I love Judge Simpson, I have been in front of him before many moons ago and he gave me a break that I needed and now I'm one of the executive Chefs of one of the most sought after restaurants to eat at here on the west coast. Hopefully I can run into Judge Simpson again at Meijer when I visits home for Christmas
He's a great judge, usually. But on this case I don't see why he needed to string it out so long, the long pauses are not needed. If the kid wants to be in jail, let him go to jail. Don't make other people that are waiting for their case to be heard, wait through such unnecessary bullsh_t!

He's taking the time to craft a sentence, in cooperation with probation, that gives the defendant the best possible chance of getting hid life in order, not only for the defendant's own sake, but for the sake of his child... Yeah he's depressed. I don't know that but speaking personal experienced he sounds like me about a decade ago lol. It's hard to describe but when you're brain chemistry is messed up just getting up in the morning going about a normal day feels like getting jumped by 50 ppl. And you want to make decisions that don't make sense.
This is what complete hopelessness looks like. Housing instability, working a minimum wage job, cut off from his child - and now he has a record. He can't see things getting better. He's giving up on life. 💔
Kinda sad, but I've seen quite a few defendants do this. Throw their arms up defeated, telling the judge to just send them to jail. This guy does have a child though, so I hope he pushes through for the kid's sake, if nothing else.

Simpson knows the score. As he's said on numerous occasions, "I've been doing this for a minute." Bench conference. Grandma in the courtroom. _"I do not understand how someone that looks like me comes up here and asks the court to send me to jail."_ He'll get to the bottom of it. His next hearing in two weeks should be enlightening.
If you listen to his sentence structure when he is speaking, he is fairly intelligent and educated. I believe he is so in love with his son, that being separated from home him is destroying his self worth. Working at Taco Johns, or where ever, he is probably just scraping by. Financial stress, mom moving away, pending court cases and being separated from his son, is just eating him up alive. He is just one or two steps away from suicide. He needs help and he has the right judge, to give it to him.
I agree. As a therapist (caveat that I obviously cannot diagnose him from a video) I think he genuinely believes that him not being around would be best for his son.

I see everyone jumping on this kids back for wanting a relatively short amount of time in jail instead of probation which will be a lot longer then a year. I can tell you from personal experience I totally see where he is coming from. The stress of probation, dealing with a probation officer that may be a real hard ass and then all the programs , court cost, probation cost, random testing, not allowed to leave the county without probation giving you permission. Then just the very idea you have any police involvement. Weather its your fault or not is a strike against you and can be used against you. People do not realize how many people opt for jail time instead of probation. Sometimes just being out of society not dealing with peer pressure and being away from the drugs and influence can so much more for you. You get in a certain way of thinking, and you get a in a pace ,weather its working out, reading or whatever. It can be very beneficial to be just away from the bullshit for a long length of time.
Probation is a cake walk. You have no idea what you’re talking about. I’d take 30 years probation over a year in jail. You must be mentally ill too. I feel bad for you bud.

He's working full time, paying his rent, has a good relationship with his son and following the conditions of probation by attending the classes...but now he wants to chuck it all? It came out near the end that he's been prohibited from seeing his son. That's probably hitting him hard. This young man may need a psych evaluation. He sounds depressed and willing to retreat from life altogether, hence the request to go to jail for a year. I'd bet the judge is going to look into either an evaluation or additional support services for him.
If you look at it from a different lense, I think it makes sense. I think he's extremely depressed and feels that his son would be better off without him since he caused him trauma. I think he's terrified of hurting him again that he's not thinking straight.
i get why he would ask for the jail time, he believes he won't be able to do the requirements of probation nor would he be able to afford the supervision fees or testing fees but thankfully he landed in front of the best Judge on any bench. i wish this young man all the best and i hope he gets on track, for him and his son.

The financial issues are real, and they can create a no-win situation for people struggling to pay rent and utilities, perhaps child support, restitution, fines, and court fees. Then there's the issue of probation's demands on time, which can cause someone to lose their job and place to live if the corrections officer simply doesn't care about the probationer's work schedule. That makes a difficult, but doable, situation impossible by any standards. And seriously, I'm sick of hearing people say, "If they didn't want the consequences, they shouldn't have done the crime," because that's ignorant AF. It doesn't take into account no-win situations created by some judges and corrections officers, which are cruel and unusual punishment.
A person has NO idea what "the consequences" are until they are in the thick of it. Forget to call to see if they have a UA.... That's a negative against them. And if you were supposed to test... Notice sent to the judge. Then you have a for cause hearing. Before a person knows it they are staring down revocation and serving their sentence... right then and there. Set up a payment plan... can't make the payments... Notice to the judge. Can't stay employed as a condition of probation... Notice to the judge. USA incarcerates more per capita than the next three countries combined. And those next three countries are not good countries.

He can't afford all the probation and drug testing fees. It's cheaper and easier to spend it behind bars. Dude doesn't have the $$$ that probation requires. The fine's, cost of court, the monthly or weekly urine tests, probation fees, etc. It's probably going to be a couple thousand on top of his already pay check to pay check routine. Plus he said he has other charges pending. He probably just wants a 6 month to a year break from his reality.

There a guy here that can’t afford food , heating in the winter has no family so every year about now do something to get small amount of jail time . He’s fed ,warm and people around him . This guy reminds me so sad they give up

It's like he is biting back the truth, so he is able to not answer the judge's questions. He is probably not following the judges orders about the mother of his child and his child. What else he is not telling is unclear.

