunctioned. Notice how they always claim malfunctions on 5 - 6 figure payouts. No one ever hears of the casinos claiming payout malfunction on a $1500 payout or something like that

    Is there really any such thing as a penny machine? Most of the penny machines say 1 cent on them but then have a minimum bet of 40, 50 or 75 cents and maximum bets of 4 , 5 dollars or more. The machine clearly said she won a million dollars so the casinos should honor what the machine said.

    if this casino is smart they will settle out of court and pay her the mill without hassle. it was their error and its gonna cost em. if they bring negative attention to themselves it will even cost them more.
