Maidam, humne kisi company name aur logo done use kiya tha apne brand m sirf 1 word diffrent krke, us company ne, court se stay order lekr mera goods ko seize kiya kr diya, aur brand bhi trademark register nhi h, but mai avhi start up hi kiya tha, usne case trademark act, recovery and damage ka case file kr diya h but mai to apne aap ko court m salendar krna chahta hun but mera bakil jabab file kr diya h to mai kya kru, iss case se kaisa chutkara milega, 280000 ka claim dala h uss company ne, mai to 1 mazdoor barg ka aadmi hun kya kru

My question is,
If the person registered a logo and trade mark so many years ago and right now he is not using exact logo then the person may files a suit against the infringer even though he is not using his exact logo?
Can I know the consequences for this query
Infringement is only applicable to "registered trademark"
In your case, even though it is an old trademark, the owner still has the right to file a lawsuit against the infringer, Because it is a "registered trademark"

There is one unregistered business running since last 3 years and other business running on same or similar name got registered trademark in October 2020. Can this registered trademark holder initiate infringement proceedings against the first unregistered bisinessman?

One hypothetical question:. If a trademark "Nature" is already registered by someone else............can a trademark "Pure Nature" be registered...? Will the objection be considered right if happens..?

Bilkul possible hai. Trademark only restricts competitors in the same industry from using your registered brand name or company name. Each registration in a different class of business is allowed.

Nike clearly proved that they were NOT involved in satan shoes which offended people sentiment.
