Terrific video and USLawEssentials one of my favority channels.
What would a situation look like where a defendant could timely file a
removal notice within 30 days of the service that first made the case
removable for that defendant, but is time-barred from removal because
the complaint was filed over a year before?
Are civil wrongful termination cases worse in federal court ? What if a defendant from the same state is hiding and we can’t find her to serve ?
Great explanation!
Thank you so much for your super explanation ;) Greeting from Vienna
+Arbelina Atur Thanks Arbelina. Are you studying US law? I'd be happy to hear about topics that interest you. And say hi to Vienna for me. uslawessentials@gmail.com
If one wanted to remove a case from State court to Federal court, how long does the process take generally?
Removal is simple although I can't tell you exactly how long it takes. The removing party files a 'notice of removal" with all of the documents that had previously been filed in state court. Especially if everything is being electronically filed the process is quick.
USLawEssentials I was just asking for a general time line. I don’t know if a day is an average amount of time or 3 months. Quick is relative.
Removal is jumping to federal court.
