      Florida charges it as murder regardless of attempted or actual. The difference is 1st degree murder punishable by death penalty and 2nd degree which can get 30-Life

    I refused to repossess vehicles when I was a tow driver. Many of these people are at the end of their rope and taking their transportation is the last straw. Right or wrong it is a dangerous job.

      I knew a couple, both police officers that inherited $300,000. They spent it all all land, new truck, $15,000 TV and whatever else. They didn't know taxes would have to paid on that inheritance. They filed for bankruptcy, foreclosed for the second time on their second home. Some people have zero financial sense. The wife was a college grad. Go tow them, the company that's owed the money needs it to stay in business to make loans to others.

      My brother is a chronic deadbeat, with a long history of foreclosures, bankruptcies, and repossessions. Unfortunately we have a unique last name, so I was always hounded by his creditors. One day a tow truck ended up at my ex-wife's house looking for one of my sons simply because he tracked down my brother's last name. He was determined to repossess a car, any car, and didn't care that it was the wrong person or the wrong car. My ex had to call the police to get rid of the tow truck.

      Repo's have been around since the first vehicles was financed. However I do agree new vehicles are grossly overpriced

      I have never owned a newer vehicle and have not had a car payment since 2010. People want the latest and greatest because it is marketed to them and an older vehicle with less tech is uncool. Not me, I'll just run old junk and fix it myself. I currently own a 2004 and it is the newest vehicle I've ever owned. That being said cash for clunkers destroyed the used car market because it depleted stock and reduced the available number of used cars. We didn't have it in Canada but the used car market is crap here because all the good ones get exported.

      @@juliogonzo2718 I never bought a new vehicle. One of the first economic lessons my dad taught me was that the value of a new vehicle drops by a quarter to a third the minute you drive it off the lot. Our two vehicles are '05 and '04. Nuff said.

    I've done repo work. I always had a law enforcement officer with me at the time of repossession to serve the proper paperwork and protect myself. I would not do that work today. I've seen too many videos of the repo guy driving alone onto private property to try to take a car without being noticed. Not defending the shooter, just suggesting legal help to avoid the confrontation.

      Good chance he knew he was late on payments. But there is a good probability he didnt know that when you don’t make payments, the bank takes the car back by force. Therefore, he thought they were stealing it. I can be wrong. Or I could be right.

      @@deplorablelibertarian You are incorrect! The tow truck driver does have something to do with the car. He was hired by the owner of the car (the finance company) to recover a vehicle that was not being paid for. The person "stealing' the car is the guy that agreed to pay for it, then for whatever reason decided to stop paying for it. Listen, if the repo truck shows up at your house to get the car, it's not because you're 10 days late or even 30 days late. This person ignored months of letters, emails and phone calls from the lender. I would bet he was at least 90 days late. The finance company doesn't want the car, they rather you pay for the car. The repo man doesn't want the car, he just wants to get paid for the job he was hired to do.

      I have seen on TV when they repo cars in UK, they always try If they can speak with someone and show the repo paperwork, so the driver of the car understands they have right to take it, in US they just steal it and this situation can happen.

Perfect condition and have had 0 problems other than what I have messed up myself. Don’t beat on me for having a jetta😂 The wolfsburg edition seems much better than an average jetta.

    I am a tow truck owner driver I've been to 7 funerals for tow truck drivers in 5 years. The last one was a repo driver picking up a payday loan vehicle that owed 150 dollars he was shot in the back of his head suspect caught in 5 hours he left behind 3 children 4 grandchildren and his wife he was 38

      I'm betting your ancestors were also immigrants, as we're the ancestors of 99% reading your post. I know mine were, immigrants aren't the problem. There are problems that it's easy to blame on immigration, but really look into the problems you think are caused by immigrants, and you'll find they're not the actual root of the issue. For example, most of the fentynal coming into our country is coming directly from China on shipping containers, and most Americans get their drugs from another American citizen they personally know. Most immigrants work in whatever capacity they can and are not a drain on the system. And the actual crime rate for immigrants is far lower than those who were born here. If I were born in an undeveloped country I definitely would have come here especially after having children. There could have legitimately been a mistake by this tow truck driver,or the financial institution, and this guy living in this nice neighborhood may actually have been legally defending his property. And there are actual car thieves who own tow trucks, I had a co worker who had their vehicle stolen from the parking lot in broad daylight using that exact style of tow truck, it was black rather than red, but it was 100% stolen, and not a repo, we know this because we checked the reviewed the camera footage, with the police, when the police questioned weather it was a repo or not they checked the registration an confirmed there was only 1 owner, no financial obligations. I'm not saying this is the case but you shouldn't be so quick to take one side or the other when you don't know the facts and it appears as this his accent may have lead you to jump to conclusions.

    In Missouri it don’t matter private property is private property no matter who comes on your property!!! if you come when someone’s property, don’t matter if you are tow truck company or Jehovah witness. When a person tell you to get off, you have no choice but to get off the law is still on your side, no matter if you are two payments or 200 payments behind.

