    It is ironic that in this court of law, Philip Brailsford is having a hard time following instructions and answering questions - which need to be repeated over and over. Could that be because he is nervous and doesn't understand? Now - I wonder how Daniel felt with an AR-15 pointed at him and he feared for his life? It cost him his life! Would you be able to follow instructions perfectly? Any lawyer worth their salt would have made this the point of the proceedings, and perhaps Mr. Brailsford would have seen a jail cell...

      He's not 'misunderstanding the questions', instead he's not giving direct answers that would otherwise testify against himself admittingly. On one hand, a question without a consensual answer is a form of incorrect sourcing of information, however answering a direct question with an indirect question whilst not illegal, is considered a dishonest and guilty form of testifying. Most defence attorneys will tell you to either stick to your original statement given prior to the court hearing or to simply state nothing at all, or 'no comment'
      A basic example is;
      If a man gives a cake, made with milk, to someone who is lactose, and that said person gets sick.
      If questioned 'Don't cakes normally have milk in?'; to answer 'Yes', confirms that you acknowledge you are guilty of supplying milk. However to state 'I did not know milk was in that cake', acquits you of any possible intention to harm. If you're then asked 'witnesses state that they saw said person claim they are lactose to you', is this true? If you say yes, you're admitting to knowing that the cake COULD harm, despite not knowing if milk was present. However if you answer 'no comment', the question is considered answered.
      Prosecutors will try time and time again to answer these questions multiple times, and differently to get the answers they need, either by slipping up or other means. They will also try to ask very vague questions for answers that are much more important to the case than may appear, and therefor trying to ask for a more direct question, or literally to avoid a question that may lead to something, even if it's clearly unrelated to case, is often used. An example such as; Is it true you do not like fishing?. It has nothing to do with the case what-so-ever, however if you state 'correct' and the defence then props up a picture of you holding a fishing rod and a fish smiling, you've then just told a blatant lie to the jury. Further attempts at justifying the picture just incriminates yourself further as someone who 'does not remember', 'lies', etc etc.
      This whole case is extremely text book.
      Long story short, he was very well informed how to save his own ass.
      The most serious and worst part of this is when she is trying her damned hardest for him to admit in some form that he intended to shot Shaver. It is quite disgusting but is what court is.

      That is one part that annoys me because he kept on being confused by simple questions that were explained over and over again but when he was aiming a GUN at an UNARMED, AFRAID, INOCCENT man he didn't care about how the man felt and how he might be confused by what he was saying especially when you are telling this man that you will most likely kill him!! It sickens me.

    i am a retired police officer that worked in brooklyn for 20 years. This video was so sad and preventable! 1st you are trained to take cover. Make very clear your commands. As you could see, this poor male was very nervous and confused with your commands. Why did you have him to lay on the floor? These two suspects could have been control the same way you do a felony car stop!! Make one suspect at a time walk backward with both arms raised straight up until told to stop. Other officers keep visual while one approach and handcuff and search. In my whole career i never had a possible armed suspect do a dog crawl towards me! Of course you want to do this away from room 502. I am glad you are off the force. This wasn't the job for you. You are too nervous and scared to do the work. You killed this poor innocent man and should have been found GUILTY! May he rest in peace. May you have nightmares for what you did. Surprise you didn't shoot her too?

      I agree these cops were not well suited for the job, but incompetence is not the same as criminal intent. Who hired them? Who trained them? Who evaluated them, etc? There is more responsibility to go around.

      Further, the voice tone is lower and more quiet. But we must remember it was Langley who was shouting orders at the time of the shooting.

      If you get absolutely smashed drunk, start pointing a gun out a 5 story window, and repeatedly fail to follow the instructions of police at gunpoint bad things can happen. Thats a tragedy, not a crime.

