Law needs updating, if an employer wants to control an employee 24/7 then they need to pay for those hours. Otherwise an employer has no say in what someone does out side of paid hours.
I got fired for saying online the place I worked at was run by idiots, after they knew I had a 3 hour commute, and they told me to go home after 1 hour of being there to "prepare for my end of probationary period meeting". Why they couldn't have sent me a message while I was at home is baffling. Now I just don't include where I work on any of my social media profiles.
My employer once made us sign a policy stating we would be fired if we receive pornographic images in the workplace. This wasn't due to any incident involving myself, However I did point out that the policy was flawed because anyone could setup an anonymous email account and email images to her and then because she received them, she would technically be in breach of the policy and could technically be sacked. I signed it anyway believing it would be unfair dismissal if I was sacked for receiving an unsolicited email with this stuff on
Can your employer dismiss you for gross misconduct if you have a rant to your friend in a private WhatsApp chat about your leadership team just between the two of you that the friend then uses against you when they raise an allegation against you (that has no relation to the chat but is used to show unprofessional conduct)? The comment made was the leadership team were s**t.

You might say what has that to do with your job application, and I would answer why has mine anything to do with it either? We did not have this level of intrusion pre-social media era.
Sounds like to me it is a erosion of your freedom of speech. If the employers are saying you are representing them 24/7 that means they need to pay you 24/7 for representation. That sounds like a big bill coming their way?
If you look at some of the examples it’s not freedom of speech, it’s hate speech and bullying behaviour. People aren’t dismissed for well constructed commentary.

Absolutely. The only exception I can see. Is if you are in charge of a company social media profile. But then again, you're being paid to do that.

So I guess people at job interviews should ask the potential employer, if they engage in spying on their employees via social media.
