Yes, it is. Suspects are supposed to be held in jail for a few months while the police gather evidence, and then the court trial happens and if they're proven guilty beyond a reasonable doubt, they get sent to prison, and if not, they get released.

But I do think it's worth noting that in this country, false accusations against racial minorities are a long running problem in the legal system and so every little bit of help matters. I'm not gonna bootlick the bare minimum of decisions, but as Curb Your Enthusiasm is quite an entertaining show and something I've at least enjoyed for a long time, I am glad that they made the right decision. Edit addendum: for me, it's about being at the right place at the right time and sheer luck.
I watched the documentary abt his case and the the evidence was when he was caught from camera walking to his seat close up...and when his wife called him exactly the time the victim was shoot and they have identified the location of the call

Major props to the lawyer! I heard a longer version of this and he put SO much time into the case, so much time into going over ALL the raw footage (and think about how many thousands of faces were in that crowds with Juan and company making up like 4-6 of THOUSANDS) from Curb Your Enthusiasm (and there was a TON). He was onto the 5th tape by the time he saw Juan, and his ability to pick Juan out after hours and hours of staring at tiny, grainy faces is mind blowing. Also props to Larry David and team for allowing him to look through their raw footage before it was even made into an episode. They are AWESOME for helping get him exonerated.
I don't get it. If he went to a baseball match he'd have tickets, which is already some evidence on its own but they also have seat numbers. Which should tell you roughly where to look in the crowd.

Saw a post or a comment somewhere where the guy talked about how he told the police that the guy who just robbed him had a black hoodie with no trademarks, and when he looked at the CCTV footage, the guy had a blue hoodie with trademarks.

That's the problem in USA: in other countries, prosecutor has to prove his point, and the defense will only point out weakness in the evidences. Whereas in USA, debate is contradictory, so the prosecutor and defense present their evidences and the best prepared case win. And innocence, proving that you did not do something, is much more difficult to prove than guiltiness.
There is a famous case in Korea, about an innocent man that spent almost 20 years in prison after been accused for murder. The real murderer was never found for almost 30 years until the police caught him back in 2019. The case is called Hwaesong Serial Killer.

I give the person who identified him in the crowd alot of credit. I remember a case where a woman was murdered inside of an office building. They had cameras in the lobby and elevator,but it was still very difficult to find the perpetrator. They actually found a homeless guy who looked like the suspect and it was a mess. Eventually they found the right guy,but It demonstrated how difficult it can be to solve a crime even if they have the person on video.

Yep. Everyone likes to think that it's "Innocent until proven guilty" but the fact is that most cases in America actually operate in the opposite. This is true when it comes to a variety of cases. It's often the case that the system and the people within it are so corrupt and lazy that they don't actually want to do their jobs at all. It falls on some really hard-working, kind , people to save poor souls like this guy.
I think its because he was accussed of Murder. Crimes like Rape and Murder have different rules when it comes to bails and arrests. Their arrests do not even require an arrest warrant nor are they bailable. Its like the system doesnt wanna take a risk by leaving a "maybe" murderer free.

Juan had a really good lawyer who actually seemed to care. That's awesome, and that lawyer deserves kudos for going the extra mile and convincing an industry giant like HBO to let him review footage that was probably on the cutting room floor. That is one bulldog lawyer, right there.

He didn't have to, it's enough in a trial to convince a jury there's reasonable doubt. But if you can do it, that's a major plus that should quickly get the charges dismissed without need for a trial.

He wasnt convicted of the crime He wouldnt be convicted of the crime He was arrested for probable cause during the 6months and meanwhile they were investigating and gathering evidence. They didnt have enough evidence to sentece him. He was never gonna get the detah sentence or any sentence at all because there wasnt any direct proof.

something similar happened to a friend of mine. Two eye witnesses claimed they saw him at the scene of a shooting & authorities took him into custody. Luckily he remembered he had a receipt from AutoZone to prove he was in fact shopping at the time. Take your receipts people 👍🏽

@@halimooooo it’s not always a lie, it’s often misidentifying a person, or misremembering. A person could easily be manipulated into remembering details, without either party being aware of it. This is why recovered memories are often bullshit, and why eyewitness testimony shouldn’t be admissible in a lot of cases. It’s also why we need to enact so many restrictions on what cops are and are not allowed to say while interrogating.

