It gives law enforcement the ability to gain access (through a heavily rushed warrant process) to someone's account and to delete or alter the data on it in order to gain intelligence on 'suspected' criminal activity. So these agencies, with access to someone's account could make posts in their name, effectively planting evidence. Naturally it was rushed through under the guise of protecting children and preventing terrorism, but as we can see, the powers that be can freely apply the terrorist label to people as they see fit.
What's odd is that the two previous big spy laws had lots of media attention. The metadata and the encryption breaking law had decent media coverage. But this? Nothing.

Jordan - i have been working in IT for 25 years and have tried to bring peoples attention to issues such as this - thank you for doing so. The pervasiveness of government surveillance in Australia is quite staggering and it is getting worse. I fear we now with the Covid situation are no longer living in a democracy.
Portuguese here. We do have pretty tight security measures when it comes to data privacy, compared to the rest of EU and EU-law in general. It's so nice to be appreciated once in a while, thank you Friendlyjordies ❤️

That won't work I'm afraid. A document is largely meaningless now. All that matters is the power to enforce rights and the docility of the public at large. The U.S may have a bill of rights but they're not in a better position than us on this front, though it may seem that they are on paper.

Almost no major news outlet reported on this matter and most of the people talking about it are just independent youtubers. Look into the new legislation rammed through last week to force small political parties to TRIPLE their membership or be unable to have their party name on the ballot. Required membership of a party was 500 and is now 1,500. This anti-democratic legislation passed without fanfare or any media scrutiny.

Here in Ireland the Government passed legislation to stop debates on new forced legislation, silencing opposition. It is often described as being on the right-wing of politics. Groups such as the Liberal Party of Australia label themselves as being conservative. It is the Liberal Party that has done the most to dismantle civil liberty in Australia bar none.

The Bill of Rights doesn't specify many rights for citizens. It is important for knowing what powers a king or queen has, though. And by extension, what powers a president might have.
Very limited rights indeed, but there are numerous historical acts covering others. Right against Excessive Bail form the 1869 bill may be relevant to topic at hand. Bail is being increasingly used to control political dissent, especially in Victoria at the moment, but also in this case.

The real concern above and beyond everything you have highlighted is that most computer programs that we might use say for Engineering or CAD purposes or IP and design or industrial design or for invention are cloud based. Extracting META data is all that is required to extract IP. The last time I checked if I want a dedicated internal CAD program that can power a half decent 3d printer I am up for tens of thousands of dollars but hey if you want a Cad Cloud program to build a 3d printed prototype with a Cloud based 3d printer then you can have it for 12.99. Well ok these are pricing metrics that make a lot of sense aren't they? This is the way that acquiring free knowledge on the internet, results in free services?
lets not, a bill of rights puts into words exactly what freedoms the government can and cannot violate and that is a bad thing. for example the US bill of rights states that a person may carry a concealable weapon that can kill people at over 100m as a right, and yet contains no such statement to the effect of liberty for all or equality of the sexes.

The no warrant part is incorrect, the laws that were introduced are a new classification of warrants that are available through judges. Not ideal laws any way but they do require warrants.

It gives law enforcement the ability to gain access (through a heavily rushed warrant process) to someone's account and to delete or alter the data on it in order to gain intelligence on 'suspected' criminal activity. So these agencies, with access to someone's account could make posts in their name, effectively planting evidence.
Naturally it was rushed through under the guise of protecting children and preventing terrorism, but as we can see, the powers that be can freely apply the terrorist label to people as they see fit.
What's odd is that the two previous big spy laws had lots of media attention. The metadata and the encryption breaking law had decent media coverage. But this? Nothing.

That won't work I'm afraid. A document is largely meaningless now. All that matters is the power to enforce rights and the docility of the public at large. The U.S may have a bill of rights but they're not in a better position than us on this front, though it may seem that they are on paper.
That last bit about using all this data to formulate targeted propaganda is a pretty valid concern. Almost no major news outlet reported on this matter and most of the people talking about it are just independent youtubers. Whenever said outlets DO actually talk about it, they just talk about it being used for predators and terrorists and never focus on how it can be(and has been) misused. Some very limited rights may still be in effect in Australia as inherited from the the English Bill of Rights 1689. So Australia does have a bill of rights - technically. The Statute of Westminster Adoption Act 1942 and similar state acts may have stripped any left over teeth from this old law or other similar inherited laws though.

Very limited rights indeed, but there are numerous historical acts covering others. Right against Excessive Bail form the 1869 bill may be relevant to topic at hand. Bail is being increasingly used to control political dissent, especially in Victoria at the moment, but also in this case.

The real concern above and beyond everything you have highlighted is that most computer programs that we might use say for Engineering or CAD purposes or IP and design or industrial design or for invention are cloud based. Extracting META data is all that is required to extract IP. The last time I checked if I want a dedicated internal CAD program that can power a half decent 3d printer I am up for tens of thousands of dollars but hey if you want a Cad Cloud program to build a 3d printed prototype with a Cloud based 3d printer then you can have it for 12.99. Well ok these are pricing metrics that make a lot of sense aren't they? This is the way that acquiring free knowledge on the internet, results in free services?

the right to liberty was not in the bill of rights and slave owners abused that to legally legitimise the ownership of people, an amendment post bill of rights had to be made to specify that all peop0le have the right to liberty.

The no warrant part is incorrect, the laws that were introduced are a new classification of warrants that are available through judges. Not ideal laws any way but they do require warrants.

Just about to make this same exact comment. More people need to be aware of it. The UN is not our friend but as long as Australia is a signatory to this document, we've got something (on top of English Common Law rights as well).
