    Never try to reason with an HOA...always hire an attorney and sue for damages, costs, harassment and anything else you can think of...start with a cease snd desist...and then go for their jugular...

    If you are within the boundaries of the HoA then you are NOT a part of the HoA UNLESS you sign papers stating that you wish to join, HOA has no authority to just say you are part of it !!!!!!

      Yes, but often the HOA's forge... yes, criminally FORGE... documents to show "You joined the HOA!"
      Just had a problem with that nonsense less than a mile away from my home where an HOA was trying to say "These people joined the HOA!" and they were saying "No, we did not!"
      Finally had to get a judge and a forensic investigator involved to trace the paper trail. Turned out the HOA board was lying and had illegally marked people as 'having joined' who never did.

      Sorta…in some the HOA has some but power over properties whose borders touch theirs. I’ve been a small developer over 30 years. I’ve had properties in three states and two countries. HOAs now control about 60% of US homes. I would NEVER buy a home in or next to an HOA. I’ve chosen to live rural most of my life. Now HOAs grow and spread like viruses. Our ranch is in the middle of nowhere. I’m zoned for agricultural. So IF one did show up next to me , I’d literally start a pig farm. Not joking. The only reason we don’t have pigs now, is because my wife won’t let me. I like pigs. Did you know if you set it up properly, and feed them properly they make very little to almost no smell. BUT if you feed them lots of corn and restaurant waste that’s another story. The smell if you do that is eye watering. It gets into fabrics, and it also spreads far and wide. I’d instantly tank their property values.

    HOA approached on anything.. I get a lawyer right away .. wouldn't give them a chance to do anything .. makes me want to buy a farm next to a HOA just so they'll try something.. free money sueing them

    Extortion plain and simple file charges if the locals won't do it, the county or state probably will you can get free legal assistance from your states department of consumer affairs.

    The house is 100 years old they want it because the property under it is worth more than it is, so they want to tear it down and build somebody a McMansion on the land, it's all about greed!

    If you are within the boundaries of the HoA then you are a part of the HoA that is how boundaries work!!!
    Edit: The fact that he wasn't notified of the changes invalidates any lien and foreclosure.

      You are not part of a HOA unless it's part of the deed or a person voluntarily joins, no matter where the boundaries are.

      @@robertstarks9823 Exactly. The HOA can say "I'm extending my borders to this place!" and your home is still NOT a part of it unless you opt to join the HOA, no matter if someone halfway down the street does.

      The fact that the house wasn't a part of the HOA to begin and they didn't ask him to join shows that his house wasn't a part of it. If your house is not a part of a HOA, one can't make you join. The HOA can invite everyone around you, all of them can join the HOA, but if you are not invited and/or you don't accept the invitation, they can't make you a part of it.

      There are two ways that a home that was part of an HOA can be removed from the HOA depending upon your state. First, if you inherited the property. Second, a tax sale.
      You can be within the boundaries of an HOA and not be a member, again two ways. First, your property predated the HOA. Second, the HOA was originally voluntary and no owner ever joined.