      I'm not saying Shaver was an angel. I'm saying a moron cop who gets a report of a gun and never sees one and decides to use deadly force, is no better than any two bit murderer or rapist. He's dangerous. He let his emotions dictate his actions and that sir is a tragedy. This moron cop deserves to be in prison for shooting a man who didn't even commit a crime. And what does a person's sobriety have to do with being shot by a cop who had no idea his victim was even drunk? If he was drunk at all. It's irrelevant. You ask any cop if he/she was in Shaver's position. None would shoot. If this guy fears that a man on his hands and knees following the orders of the officers is a threat, he's dangerous. There's no telling how many people he might kill if a real dangerous situation occurred.

      during the testimony, they made the difference between perceived threat, immediate, and imminent threat. this was a situation of perceived threat since there was no gun visible. even Brailsford said it was a situation of perceived threat so no deadly force was necessary as considered by the experts

      Aaron Barnes how was he not following instructions? If he wasn't fully compliant it wasn't because he was being hostile it's because he was scared and when you constantly have officers yelling at you telling you they're going to kill you and telling you to shut up, I doubt ANYONE is going to keep calm. You say it was a stressful situation for the cop but that's why you go through the academy. Being an officer is a very strenuous job and this officer obviously wasn't suitable for it

      Vincent Chase he was not following directions, the complete video has been released. There were two people involved, one followed instructions and one did not. The one who complied was unscathed. If i get insanely drunk and brandish a rifle and fail to follow simple commands of Leo's and reach to my waste line after being told I would be shot if I did it again but did it anyway I have no one to blame but myself.

    How much of a threat is an unarmed man, on his knees, pleading for his life, faced with 4 murderers with guns? They could have searched him when he was stretched out, face down on the ground.
    This cop baited him to give him a "reason" to kill. I hope he rots in jail for the rest of his life.

      The cops asked the chick if Daniel was armed and she said she didn’t know. I do think they shouldn’t have had him crawl down the hall. The cops didn’t know if there were other possibly armed civilians in the room that might come out shooting if they walked down the hall to the suspect.

      He quietly resigned and according to TMZ he is currently hiding in the Philippines in order to avoid prosecution. When in uniform he is drunk with power but when he faces legal action he tucks his tail in between his legs and hides halfway around the world.

      He didn't murder him, he followed protocol for that specific situation the body cam footage shows that. The suspect putting one of his hands out of sight made this a justified shooting.

      Jeremy Gunn The SS also followed protocol according to German law,that didn’t make it moral.From the women that called 911 to this officer,not one person ever asked is he pointing at or threatening anyone with the gun?It is not only NOT a crime to have a gun in your possession but a constitutionally protected right so the police should not have even been there.It’s also not a crime to be intoxicated in your hotel room.I don’t believe this officer was guilty of cold blooded murder but I would say 5 against 1are pretty good odds even without body armor and fully automatic weapons against a man crying and lying face down in his underwear.Police take the job voluntarily with no one forcing them knowing it can be a dangerous job.If they are that scared of 1 man crying in his underwear and begging for his life when they have 4 of their buddies backing them up with body armor and fully automatic rifles then they are definitely guilty of being a coward unfit for the job they freely choose.Most importantly this cop was thrown under the bus by the very people that trained him to be such a coward,and a jury of people just like you let them all get away with it because you are all brainwashed into believing these guys are heroes instead of the cowards they are.If you can face Daniel’s widow and fatherless young children and tell them that their dad sucked at a confusing as hell game of drunken Simon says but it’s ok he’s dead because the police followed protocol then there is no hope for you and more innocent people will die.

I've had alot of good interactions with the police so I'm supporting the cops all the way. You can believe that he did something wrong but the body cam shows that the intoxicated man did not follow orders and put his hand behind his back which mad the shooting justified.       Jeremy Gunn During the Nuremberg trials the SS guards all claimed they were just following orders/protocol but were put to death anyway because what they did was immoral even though it was legal.Nobody should ever receive the death penalty because they are bad at following orders in a very stressful situation.I can guarantee you would have made the same mistakes as Danial even sober which again it’s not a crime to be drunk.Even though we disagree I would not want you shot for being bad at following orders ,for all I know you could be mentally handicapped and incapable of following orders or logic.

