you probably could, as long as you're not using anything that comes from an official game or making a profit off of it then there's really nothing they could do legally? though they'd probably still find a way to take someone to court to get them to waste money on a legal team.
@@ShoppingatAM the problem is Nintendo's track record with Roms, specifically Pokemon related Roms. They seem to have a vendetta against most rom hacks or fan games. Most are safe as long as they don't look for payment, but Nintendo can always raise a fuss about it and get them taken down anytime they want.
@@countcr33perThe thing is, pokemon tower defense existed for as long as the server hosts were willing to keep it online (~8 years iirc) and they even made money off it with a premium service. So if its a totally unique concept then it wont be taken down
