We never expected this in Sheffield - (The BIGGER Picture...!)
Coercion is a criminal offence and signing under duress is not legal... When a mortgage company threatens to evict somebody from their home of over 30 years, should they use COERCION to indirectly apply pressure which causes a person to sign under DURESS, be allowed to be ignored by law?
That question is for a judge to reasonably conclude based on evidential value, if coercion and threats of eviction if not signed, is beyond reasonable doubt of proof exists, that coercion and threats existed in this matter!
What we witnessed in this eviction was a tactic we would never believed had happened, if we had not been there to oversee what was happening to these vulnerable pensioners.
Both Phillipand his wife Ruth have their own health concerns, but the mortgage company appeared to be ruthless and unaccountable for what they appear to have put these pensioners through on their final hour of eviction!
They had nowhere to go and could not move out unless they had somewhere to go and live, and was expecting to be thrown out on to the cold streets of winter even though CHL Mortgages knew full well they had nowhere to go less than a month previously.
CHL Mortgages knew that a house offer was on the table less than 24 hours before the eviction time, but CHL Mortgages appear to have overstepped any reasonable assessment in light of the new re-homing of these two vulnerable elderly pensioners!
A third party housing association took over from what appears to be an unprofessional Sheffield City Council housing department, which only the new housing association in the last 24 hours before the eviction, offered them a new home which in itself, was enough for CHL Mortgages to delay the eviction for 1 month in accordance with receiving the keys to the new home that Phillip and Ruth accepted.
Unfortunately in these circumstances, unbeknown to anybody at the time, CHL Mortgages appear to have stipulated in paperwork that a local Sheffield Star news reporter would have to have signed access to their private mortgage account!
We believe that David Walsh of the Sheffield Star is more than a journalist and we have reason to believe that this is the David Walsh highlighted in this video, as mentioned in this shocking video; / davidwalsh_m
We would like to speak with David Walsh and ask David why he was included in the paperwork of CHL Mortgages in this matter, and how it appears that he was named on the paperwork of CHL Mortgages as part of the elderly couples eviction to be stopped, unless authorisation to access their personal mortgage account, was not signed for.
We would like to seek clarity on this matter with David, but at this time, he is currently unavailable, and we will attempt to contact David again in due course!

Ran the buildings into the ground, NGO's applied to courts to , in turn , seize the rights to the building.

As I suspected when I read the title. Executed by a woman with a chip on her shoulder. 'Catherine' or whatever her name is should be jailed for breaches of ECHR and an attempt to breach ECHR Article 8 by asking to sign to a third party (newspaper). Seriously, Sue them. I'm currently after my landlord for many breaches of ECHR, four counts of slander and I'm attempting to go for a custodial on their Data Controller for failing to disclose, holding erroneous information and failing to adjust records when legal information was provided. They will either admit or settle and if its the former they're done for because I'll go public with it.
From my own comprehension based on the events and help from the third party hosing association, I believe that the (mens rea) the intention or knowledge of wrongdoing that constitutes part of a crime, as opposed to the action (actus reus) the action or conduct which is a constituent element of a crime, as opposed to the mental state of the accused, has for myself highlighted that although the housing association verbally presented the threat act, did not realise that the act appeared to be one of law breaking without the knowledge or intention to commit the offence of coercion. I do believe that CHL Mortgages was the ones pushing this threat because somehow it was CHL Mortgages that appears to be part of a stipulation to sign or eviction will go ahead! I think CHL Mortgages used the housing association as their unwitting patsy!
I would like to think in your case, they will capitulate and settle out of court. Good luck 👍

Do you have owt love on Derbyshire home loan mortgages, that went over to nationwide, there is a few of us that are hoping to find a way , to expose fraud, as mortgages get changed over , without contract consent , 1 method using courts, other the mighty sword the pen,land registry refusing to acknowledge anything asked in Foi , finacial omubusman,also revising acknowledgments,any advice would be appreciated, my friend went to court 7 times,the bank falsified paperwork,the judge told them, they were a disgrace, told them to have the original deed of assignment by next hearing, each time has been a different mag, last hearing,the judge / mag court, said you owe, no fraud goodbye, pay what’s owed, arrears placed onto bill, my friend is also disabled, extended mortgage for 5 yrs which was to end this yr, they agreed to extend ours by 5, with review, due to health issues, brain aneurysm, heart failure,mobility issues , also halved monthly payment, any suggestion , would be appreciated, ❤
Is it fair to say at a glance on compact house , the mortgage company & people on the cooking the books, have links to other company’s that are global, & coincidence always some real estate property links, if this mortgage companies bank account is off sure, then doesn’t that mean it’s not covered by the FCA , making it fraud/ fraudulent/ void, as many are being found to be linked to swift , & part of the Finchley Road fraud, involving banks, MPs, , celebs, police & also these so called law enforcement puppets bailiffs, that these so called mick mouse msg courts, are working with Marstons, giving them access to data, & putting out there they are civil servants, when challenging courts, they then state im not qualified, so Don’t really know ! @@andreaowens6997 Everything you are saying appears to be true and the way the courts have been acting with people, are also true. I have witnessed first hand experience of many times where I was not even allowed in to a public court building while everybody else walked in while I stood by and watched. The courts know we are on to them and they will try any tactic to try and stop their exposure taking place. What we the people are slowly achieving, is now highlighting on social media what is going on because the mainstream media will not expose their own! Mainstream media has a purpose, and they very cleverly use some good reporting mixed in with lies. This tactic is to try and make the lies believable and trustworthy because mixing lies with truth, often the truth will help the viewer believe the next story when it's a blatant establishment lie... Thats mainstream media in a nutshell.