    As a former Police officer and a current law student, the thing that I find most disturbing about this man's testimony is the fact that he, without facing a drawn gun or Police barking at him, is unable to process simple questions. Indeed, he has to clarify basic requests from Counsel. Now, I wonder what his responses would have been if he was looking at the business end of a carbine, while being degraded and given impossible commands.
    This unnecessary Police shooting is causally linked to deficiencies in training. Had they taken the time to visually clear the subject "before" putting him in the prone position (i.e. one hand in the air and request that he raise his shirt with the other, while turning around, to expose his waist band) Mr. Shaver would likely have had the opportunity to see his kids grow up. Police need to remember that we all swore an oath to "serve and protect" not "degrade and destroy".

      It's important to note that the "mistake" which Langley said would result in Daniel and Monique's summary execution was walking out of the room too close together (Source: ruclips.net/video/yRb5JK23D0E/видео.html
      ) But they were obeying the instructions given to them over the phone by Bryan Cochran, Langley's subordinate. So Langley punished them for his own incompetence and compulsion to harass people.
      Brailsford knew this, and not only refused to speak up and help Daniel, but fired the shots that killed him. Then lied on the stand about feeling scared.

    The defendant killed an unarmed, crying, and terrified man. The Prosecution Examination is a critical moment in the trial, perhaps the most critical. So why is the prosecutor so aloof? Just messing around with her papers, pouring herself a drink, long pauses, when the defendant doesn't answer a question, she simply moves on... This lady is NOT advocating for the victim, which is her job.. She lost the case in which she has the murder on camera....What an aloof, obtuse, incompetent... Do know that a man's life was taken from him by this defendent? She doesn't care about the victim and that is a big reason why he did not receive justice!!

      It doesn't matter that the kid was crying and pleading. That has no technical weight over him being at gunpoint under the presumption that he is armed. Just because we know in retrospect that he in fact was not armed doesn't mean that the officer was unjustified in firing at that time, after it was stated that a threatening move would result in them firing. I don't know what you ignorant people don't get about that. If you are a police officer, it is already known that death may occur at your hands; sadly, the reality is that it's part of the point. The officer may need to kill to protect, not because he wants to, but because he has to. In this situation, the young man, presumably an assailant with a gun, was instructed at gunpoint to not reach. He reached, and the officers fired accordingly. It's sad, but it doesn't mean it's to be assigned to someone else's soul. It's a tragic event

      A man begging and crying for his life while crawling under threat of death with 5 assult rifles pointed at him isn't reaching for a gun. The murderer could have waited 2/10 of a second to actually see a gun before executing him. That guy was hoping for a reason to kill him, so he did..

    The bottom line is that they had so many opportunities to handcuff the victim in this case. I don't care that they were worried about someone else being in the hotel room. That's just an excuse. And just listen to his testimony… What a joke. Acting like he doesn't understand anything and dodging every question. Very very sad situation for the victim and his friends and family.

      There is a lot of police officers out there that is scared of there own shadow, and bad police officers cause good police officers to get killed. I have got to the point when a officer gets killed in his so called line of duty, I morn no more, you will not see me waving old glory when the Hurst passes by. They need to learn you give respect, you get respect. And if you are so scared of your job, go flip burgers somewhere !!!!! If someone is breaking into my house and there maybe a chance of harming my family, I will not call the police, only after I have finished protecting my family. And then I will call them to clean the mess and bodies up when I am done protecting my family. That would be all they are good for. Is cleaning up the mess.

REPEAT - He said that Brailsford commanded the victim to crawl forward, shot him, then in Court made it as his excuse that the Threat Level increases when a person gets closer !!     I think this guy killed dude because of the captain who didn't do a good job of taking point. Also this prosecutor is weak. She should've pointed out how he isn't listening and following orders well and she's talking to him even toned and she doesn't have an assault rifle! Still the captain ramped the situation up soooooooo much he in my book is to take much responsibility for the blood that spilled. I'm hurt by this and just wished it never happened.