    As someone who did asset recovery, it's not safe during the day, and you dont get paid enough to deal with these kinds of people. The banks just need to take them to court at this point and stop getting people injured over there property. I've heard of guys being shoot because they picked up and moved cars to get to the one they wanted. Doing a repo at someones home is by far the worst place it puts you in the most danger.
    Also always call in a pick up before you do that way you can have police on stand by if needed.

    In my time doing repo's the rules were don't have a gun. Back off if if it becomes confrontational. My guys said they could hook up in 6 seconds before the owner could pull on his pants. Also can't enter a locked gate . One owner was able to follow them and shot their tire to stop them and get back his car. The repo guys were a bunch of good guys doing their job professionally with the banks ok. The payments were usually 2 or more payments late with customer's evading the lender and not communicating.

Me nor the agent could be armed while in performance of our duties in the State of FLA. NOt sure if that has changed but that was the law back them and I'm sure it's still the same.

    Apparently man forgot to pay the note on his vehicle...so, he shoots the repo man...this will cost him about 5 years in the prison because he also forgot it's not cool to shoot people.

    Not supporting the shooter, but the tow driver should have just left if the deadbeat got in between the truck and the car before the hookup.
    The tow driver was using his vehicle as a weapon to force the deadbeat to move. As usual, we only get a snippet of video and that snippet doesn’t show any punches being thrown. But it does show an assault with a motor vehicle.
    Something for the lawyers to fight out in court if the DA pursues it. If you’re going to be debt, pay your bills.

    People need to understand the laws .most professional Asset Recovery knows what the law says, being on a driveway with public access is not the same as breaking into a garage, you can't shoot someone who has a legal right to recover something! A repo means you don't own it ! You are behind on payments, the Driver did absolutely nothing wrong! He didn't enter into any structure, open any doors , touch anything that was not part of the legal order. When these repos happen the driver once in possession of the Said Asset has to notify whatever law enforcement the state requires. All those comments about how the man said your trespassing get off has no weight because he is a licensed agent. How do I know this I worked for one of the largest asset recovery companies in the USA , yes it can be dangerous but the banks would never get their (I said Their) property back. If All you had to do was Park in your driveway making it off limits banks would stop giving loans. The only time I was not able to gain access to a vehicle was on military bases if they let me in great they usually did after showing them the legal order. Sometimes they would find the person and make them hand over the keys! They only offer obstacles are Reservations if the tribal police said no then it's no. Facts are facts you can't make your own rules or things like this happen. This guy's
    life is probably over for pulling that trigger. You would be surprised how many repos happen a day! When I worked we had all of the state of Washington had 6 drivers I personally pulled 10-12 cars a day 7 days a week . This was way before COVID

      I believe it depends on the state. In Illinois when I did it if it was private property when the person said get off my property that was it, according to law enforcement. Though that was the 90's when I did it. From what I saw in that video the person was on his own property and the driver kept going. His claws appeared to be down going for the car and not hooked up yet. The guy was blocking it and the driver kept coming. I am all for the repo man trying to do his job. I had some bs happen to me with a bunch of lies and people in the projects saying I trying to repo the car with a baby in it. The women had her kid go up to their apartment and actually bring a baby down and put in the back seat of the car to say that we my partner and I and another repo crew tried to still her car and kidnap her baby. Bunch of ghetto nonsense. For the racist out there, every class of people get there car repossessed. Lawyers, doctors, police officers, nurses, fireman, dentist, and the common Joe. Black, white, brown Asian, you name it, it happens.

    A similar incident happened in Harris County, Texas several years ago when I lived there. Homeowner used his trusty deer rifle and shot the repo driver who drove off and crashed into a ditch where he died. The grand jury did not indict the home owner for shooting the repo driver. I don't know if a wrongful death civil case was filed by the family of the repo driver.

    I did repos back in the 70's and it is a very dangerous job. I was shot, stabbed, and beaten up, all this and the police were always told about the repo before hand. I always carried a gun but sometimes you can't get to it. Baltimore and Washington are some tough places to work back then. After about 2 years of that crazy stuff I found another job.

    When you sign a loan agreement, your property rights don't matter if you are not making your payments. The lender has the right to regain possession of their property on your 'private' property.

      If I was so bold to go on someone's private property to repossess their vehicle, which may be their only means of transportation, I would show the repossession documents and only proceed if the owner agrees for me to take the vehicle. Doing a stake out and wait for the vehicle to be in a public place with the owner nowhere in sight would be my modus operandi if I was repo man or woman. Repo people dont risk your life over a job, use commonsense and do not confront or engage with angry desperate individuals, not worth it.

    In the video it looks like the driver was about to take out the guys legs with the lift. Granted the guy shouldn't have been standing there, but technically that could be considered assault with a deadly weapon, or attempted vehicular manslaughter, or something similar. Therefore it seems a case could be made for the shooting to be self defense. Granted it's thin and most likely wouldn't stick; especially since a gun was involved.
    I'm well aware that the tow driver was within his rights and just doing his job being there, but you can't just run somebody over with a vehicle or even push them out of the way with a vehicle no matter what the circumstance.

