    What if the spouse signed a waiver giving the other opportunity to own the house without her inclusion. Is this still considered marital property when divorce comes in?

    I live in NC. 22 yrs ago as a single mom, I bought a house with a Fannie Mae loan. A few yrs later, married a man who also had a house before the marriage. We lived in his house after the marriage and I rented my smaller house out for a short period of time. Our marriage didn't work out and I moved back into my house. Now somehow, I think when I borrowed on my house, my ex espoused showed up on my title. He isn't on any of my mortgage or loan info and has no financial responsibility and the judge at our divorce told him he had no rights to my home, yet there he is on my title. How do I remove him?

      You will likely need to speak with a real estate attorney in your area but generally, title can be cleared by having him sign a quit claim deed transferring title back into your sole name.

    with all do respect, i am not agree with what your are saying about separate properties BEFORE marriage ...Any assets acquired before the marriage are considered separate property, and are owned only by that original owner... most of the lawyers claim/promise one party or another that they can fight and trying to get half of what does not belong to one particular spouse, and eventually this will lead to thousands and thousands of dollars legal fee and no favorable outcome

      Separate property vs. Community or Marital Property is generally a legal question and the law varies by jurisdiction so you should check with an attorney who is well-versed in the law in your jurisdiction in order to get a full picture of how property ownership breaks down.     My ex sign quit claim did , for a house I owned during our marriage , and we done a postnuptial agreement front a lawyers .
    Does the house will be a separate property.

    I have a question in simple terms if i buy my own house i paid it off... I bought expensive furniture and everything... Before i got married... Then i got married for 5 years and the lady only paid for the electric bill only nothing else... is she able to take half of my house? And my things?

    My husband brought me to Utah! He signed the I-864 as my petitioner/sponsor!
    He did not declare his car and condo on the I-864 on his I-485 petition for me and the properties bought within our marriage under his name! Me and my husband don’t have children!
    What can you say? My husband just want to marry a local woman in the USA!

    what happens to my rental property where married couple does not live will it also get divided or i get to own 100% of it? what happens to extra real estate? how to protect those at the time of divorce.

      You should speak with a family law attorney in your area as there are many factors that go into determining if a property is marital or sole as I describe in the video.

    My dad and his 3rd wife divorced 10 years ago. She moved out and in the online divorce decree it stated that my dad would live in the home until his natural death. What happens if she dies first? Nothing is outlined in the decree if this happens. Does his heirs get the house? Does her new husband get the house as her heir?

    I've bought a property about 1 yr ago in NJ everything on the property is in my name, due to me being married, 1/2 she is entitled to, I filed for a divorce, and ask to buy her out, which is pay her, her half of the equity, she wants me to sell my house, mind you she has her own property that she rents out in NY. It's draining because I do not live in the property but still pay all the bills, she does not and had not contributed to any of the bills, I had plan to bring my kids (5)from 🇬🇾, to live with us... It seems as thou She wants me mess my credit up so I wouldnt be able to being my kids here anytime soon 🙏🏽, do I sell my property or fight to keep it???.

    Hi I’m in miami Florida. My mom and dad are divorced. The home is under my mom name. If my mom pass does the house go to my dad, me or probate ?

      Your dad gets it first typically, then you when he passes if your the only kid.

    I’ve been married for almost 8 years. The home we have live in for almost as long was signed for by my husbands parents. I contributed in every way to the home.
    Now I am leaving and getting a divorce. Do I have to just walk away with nothing? Thanks