    I still can’t believe this! If I was that poor guy, I’d have been shot also. It’s a fact when you’re stressed (as victim clearly would’ve been) it’s hard to think clear. He’s legs would’ve been weak with fear. Cop seems cold as ice and seems like he had zero regret. I don’t get it. It’s scary! Wheres the parents, or family of victim? I hope they got millions. That guy was mentally tortured prior to being killed. The screaming alone, would cause many people confusion as to what this cop expected! How many times can this sedated cop reply “I don’t understand”. And what kind of training did the victim have? Being screamed at like a dog and told your going to die.

    This is a common occurance in iraq...when I was a marine we secured people like this all the time and we don't shoot them if all you gotta do is let the others cover you while you approach...Thats rifle training week one stuff...they provide mental tools for coping with Combat stress. He keeps bringing up training, with as much preparation time as they had the srgt should have discussed that. . . I live In mesa and usually support the police but this guy fucked up...everything that happened could have been avoided with a tiny bit of teamwork but instead death occurs. The label on his gun "you're fucked" is unacceptable for a service weapon system of any kind...the fact of the matter is this cop and his srgt straight dont know shit about apprehension on the move...a situation is just tragic and for the record srgt screamer Is not as tough as he thinks he is and needs to get over himself, he had everything to do with the escalation of this situation...he later received so many death threats from the public he went into hiding. These guy were a bunch of ametures, the choices the victim made also werent the smartest ever but they clearly had time to gear up and Dismissed a plethora of non leathal alternatives carried by two men and actual firearms by the others. They could have called a k-9 unit...2 dozen strategic options were ignored here and instead they turn it not into a desperate attempt to save lives but to feed their ego and impress their buddies...they never would have made it in Afghanistan. #fuckedup #doyouevencopbro #seriously

    Disappointed in the DA with this cross. Aside from the weak line of questioning, and irresolution, the DA failed to best assert herself throughout cross examination by allowing Phillip Brailsford to insert non sequiturs and tangential statements while he was asked to respond simply with a, “Yes” or a “No.”
    It’s a shame there was no attempt to more poignantly illustrate the witness’ perturbed temperament as well as his overall air of consternation, to the court.

    I watched the video. First of all the officers did not know there was a gun, they acted on hearsay from a call. Of course they had to go prepared. But even there they did not see anyone with a gun, yet they executed an innocent man who committed no crime. I would also add that police officers are essentially public servants that volunteered for that job, and their salary is paid with taxes from people like Daniel Shaver they killed that day. As public servants, cops have no right to put their own safety above the citizens they signed up to protect and serve, in fact they must be willing to die rather than kill an innocent man. So what if Daniel put his hand behind his back? Thats no reason to shoot him, they should not shoot until they saw an actual gun, even if that means they have to risk one of the cops getting killed or injured, its a risk they must be ready to take. If they don't like it they can quit and find another job. By shooting someone on a hunch like that is extremely selfish, something a gangster or terrorist would do. People should refuse to pay taxes until cops training are changed, or else realise that it could happen to any of you who is in the wrong place at the wrong time like Daniel was. Daniel would have a much better chance of being alive now if he simply politely refused to move and stay on the floor with his hands on his head, they would not get away with shooting him then. Cops must be prepared to die rather than kill an innocent man.

