Hello Mam, In my case, Builder and land owner jointly developed the apartment and after completion, builder allocated some flats to land owner. After that land owner has sold 1 flat to me with proper sealed and signed agreement to sale but do I need to make sale deed also? He is saying that it's not required if it is new flat. I also got possesion letter from builder for my flat.
For instance, if you bought a house under the agreement of sale and failed to execute a sale deed, then even after you avail the possession of the property, the right to property would remain with the developer. Thus, to avoid such situations, it is imperative to draft a sale deed and get it registered. Only a stamped and registered deed guarantees legitimate property ownership to the buyer.
