We consider the Brazil Digital Nomad Visa a great option... It allows you to legally reside in Brazil if you can prove you have an income of approximately $1,500 USD per month or you have $18,000 USD in a bank account. We can help with this process..

What is the difference (cost, process time, documents etc. ) between the Brazilian VITEM XI and the Permanent Residency Visa by Spouse. I had my old lawyers for over 7 months and they were not that good. They never talked to the Federal Police, so I owe a HUGE fine when my 90 days expired in April. I need to make it easier, especially to return to the USA for updated documents and storage of important items.

Roddie, picking the right law firm can make a big difference in the outcome of your immigration applications. Unfortunately, what you are sharing is not uncommon. Giving the seriousness of your situation, we recommend a consultation to go over all the details and advise on a proper route.

@@oliveiralawyers Thanx, I actually did call, but my advisors, in Fortaleza said i had to work with someone from my own area, especially because of the Cartoria. We have some great new lawyers and i have 60 days to go back to the USA and get updated documents. For better or worse, i live very, very far North where this type of advice is not common. I am sure if I was in Sao Paulo or Rio, I would not of had any problems.😎

Glad to hear you are in good hands, Roddie! We have clients from all states - many actually in Fortaleza. Most of our clients wait for the results of their immigration applications in Brazil while getting their needed documents from abroad without leaving the country. From apostilled birth certificates to criminal records, nowadays virtually anything can be handled remotely. Consider participating in our live streams on Wednesdays and Sundays. We would love to hear from you live!

You mentioned if a foreigner becomes a perm resident, they have to declare income. if all the income is coming from abroad, does that still get taxed? or is it only taxable if the income came from brazil?
And in that situation, if I was to have perm residency, but I am still only staying in Brazil for less than half the year, does that impact anything tax wise? Asking, because you mentioned the DN visa excludes you from tax residency if you are there for less than half a year
    Thanks!

Thank you for asking. For tax residents, Brazil will usually tax your global income unless there is a tax treaty in place. A tax credit approach may exist to avoid double taxation. Permanent residency triggers immediate tax residency and creates a presumption of continued tax residency. Nuances and exceptions apply and cannot be addressed in short questions and answers.

What about tax residency for golden visas obtained through real estate purchases

    • @oliveiralawyers
      @oliveiralawyers  Год назад

We have an entire playlist on the Golden Visa through real estate purchase: ruclips.net/p/PLBx0ly376KZqw_GmDykwf3zcqZGEiWUmy
Golden visa will usually have a period of temporary residency followed by a permanent residency. While our interpretation is that the initial temporary residency granted by a qualifying real estate acquisition does not automatically trigger tax residency, we recommend our clients to always secure a consultation with a Brazilian tax attorney to better evaluate their tax planning.

Infelizmente não somos especializados em vistos para portugueses. É possível sim que existam caminhos diferenciados devido aos tratados entre os dois países.

Can I register a company and be a 100% legal rep. of the company with digital nomad visa? I know I need a partner as well but please advise if it is possible. Thank you.

Dear cap nadersab, thank you for your participation in our lives! You bring interesting points that have not been addressed before and that help the expat and foreign citizen community to learn more about Brazil as a whole!
As discussed in our live, we don't think that a temporary residency under a digital nomad would help you qualify to become the legal representative of a company in Brazil.
Digital Nomad Visas' underlying resident cards in Brazil will usually clearly indicate that the residency allowed is temporary. When the Junta Comercial ("trade board") in charge of enforcing this requirement reviews your documents, they would most probably refuse to accept you as a legal representative.
Examples of residencies that would potentially allow you become elegible as a legal representative: marriage-based and real-estate-based residencies.

can i rent a house using this visa? They are refusing to use my usa income even though i have cpf registered with Brazil

    • @oliveiralawyers

The RNM card which you obtain through the Brazil Digital Nomad Visa would make it easier for you to rent a house. The RNM shows that the foreign citizen is a legal resident in Brazil. This would assuage concerns a landlord may have about renting out to a foreign citizen.
This said, having a CPF or a RNM card does not mean a landlord will be required by law to consider your income abroad. It is customary for Brazilian landlords and financial institutions to prefer income in Brazil since they can more easily verify its legitimacy.
One way to reduce landlord concerns is to offer a larger secure deposit. We have seen in our experience some foreign citizens paying up to an entire year upfront to secure a highly desirable rental property.

90 days is a potential timeline (the analysts are free to ask for a fresher version or even documents not originally mentioned anywhere). As it may take a while for the analyst to get to your application after filed, we always recommend a fresh one to be used.