Unfortunately, Public Servants cannot be trusted in this day and age. Ruth made the mistake of trusting people to get in this situation therefore, trusting another Public Servant and signing a contract without fully understanding it will guarantee more problems…

I found this piece a bit confusing - it's a pity we are not privy to the reason for the eviction as that may make matters a little clearer. Does the couple not have a solicitor ? If it's a case of not being able to afford one, there are instances where you have to ask - can you afford not to have one and this might be one of those times. Plenty of 'no win no fee' outfits would have taken this on I'm sure. On a side note - I firmly believe it's only a matter of time now before we start seeing a massive increase in homelessness. There isn't the housing stock to accommodate the current increase in population and the rate at which new houses are being built is only a tiny fraction of what is needed. We will see people including the vulnerable on the streets in numbers very soon I think - your video shows one instance of how easily that could happen. I myself am technically homeless but for the good will of family. I have been seeking rental accommodation for several years and I find wherever I apply I have to get in a very long queue for a chosen property which often ends up in a rent bidding war. As a single man, forget council housing, that's a complete non starter. Buying a property is just a distant dream unfortunately and I'm sure I am not alone there.

There are matters of more than one aspect that could be deemed relevant. First I will help you understand that no matter the reason as to why the eviction was to take place, this is not what this video has managed to capture. We knew that CHL Mortgages are acting unprofessionally and obtained the mortgage via pennies on the pound, but there is also a moral aspect, the greedy CHL Mortgages company have shown themself and then exposed themself on camera to the point that the civil matter then turned in to a criminal matter! Let me explain... many people focus on the reasons of why the reason for eviction, this video is focusing on capturing illegal, unlawful, immoral and evil sinister practices by mortgage companies for example... We never thought for one minute that they would expose themself both illegally and unlawfully like they did in this video.
Try focusing first on the illegal and unlawful actions and then ask yourself why CHL Mortgages allowed this to turn from a civil matter, to a criminal matter?

David Walsh was the guy who the home owners son phoned to take up his case no mystery just wants consent to report on this properly. Just ask him, he is doing a few reports on housing.

Regarding David Walsh and The Star, I expect that is because Mr Walsh has reported on the story in the past (similar to how you have), but unlike you, he will be far more likely to contact the mortgage company themselves for comment, and to discuss the situation. As personal information is involved, it is perfectly reasonable to have a signed letter of authority from the person concerned to ensure that the individual concerned consents to having such information shared. It is quite common for journalists discuss such matters with organisations, for example, my local paper took up an issue with my local council on my behalf a few years ago. There should be no requirement to sign that in order to deal with the eviction. All it will do is enable to Mr Walsh to do a better investigation into the case.
The one thing about the whole David Walsh scenario is the point of time in the video where CHL Mortgages have appeared to use the third party housing association to say to Ruth in short; “sign or you will be evicted”
I have contacted the Star news desk team regarding David Walsh their journalist and so far they have not responded!
In the video, Ruth clearly stated she did not want David involved with her personal account but like the video shows, they was coerced to sign or be evicted and that for me was a serious breach of law which made Ruth only then sign under duress and through threat of eviction if that section of the paperwork was not signed!
No doubt David Walsh the journalist mentioned, will have his own version of events, one which I am actively seeking fir a response either from the Star or David himself in this matter because if David should not be on that third party form, or Ruth has no longer wanted him on it, then a serious question as to why the threat of eviction was issued if David was not allowed access to their personal account!
The bottom line for me, is Ruth tried to withdraw David Walsh, but she was not allowed too or she would be evicted!

My first question and one I have been meaning to ask you for some time, what is your legal background?
I ask because you are giving these people legal advice and unless properly trained this could be false information or information that simply could work against them.
Now on to this case, firstly it does not make sense. You say Sheffield Council ignored them. And a independant housing ass offered them a house but not for a month. You then claim that Sheffield Concil have stated unless they sign the papers RE the Sheffield star then the offer of a house will be withdrawn. Sheff Council would not have the power to do that as you have stated the offer is from a HA and not the Council. This is backed up by the lady talking on the phone and then saying Sheff Council have just apologised.
So something simply does not ring true here. Sheff Council simply would not be able to force a HA to block a potential tenants move.
Furthermore, and this is what I say in all of your videos, more background is needed. Councils have a duty of care, they simply can not put vulnerable people on the streets. That is not how it works. Speaking from experience, twice I have been homeless due to relationship breakdowns and as someone who is deemed vulnerable the Council have to act, even on one occasion putting me into a BnB until somewhere became available. However, they can only act if the person has told them at the earliest possible time. There is no point ringing up and saying I am being evicted in 48 hours.
My advice would be stop the clickbait titles and actually report, do the backgrounds and include that in the videos, the only reason not to do that is if the history of a case would not support what you are accusing people off.

Unfortunately there is very little legal help available (free or cheaply), and it is often necessary to be self taught. I have had to teach myself a lot about data protection law, equality law, employment law, social security law, etc. simply to be able to stand up for my rights and get what I am entitled to. This was necessary because there was no one else to do it for me. I expect Banaman and some of the people who appear in his videos are the same. Unfortunately though, this can mean that people may be misled when ordinary people like ourselves do not understand the law properly.
I agree there is a bit of missing background in this case. I reckon it may be due to the fact that the lady concerned is herself elderly and stressed and may not be very knowledgeable about the law or how to stand up for herself, but also the fact that her son seems to have dealt with a lot of it, so she might not know exactly what her son has been up to. Additionally, with regards to David Walsh and The Star, Mr Walsh has already reported on the story multiple times, which Banaman neglected to mention (I'm guessing he doesn't read The Star, and their website is quite difficult to navigate).
