    What is Legal Guardianship for Adults with Disabilities?
    Guardianship means obtaining the legal authority to make decisions for another person. This happens by going to court and proving that your loved one with a disability is incapable to a judge, who would then appoint a guardian. Now again, this might seem like a good idea, but please exhaust all of the alternatives before going forward with guardianship because guardianship removes all of your loved one’s rights!

    Thank you for this video! I’m my son’s guardian and have been since 2007. I was appointed due to ongoing behavior problems that didn’t get better with counseling. This video has opened my eyes to options/alternatives I didn’t know were possible. We live in the US in southeast Wisconsin. I’ll be 65 in October so have really begun looking at the future for both my son and myself. Admittedly, I’ve put this “task” on the back burner but now need to focus on it. I participated in the online learning you hosted on 5/4-5 and am going through the videos now to get more information and work through the information provided.     One of the biggest barriers that I face is much of the population of people with disabilities have guardianships, especially if they have severe challenges and this prevents socialization. Guardians have to approve of whether they would want the connection or not then if they are in a group home under agency, the agency has to approve whether They want someone on the outside interacting. So guardianship as well as the privacy act are the two barriers that hinder me from connecting with people I relate to very well.

    1/13/24 We have had 5:23 guardianship of our nephew since he was 8 yrs old. He has Downs Syndrome and is fairly high functioning. We are 73 yrs old and want to make decisions for his care before something happens to us. Can we assign guardianship to our son or daughter in a will?

      Guardianship is something that can only be established through a court.

      Depending on where you are located and what kind of legal support you already have in place for him, you may be able to get other plans in place for him in the event you are not able to care for him (due to illness or death or whatever). If your country/state has a supportive decision-making provision, you may be able to accomplish this through that means. Could you do some research and speak with some attorneys about special needs law in your state?
