      @Joshua Smith I have to agree with you. This interpretation is unjust. The child should not suffer from the unfortunate situation of the original parent who could not keep the child. We do not have to follow the opinions of youtube scholars, articulate as they may be.

      I agree with sheikh and I also agree with @Joshua Smith.
      My experience is when my late grandfather wishes that his house to give to my adopted aunt. My father and uncles agree with it, even they all knew the Islamic Law of inheritance that adopted can not have it.
      Also anothet solution for adopted children to have your wealth is by wasiat or will.
      Later it was the lineage was the challenge to my family, it was my aunt death that was troubling us, since we as her close family can not inherent her wealth. I remember my parents ask around to our relatives about her adoption and also about her biological family, in the end it was a dead end. Later my family decided to give her wealth to charity.
      There is reason all of this law, but does not mean it is burden to us. Allah knows what the best for all us. Taking care of another child is the most beautiful and I respect for you for doing this.

      Which is exactly why he mentioned and particularly emphasised on the idea of the four witnesses being just and honest and that these qualities of theirs must be recognised by the rest as a majority, not just a small group who considers them honest and just. The question you should ask however is in how likely is it for four just and honest witnesses to witness a man and woman and the act of penetration? I'd say highly unlikely. And Allah knows best.

      @@roberthannah7983 isn't it child's right to have his/her biological parents surname, even if he/she got adopted? taking the surname of adopted parents is unjust. 'what leads to what' is your own opinion. In a society where children are born out of wedlock is injustice to the children according to sharia .

    • @roberthannah7983
      @roberthannah7983 4 года назад

      @@saieidashik3492 From what I can see, "the sharia" in a discussion of the fourth objective forbidding adultery does not say anything about the way the child out of wedlock should be treated. I think most adopted children (I have known a few) have no attachment to the biological parent, except maybe out of curiosity as to who they were and why they were abandoned. But their loving family is their adopted family. Of course if the person wishes to change their name they can do so legally. Apart from adoption, there are also orphans and millions of refugee children with no known "lineage".
      I go back to Yusuf's mention of lineage. I am in a country (Canada) where many people have come to get away from the structured class societies where "lineage" and class are important and can be a type of oppression for those without favoured "lineage". Of course one can be proud of one's family and parents, but a person's character and morality are more important. In fact a person who comes from a broken family without money or good parental role models, and who nevertheless becomes successful in life and family can and should be worthy of respect; their poor "lineage" does not matter.

      @@roberthannah7983 I know how you meant. I have no intention of hurting any feelings you know. One thing let me say... in Sharia 'No soul bears the wrongdoings or actions of another soul' . Biological parents wrong action does not fall on the child. So Maybe its just societal prejudice that child suffers . Like its not preferred in places that a bastard child lead the prayer. It's society's problem. If you ask whats the sharia opinion on this 'society's prejudice'? it's just wrong because they are our brothers and sisters in Islam. At the same time Sharia does provide all the social economical equality to the orphan and oppressed child. Zakat fund is available and higly recommended for them. Their own wealth can't be mixed with his/her guardians.. if it gets mixed then it has to be in orphan's interest. Sharia gives respect and appreciation and honour. Maybe some societies abuse the preservation of Lineage too much that it hurts oppressed or orphans. Maybe we need more sharia laws against 'societal prejudice' to establish the purity of lineage and oppression against a child. I wouldn't say lets get rid of preservation of lineage and make everything just secular. Secular world doesn't have social and economical guidance. it's working procedures are really political and mostly anti-religious ideas.

    What if a baby was found on the street for example beacause the parents didnt want it and left it just there? This happens mostly i believe in western countries. So if someone later on wants to take care of the child how would you know the name of it?

    • @MN-bv2qq
      @MN-bv2qq 5 лет назад +10

      Good question. There is a strict ruling regarding orphans and adopting an orphan and prescribing him a surname. In the case where you do not know his family and he is a baby and obviously unable to speak for himself, you are allowed to prescribe him a surname of Abdullah which simply means slave of Allah or Abdur-Rahman which means Slave of the Most Merciful. Doing this means you are not destroying his lineage and that you are directly relating him as a slave to Allah and this is seen as more just and right in the eyes of Allah.
      In no circumstance, can you give him/her your own name. As for choosing his first name, you are welcome to choose him/her a good name which does not necessarily have to be Islamic, but that it should have a good meaning. And Allah knows best.

    Dear Sheikh, how come you mentioned that if someone leaves the stoning pit they will be allowed to leave? What about this?
    Sahih Muslim Book 17 has several hadith regarding Stoning specifically (17:4191-4209, and 17:4914). For example,
    Abu Huraira reported that a person from amongst the Muslims came to Allah's Messenger while he was in the mosque. He called him saying: Allah's Messenger. I have committed adultery. He (the Holy Prophet) turned away from him, He (again) came round facing him and said to him: Allah's Messenger, I have committed adultery. He (the Holy Prophet) turned away until he did that four times, and as he testified four times against his own self, Allah's Messenger called him and said: Are you mad? He said: No. He (again) said: Are you married? He said: Yes. Thereupon Allah's Messenger said: Take him and stone him. Ibn Shihab (one of the narrators) said: One who had heard Jabir b. 'Abdullah saying this informed me thus: I was one of those who stoned him. We stoned him at the place of prayer (either that of 'Id or a funeral). When the stones hurt him, he ran away. We caught him in the Harra and stoned him (to death). This hadith has been narrated through another chain of transmitters.

The Hadith number 4914 doesn’t belong to book 17 so the reference is not right and for the other two Hadith reference there is no incident of what you indicated about people grabbing a man and stoning him to death forcefully ...

    He keeps referring to "Islamic law" as though this is codified and immutable, but really apart from the five pillars of Islam it is just a collection of scholarly opinions and fatwas, many of which contradict each other. For example, look at the wiki entry on apostasy - scholarly opinions are all over the map and (thankfully!) have evolved.
