In this video, we have discussed the principle of passing off in the Trademark act in detail.
In INDIA the one who has started using any brand name first can claim a right over it, however, in order to claim such a right you have to file the suit of PASSING OFF and prove all the ingredients of PASSING OFF.

Speaker, Bhavpreet Singh Soni explains that if your trademark is registered, you can easily file a civil suit against somebody infringing such trademark. You don't need to show anything before the court of law.
Similarly, if your trademark is not yet registered and someone else is using such trademark. And, if you want to file a civil suit against such individual, you can do that through the principle of passing off of trademark. But for the same, you need to show three things:
1. Good will of the brand.
2. Misrepresentation.
3. Damage of good will in the market.
It is pertinent to mention that if you fail to show even a single item among the above things, trademark passing off would fail and you'd lose the case.