It may have been a case of if you ask someone. Did you see acts? They're more likely to think they did than just. What did you see? Example, if you ask someone, was this person wearing a red shirt as opposed to what color of shirt were they wearing? They're more likely to answer red

Because eye witnesses are really bad at identifying people of different races, he's Hispanic, the witness was probably a white or black person, so less able to distinguish between faces of Hispanic people.
That saddest part is that for 6 months they definitely didn't follow other leads or even look for a possible other killer at all. That much time lost in a murder trial is devastating considering the killer or any trail of him could be long gone by then

It’s pretty wild when two pieces of circumstantial evidence is enough to get you arrested and held in custody pending a trial whilst there isn’t a shred of actual evidence proving your presence at the murder scene.
Yeah eyewitness testimony trumps everything. Saw a case on the old Unsolved Mysteries show of a guy that was convicted of a robbery. He had twenty neighbors that day who were outside because it was the beginning of summer who saw him somewhere else at the time....he was at home working on his car. Of course that wasnt enough for the jury and they sided with the shopkeeper and he went to jail.
He had a motive and an eyewitness saying they saw him. (as the other reply said, an eyewitness testimony trumps anything.) They aren't just going to let him be free when he knows he's a suspect. Many murderers, if they know the police are catching onto them, will go into hiding. Can't arrest someone if you don't know where they are. It's still a fucked up situation, but there aren't a lot of options.

Exceptions aside, people don't go out of their way to falsely testify, that's why generally eyewitnesses also aren't prosecuted for perjury. Research has shown that eyewitness testimony is unreliable, but that eyewitnesses truly do believe they picked the right person. Our brains have the tendency to double down, even when mistaken and especially when challenged.

Exactly. The US justice system is SUPPOSED to be innocent until proven guilty BEYOND A SHADOW OF A DOUBT. That's what the system claims they do. Although, *in practice* the system does the complete opposite. Many *innocent* people take plea deals to plead guilty just to get out of jail because they can't afford bail. In the US, 95% of people in jail take plea deals. That's not a justice system when innocent people can't afford (quite literally) to stay in jail because they have jobs and families and bills and just don't want to be in jail cause it sucks. Innocent people lose their homes all the time because they were stuck in jail and couldn't pay rent. Rich people are the ones that get the "innocent until proven guilty" treatment. Poor and middle class people are kept in jail for months and can be in jail for a year or more just awaiting trial. Literal innocent people get locked up a shocking amount in the United States and its absolute injustice and a travesty. The US justice system needs a complete overhaul and needs serious restructuring, for one, we need to get rid of bail completely.
Thank God! Unfortunately, a young girl was murdered, I hope they found the right person. Hopefully they didn't stop doing justice during that 6 months he was locked up and didn't waste time by not continuing to find answers.
That documentary made me tear up. He looked so heartbroken recalling the feeling of helplessness and thinking he was going to either die in prison or be sentenced to death.
This was an amazing story that I watched on Netflix last year. Juan bought those Dodger's game tickets for his mom for Mother's Day, knowing she didn't even care for baseball and he figured he could go instead. He took his young daughter to the game and she wanted some snack from the stands so he went to get her the snack which is when he walked in front of the cameras while they were filming and just happened to also have a date and time stamp on the video. That "accident" of walking in front of the camera is what definitely saved him because it placed him in the stadium at the time of the murder. There is a famous case in Korea, about an innocent man that spent almost 20 years in prison after been accused for murder.
The real murderer was never found for almost 30 years until the police caught him back in 2019.

I give the person who identified him in the crowd alot of credit. I remember a case where a woman was murdered inside of an office building. They had cameras in the lobby and elevator,but it was still very difficult to find the perpetrator. They actually found a homeless guy who looked like the suspect and it was a mess. Eventually they found the right guy,but It demonstrated how difficult it can be to solve a crime even if they have the person on video.
What irritate me SO MUCH is that by focusing on an innocent person, the murderer walks free among us.

