Hey Erik. I was wondering if a company in Canada has the same brand name as I do and they have it copyrighted is that an issue even though I’m in the United States?

Is it necessary to have an office in the US for applying? Please reply

Surmai, to file in the US, you do not need to have an address or office in the US. You just need to have sales in the US or an intention to make sales in the US using the mark.

If two trademarks are coincidentally the same and both are registered under domestic laws of two different countries, who will be able to get registered internationally and on what grounds? And which forum would deal with disputes regarding international contacts and conflict of interest?

Thanks for your comment. This particular scenario is quite complex because it involves international laws of multiple countries. I’m afraid that I can’t give you any more details here.
