during martial law power is not in one man's head only, it is more proper to say that it is the president's office (with the cabinet) not just one person because most decisions are made that time with the cabinet members and the president

I think we should also consider how the elections were done in the US whereas the president and vice president runs a tandem, and when the president wins the votes, then his vp will also assume office. That way we can make sure that they are aligned on how to run the government.