    Ok, so my dad was a cop. He was a military police officer for 12 years, 4 of which he was deployed in a war zone. After he got out of the military, he became city cop for a couple of years . Then he went back into the military as a weapons trainer. I grew up around cops. I played with other cop's kids. Went to barbecues with cop families, they came over to our house to play cards every week. In junior high when I went to my first school dance, my dad chaperoned, in uniform and he drove the motorcycle so he could park right outside the doors. My dad died of cancer a few years ago but I know this case would tick him off. (he hated corrupt cops more than anything, even more than being called a cop..lol) My dad never shot an unarmed person. Not only that but being in the military and being around a lot of other military police I ended up knowing a lot of cops growing up. I only ever heard of one of them shooting an unarmed person. Only one cop, one time in years of being associated with police officers. And when it happened that one time, everyone knew. Everyone felt bad for the guy that did it because he had to shoot but his whole life was being turned upside down. So something seems really off to me when you look at this case and this Brailsford guy has shot and killed two unarmed citizens. How likely is that? According to statistics nationwide last year 68 unarmed people were shot and killed by police officers. 68 in thousands of shootings and with millions of cops and untold millions of encounters. Yet this guy, I don't know how long he's been a cop but he looks really young has done it twice now? All the police officers are looking at the tape going "IDK the guys hands went out of sight" and I know they hate to judge another officer because it's a scary /hard job. But there were 6 officers in that hallway and 5 of them managed not to shoot an innocent unarmed citizen that day. SO the other 5 cops were negligent because they didn't see a threat and take the shot? And how many other police out there have shot and killed two unarmed people in two separate incidents in just a few years time? I don't buy it, I think this Brailsford guy is a psychopath that was playing his own version of a first person shooter game where the rules allow him to kill if the suspect fails to follow orders and that is murder.

    This (TRIGGER HAPPY) cop jumped the gun that killed that boy on his knees & begging you not to shoot .the way you guys had him laid out there was no danger to the police .well I hope you can sleep well at night after killing that boy .     The sergeant was the one giving the insane commands. He retired. Free and clear. Probably still carries a fire arm. This guy was fired. That's it.

      It is very safe here when compared to other countries. It's just that if and when things like this happen here, word of it spreads like wildfire and you don't hear the end of it for 6 months. By what I've seen on Russia, considering traffic rules alone, America seems MUCH safer.

      Have you been to Russia to have a comparison? In Russia they can beat you up (not kill/murder you) for being stupid or they can be very friendly even help you push your car if it breaks down. If you say America is a free country then you are being mislead. Once it was, hasn’t been for a long time.

    Murderer with a badge is set free. License to kill. This is injustice.
    He shot an unarmed man 5 times almost point blank who was on his stomach not looking at the officers. The waste line was easily observed after shaver raised his hands which lifted his shirt exposing his shorts seem line. In the video I can tell shaver wasn't armed.
    I have experience in these situations and there is no exuse for this murder. Nor is there accountability.
    Training does not over take moral compass and discernment. You were bullying the unarmed suspect. There were immoral commands obviously confusing him.
    Police murder more innocent people than any other group. Gods justice will serve you.
    If you feel you were in the right you are not repentant. Thus , before the Lord you will pay the ultimate price.

    What's not clear in the shooting video is that this officer was not the officer shouting the commands. That officer, by his choice of words and tone of his voice, unduly and needlessly increased the tension in both the suspect and this officer who fired the shots

    At 16:30, the answer is YES, everyone knows this. But what does this liar do? INTENTIONALLY MISINTERPRET THE QUESTION, THEN ANSWER A DIFFERENT QUESTION, FORCE THE PROSECUTION TO REPHRASE THE QUESTION MORE SPECIFICALLY, then DENY IT and claim he doesn't remember. How Ludicrous.

      What's sad, is they were saying he was fired for an unrelated incident. And the person that was yelling at the victim, giving him orders, in the video, was the sergeant, that was in charge. Whom had been on the force for a long time, and a few months later retired, and moved out of the country. The sergeant, also said, that he would've shot the victim as well, had this guy, who DID shoot the victim, not been in his way. Basically he backed, this piece of shits, decision in shooting the guy. Fuckin bull shit.

      @@MandaPanda0929 It was not obvious he didn't have a weapon. The motion Daniel made with his hand was very similar to someone about to draw a gun. The officer testified that he felt certain in that moment that Daniel was going for a gun. He had a split second decision to make, and I don't think we can fault him for it. Put the blame on Daniel for being stupid enough to point a weapon at people from his hotel window.
