- According to a new report from a journalist who claims they witnessed the event, Donald Trump was seen during court on Tuesday editing angry speeches that were later given to the press outside the courtroom by his allies. If true, this constitutes an egregious violation of his gag order, as it would be proof that he is directing his friends about what to say and who to attack - including the people protected by the gag order. Not jailing him is setting a dangerous precedent for future trials. I get why Marchan might be worried about protests etc. but if it’s a brief jail stay there’s less time for chaos but it still sends the needed message that nobody is above the law.

It's a delicate balancing act. Trump wants to antagonise his opposition to take drastic action.
As soon as other Republicans get involved and if Trump or any of his cronies are arrested it can be spun as a war on the Republicans and they can say "see I told you they will come for us all!!" And use it as a platform to do another Jan 6th.
Unfortunately proving that is another thing.
Unfortunately it will require the prosecution to prove that he told them to use it word-for-word. That will be near impossible to prove because Trump would not have given "explicit instructions" he never does; he just relies on his followers to do what is best for him. He will argue that even if he corrected their script he did not order them to recite it to the media. That undermines any claim that he broke the gag order. There is no instruction about him having to stop people from attacking those listed in the gag order if he felt they might be about to do so only that he can't instruct them to do so.
Unfortunately proving it is the hard part as not one of the Trump Minion Crew will admit it. They all looked like dupe copies of Trump.
What, they didn't just copy and paste Trump's script. Since it's the same nonsense every day, they should have it memorized like most of us have.

Factually, the violation of the gag order should give him 30 days in jail. And then he'll have prison for the rest of his life to look forward to very soon with his other cases now being green-lit when his immunity claim was denied. Fun Fact: Mike Lindell went on Steve Bannon’s show to complain that MIKE JOHNSON was reading from NOTES during his rant on Trump’s behalf. Lindell was complaining that it made Johnson look like his comments weren’t “genuine” and he should have been able to praise and defend Trump without using notes. Well, now we know where the notes came from.
