    What happens if an employee gets injured in the work place because of a faulty equipment provided by the employer. Can the employee benefit from Worker' comp ( which will cover : economic loss meaning wages and medical expenses) AND sue the employer as well for being negligent in providing a faulty equipment ( I guess the would sue for pain and suffering since one cannot be indemnified twice for loss of wages / medical expenses.) Is it one or the other, or is there a possibilty for an employee to benefit from W/C and sue its employer for its negligence in specific scenarios. I understand that W/C is in place in order to protect the employer and requires that the employee gives up its right to sue the employer, but what happens if the employer' actions or decision is the cause of the injury. Many thanks !

      Taking some of the legal issues out (as I am not a lawyer nor is Rogue Risk a law firm), in this case (as described) Workers' Comp would respond. Any gross negligence matters related to work environment would have to be discussed with an attorney.