Its amazing how many people can't provide a proper answer to the questions being asked. "How long have you lived there?" All my life. Why couldn't he have said that he is living in the house he grew up in? Even if his mother moved to another location, he just gives partial answers

Wait. I'm missing something here. What exactly was the crime underlying the sentencing here? I didn't hear any discussion of the subject. I ask because I'm trying to understand why his bail conditions would have ordered him to have no contact with his son (if that was, in fact, the case, and not just him misunderstanding his bail conditions). If this was a DV case, such a condition might make sense. But can't tell if that's the underlying crime here.
Definitely some hopelessness in the middle of this. He might also be gambling that he might get released in 3-4 months and be done with this case. If the jail is overcrowded, it's not uncommo. To release low level offenders early.
He has had bad advice from his homeboys on how court system works. Hopefully he does what he needs to for his child's sake and work harder at Taco Bell. He has a child to teach how to be a man, as he needs to learn to be a man. No more breaking the laws and be good to everyone.
My friend did this. I went with him ti court. They wanted him to pay $50 to do 60 hours of community service plus fines. He said "give me the 2 days of jail." The judge was another of our friend's dad (which the prosecutor knew as he disclosed it at the beginning). The judge said, "I'm speaking as friend's dad. I'll pay the money if that's the issue. You don't want to go jail." My friend said, no, give him the jail. So, that's what they did. I asked him afterwards why he did that and he said he just wanted to get it over and done with. He didn't want to spend weeks or months trying to get the community service done. He did 2 days in jail. But he was 18 with zero responsibilities, not a dad.
He would rather serve time, remove all responsibilities of taking care of his son and then want to keep using after he gets out. He knows he will fail probation because he doesn’t want to take care of his son or stop using drugs
This seems most correct. He's ashamed, but is entirely passive about it. He's using big words and procedural jargon, but he doesn't have any self-awareness.
Or, just maybe, he's nervous about being in court. As someone who has dealt with drug addicts in the criminal justice system, there is nothing that suggests to me that he is intoxicated nor incompetent. He's making a request for jail time over the excessively onerous conditions he would face while being on multiple probations simultaneous. That demonstrates critical thinking and a willingness to make a difficult decision in the best interests of himself and his family. Judge Simpson recognized that he was attempting to do the right thing, and that's why he adjourned the hearing.
He's the type to get out of jail and spend the rest of his life complaining about how the system is set up against him and fcked up his life forever by sending him to jail... when he's the fool who requested it because he's not man enough to deal with his issue.
Yeah, I'm sure you were able to assess the entirety of his character from this hearing. He did not complain a single time, and made a request to do jail time rather than deal with the difficulties of complying with probation. Just because you don't understand his reasoning (or his circumstances) does not make him foolish. I would argue that casting judgment on others based on flawed logic and incomplete information is objectively more foolish than anything demonstrated in this video.

He's also asking for jail because he knows he can't afford probation fees it'll just dig his whole deeper he's not trying suck up for a light sentence with the totality of those circumstances answering questions the way anyone else thinks he "should" is probably not a priority.

What it is the defendant is not very well educated, and Simpson can see that. He tries to get these men who are still young boys into programs to turn their lives around. Hope this one can be saved from himself.

Wait. I'm missing something here. What exactly was the crime underlying the sentencing here? I didn't hear any discussion of the subject. I ask because I'm trying to understand why his bail conditions would have ordered him to have no contact with his son (if that was, in fact, the case, and not just him misunderstanding his bail conditions). If this was a DV case, such a condition might make sense. But can't tell if that's the underlying crime here.
Definitely some hopelessness in the middle of this. He might also be gambling that he might get released in 3-4 months and be done with this case. If the jail is overcrowded, it's not uncommo. To release low level offenders early.

My friend did this. I went with him ti court. They wanted him to pay $50 to do 60 hours of community service plus fines. He said "give me the 2 days of jail." The judge was another of our friend's dad (which the prosecutor knew as he disclosed it at the beginning). The judge said, "I'm speaking as friend's dad. I'll pay the money if that's the issue. You don't want to go jail."
My friend said, no, give him the jail. So, that's what they did. I asked him afterwards why he did that and he said he just wanted to get it over and done with. He didn't want to spend weeks or months trying to get the community service done. He did 2 days in jail.
But he was 18 with zero responsibilities, not a dad.
He may have been a dad at 18, they have sex at 16 on up. Or younger.

He would rather serve time, remove all responsibilities of taking care of his son and then want to keep using after he gets out. He knows he will fail probation because he doesn’t want to take care of his son or stop using drugs

Or, just maybe, he's nervous about being in court. As someone who has dealt with drug addicts in the criminal justice system, there is nothing that suggests to me that he is intoxicated nor incompetent. He's making a request for jail time over the excessively onerous conditions he would face while being on multiple probations simultaneous. That demonstrates critical thinking and a willingness to make a difficult decision in the best interests of himself and his family. Judge Simpson recognized that he was attempting to do the right thing, and that's why he adjourned the hearing.

In MANY jurisdictions probation is another tenticle in the for profit incarceration system.

Yeah, I'm sure you were able to assess the entirety of his character from this hearing. He did not complain a single time, and made a request to do jail time rather than deal with the difficulties of complying with probation. Just because you don't understand his reasoning (or his circumstances) does not make him foolish. I would argue that casting judgment on others based on flawed logic and incomplete information is objectively more foolish than anything demonstrated in this video.

I'm sure he did not dream about working at Taco Bell, but, as evidenced by the fact that he showed up to the hearing and made a request to serve his sentence, he is clearly doing the best he can to rise above his current circumstances.