He didn't have to, it's enough in a trial to convince a jury there's reasonable doubt. But if you can do it, that's a major plus that should quickly get the charges dismissed without need for a trial.

This is why recovered memories are often bullshit, and why eyewitness testimony shouldn’t be admissible in a lot of cases. It’s also why we need to enact so many restrictions on what cops are and are not allowed to say while interrogating.

Because eye witnesses are really bad at identifying people of different races, he's Hispanic, the witness was probably a white or black person, so less able to distinguish between faces of Hispanic people.
That saddest part is that for 6 months they definitely didn't follow other leads or even look for a possible other killer at all. That much time lost in a murder trial is devastating considering the killer or any trail of him could be long gone by then

It’s pretty wild when two pieces of circumstantial evidence is enough to get you arrested and held in custody pending a trial whilst there isn’t a shred of actual evidence proving your presence at the murder scene.
Yeah eyewitness testimony trumps everything. Saw a case on the old Unsolved Mysteries show of a guy that was convicted of a robbery. He had twenty neighbors that day who were outside because it was the beginning of summer who saw him somewhere else at the time....he was at home working on his car. Of course that wasnt enough for the jury and they sided with the shopkeeper and he went to jail.
He had a motive and an eyewitness saying they saw him. (as the other reply said, an eyewitness testimony trumps anything.) They aren't just going to let him be free when he knows he's a suspect.
Many murderers, if they know the police are catching onto them, will go into hiding. Can't arrest someone if you don't know where they are.
It's still a fucked up situation, but there aren't a lot of options.

While it doesn’t make it any better, and _despite_ swearing to tell the “truth and nothing but,” saying ‘no’ to whether or not they recognized him would have slowed things down (or worse, they were possibly being _led_ to believe it had been him outside the courtroom).

Exceptions aside, people don't go out of their way to falsely testify, that's why generally eyewitnesses also aren't prosecuted for perjury. Research has shown that eyewitness testimony is unreliable, but that eyewitnesses truly do believe they picked the right person. Our brains have the tendency to double down, even when mistaken and especially when challenged.

Many *innocent* people take plea deals to plead guilty just to get out of jail because they can't afford bail. In the US, 95% of people in jail take plea deals. That's not a justice system when innocent people can't afford (quite literally) to stay in jail because they have jobs and families and bills and just don't want to be in jail cause it sucks. Innocent people lose their homes all the time because they were stuck in jail and couldn't pay rent.
Rich people are the ones that get the "innocent until proven guilty" treatment. Poor and middle class people are kept in jail for months and can be in jail for a year or more just awaiting trial. Literal innocent people get locked up a shocking amount in the United States and its absolute injustice and a travesty. The US justice system needs a complete overhaul and needs serious restructuring, for one, we need to get rid of bail completely.

Unfortunately, a young girl was murdered, I hope they found the right person. Hopefully they didn't stop doing justice during that 6 months he was locked up and didn't waste time by not continuing to find answers.
That documentary made me tear up. He looked so heartbroken recalling the feeling of helplessness and thinking he was going to either die in prison or be sentenced to death.

This was an amazing story that I watched on Netflix last year. Juan bought those Dodger's game tickets for his mom for Mother's Day, knowing she didn't even care for baseball and he figured he could go instead. He took his young daughter to the game and she wanted some snack from the stands so he went to get her the snack which is when he walked in front of the cameras while they were filming and just happened to also have a date and time stamp on the video. That "accident" of walking in front of the camera is what definitely saved him because it placed him in the stadium at the time of the murder. In fact she has her obituary and probably headstone says " here lies the Red Sox #1 fan in the world" lol .
Imagine the curb your enthusiasm music starts playing when they present the pictures proving of his innocence to the court, and the prosecutors just stand there shocked.
Our judicial system can never seem to understand INNOCENT UNTIL PROVEN GUILTY. Motive is not proof.