    You failed to pay the car payments, and were obviously WAY behind for them to repo it. Now you shot and nearly killed the tow truck driver, knowing that you no longer were the owner of the vehicle. You knew exactly why he was there. So, you lit him up with bullets instead of calling the police. Now, you've lost any right to the vehicle and you're going to jail for for attempted murder.     I went through a bankruptcy years ago and included my car. I was expecting it to be taken as well.....but it didnt happen. For almost 2 years.
    Monday morning, at 1 or 2, I had to be up in a couple hours for work, I got a banging on my door that scared the crap out of my son and when I answered, it was 5 people, spaced around my yard, 2 had their hands on the their guns and they were asking for my keys. They said that they didnt want any problems and just needed the keys (they were obviously repo) and I told them that I had crap in the car that I needed and I needed my stuff before they got the keys. All of them helped me get my stuff...all of it out of the car.
    They all had driven a few hours (from Indy, I live near Michigan) to get the car and had tried to take it without me knowing, but I had just had a new ignition key made because I broke the original at work, and when the dealership ran my VIN for the new key, I guess it told them where I was, but because of that, they had to have the new key lmao.

      I also think that the hands on the guns was in response to how I opened my door. I am a big dude and I was pissed. Knocking on my door in the morning, scaring my son. I probably looked like I was going to jump them.
      I probably could have peeked out the window and figured out better what was going on before exposing myself like that though.

    Im gonna play devils advocate here. I am not a tow truck driver. But I know several of them because my best friend owns a tow truck company that does a lot of repos. I have asked him about his business because I am curious. And one of the questions I asked him was, had he ever had a gun pulled on him and what did he do. He said, yes many times, he said he will immediately disengage and live to fight another day. He said he trains all his drivers to avoid confrontations like this. With that said, is this driver at fault for not disengaging when this guy clearly was letting him know he was on private property and to leave? Also, we have not heard any audio that has the drivers words either. What if he did indeed make a threat to this guy? Personally, I think this guy over reacted and should have never pulled a gun much less used it. Main reason being because his life was not in danger. Unless he claims those post on the ground were gonna hurt him which would be bullcrap. Hes lucky he did not kill him. Would love to hear what some of you tow truck drivers think.

    The defense in court will be that the tow driver was backing his vehicle toward the defendant knowing he was there. Therefore endangering the defendants life so he had to shoot in self defense. The tow driver is the aggressor once he moved the vehicle towards a person endangering him. I see this one being pled down or outright dismissed.

    I don’t know the laws protection tow truck drivers but he was on the man’s property attempting to take his vehicle. Even if he identified himself and declared his intentions to repossess his vehicle, this is a very dangerous place to do it! If the owner claims he didn’t believe the tow truck driver was legitimate and that he believed he was trying to steal his vehicle, under ‘stand your ground’ and ‘castle doctrine’, he has every right to defend himself and his property using whatever force he deems necessary. The tow truck driver was very foolish continuing the repossession when the owner showed up.

    the tow driver hit the homeowner with his truck..its plain as day on the video. Tow driver has no right to tresspass on private property when the owner for sure told him to leave...case over. Home owner will walk for self defense because i know i would fear for my life if someone was backing a tow truck into my body. What makes people think that repo agents have to right to do what this driver did. repo agent messed up big time . The fact that the homeowner was arrested means nothing. police generally don't know the laws or even bother to learn them.     Well I've always ranked repossession agents in the same category as parking inspectors. Lowlifes making a living off the misfortune of others.

      Where I am there's one who has an underhand side hussle , his so called business isn't registered, insured, he pays no tax..
      He patrols towns and suburbs to find old classic cars, up a driveway, in a paddock, under a tree, he won't dare approach anyone who appears to know the value of old cars.
      He offers no more than $50 , or free removal, where I am the law is not on the side of people who commit self defence type situations, often this guy won't immediately leave when asked, if someone wanted to forcibly remove him, police here would charge the property owner with assault, not the driver with trespassing or fraud, in relation to tricking people into selling things of high value for next to nothing.

    I would think that deadbeat got several notices about non payment and im sure they included something about hey if you dont pay we are taking the car back, maybe im wrong about that in florida but damn, shooting an unarmed tow truck driver in daylight? Wtf! Does attempted murder go on his credit report for other lenders to see?

    Repo guys should not be allowed to enter on anyone’s property period simply because situations like this can happen and it’s true

      And why is that?...Do you actually believe that when YOU Steal my car ...and you park on your property it now becomes yours?
      The deal that YOU made with the lender is simple...YOU don't Own Anything until you have paid for it...The lender is letting you drive it while you are paying for it!

    It's illegal in the United States to repossess. It's also illegal to sell debt. So those debt collectors and repo guys are breaking federal laws. And it's allowed to happen.

    There was a repo down the street from me, it was a food trailer, and it looked like half the swat team was there, middle of day. I don't know the back story of the repo, I do know that house had been raided by the police in the past for drugs so maybe that had something to do with the police being involved. The trailer was in the back yard and they towed it out of there. Maybe it was more than a standard repo as the police don't normally get involved in repos as far as I'm aware.

    Thats the same reason i got out of the business myself in the mid 2000s... Once in north miami and a second time in west Lauderdale... The moneys good but not that good ..
