Sometimes it's the bad guys that win.😢 Feel so sad for Samantha, she's had so much pain in her life, including while she struggled in life with no assistance from her father, he lavished all his money and attention on his spoilt brat youngest child MM. Actually, he did. He allowed Samantha give many interviews to RUclipsrs and he himself chimed in via Popcorned Planet. They are lucky that they did not get countersued. It could have been dragged out much longer in that case with a big loss to Samantha at the end.

Thank you, Pluto for breaking this lawsuit down. As a working member of the legal profession in the U.S., I too felt Samantha Markle's case was weak. When the judge remanded the case back for 2nd rewrite (remand), I knew Samantha's lawyers had not met the prong thresholds on each element of defamation or on defamation by implication. MM did "opine" her opinions that were harmless accusations at best. i.e. saying she was an only child...while untrue....never rose to the level of defaming Samantha's reputation. MM plays the "gaslighting" game well as does Harry. Ignoring both of them like the RF does is the best remedy to dealing with them.
I TOTALLY AGREE! And there are many of us that have close family members who have said FAR WORSE lies about us, but it never occurs to us to take them to court! I realise that in this case it is very public, but as you say they were 'harmless accusations at best'.

Damages couldn't be proven because Samantha actually became more popular as a result of Smeg's BS.

This is a fair point indeed! At first I thought Samantha really was just jealous. But since looking into it all more, I think she’s much more likeable and intelligent than Meghan.

Why did the judge let it go ahead if it's so obvious to the legal world that it didn't have a chance. Because who's going to foot the bill now...
It usually comes down to money.
They don’t care how much it’s going to cost the plaintiff.
I, too, wish that the judge had ruled on MM's Request for Summary Judgment (a complete dismissal, essentially) sooner. Not only is money lost for Samantha or whomever was bankrolling the lawyers, but she's lost "a life." I frankly think Samantha needs counseling herself to cut the ties and move... on.
Nobody knows with any certainty who foot the bill. If the family was asking for donations for unpaid medical bills, it stands to reason she was not footing the bill for legal fees.
in US Law, judges give you as many chances as possible to present your issues. That's the way it works. Samantha got 3 chances to amend her complaints, and she has changed lawyers multiple times.
...because her case was weak, and there's no legal remedy for "...my half-sister wants nothing to do with me..." None of the pleadings included the level of detail that would be needed for a strong claim. She even submitted evidence that dispelled one of her own claims - the one about the name change!
Judge Honeywell analyzed everything filed and the attending evidence with a favorable view to the plaintiff, as the law requires. This was an expected outcome.

TRG is honest and says she is not a lawyer, however, most of Grift’s analysis aligned with Pluto’s. TRG has raised the question of influences of today’s US political climate into the court’s decision. Personally, I don’t believe it did. As someone said earlier quoting Lady C, Meg is always just on the right side of wrong, the Markles seem to just overreach on wrong side of right.

There were no lies; an opinion based on one's own experience is not a lie. Furthermore, had you bothered to read the court filings yourself, you would see that Samantha blatantly lied. For instance, she misquoted both what was said by Meghan in the interview and what was said by the authors in the book 'Finding Freedom'-a book that Meghan didn't write and which didn't defame Samantha.
So Samantha's legal defence was ill-prepared and unrealistic. Poor Samantha.
She was the plaintiff in this case, not the defendant.
Attorneys will take any case, as long as they get paid.

Samantha might have been lied to by her lawyers. From the minute this case was filed I knew it would never fly. Defamation is extremely difficult to prove. People can pretty much say what they want as long as it doesn’t cause significant financial duress to the other party. Samantha never lost her job because of what Maggot said.

Where did the money for the lawyers come from? I hope this hasn’t bankrupted Samantha. I saw on her brother’s channel that Sam is pondering on an Appeal. I hope she doesn’t waste any more money on this. MM will always win because she has unlimited funds and can afford the best lawyers in the State. EDIT: It’s my belief that Sam’s lawyers will encourage Sam to appeal, purely to make more money out of her.

Her inability to be part of her birth family, h's family, within her marital family and her previous cable tv family, is a continuous problem. She is often away from there never seen 'kids.' Their marriage is a mess. They both have alcohol/drug problems. They both have mental issues. They are both narcs in addition to their other mental problems. She blows through money that she or he have little chance of regaining because they are both talentless. Their finances seem dubious and appear to be a money laundering machine. She is not entitled to his inheritance that is being held [I believe Anne is guardian]. He looks like he is fed up with her antics and the claw. They will divorce unless he mysteriously ODs. This was a bad case and a dumb one to file. This was a very logical judgment. Working out one’s hatred through the court system is always a losing proposition.

If it is thrown out with prejudice, that actually leaves Samantha liable for all legal expenses. She took a huge risk. She was advised, by top ex lawyers and judges in various public articles not to proceed, it was too risky and she didn't stand a. chance. The advice was brilliant, but she preferred to listen to You Tuber nonsense. Any sensible caution was shut down.
The case was dismissed with prejudice - that means that Maggot can sue Samantha for her legal expenses.

Thank you for such a dissection of the case. It would appear that Samantha's lawyers did not advise Samantha correctly or prepare the case against MM based on legal fact,
I really wish Samantha had better lawyers who could manipulate as well as Meghan and Harry do. In my eyes she really did have a case, but it all comes down to the wording and how much proof you have. I feel for Samantha, because I went through the same thing with an ex. He manipulated things that I couldn’t prove, unless I got every one of his friends to sign affidavits and testify for me, which he knew was never going to happen. I had to start my life from scratch, and walk away with practically nothing, just because he was vindictive and wanted to beat me and see me lose. The courts just don’t work for victims of manipulation. I hope Samantha and her brother and dad can move on and forget about Meghan. She is one of the worst manipulators, but things are catching up to her, so it won’t be long before they can sit back and watch Meghan get her karma.

It is my protected opinion that this case was filed for ulterior purposes. It enhances the value in commodity.
It is difficult to believe this was financed by the plaintiff, therefore I perceive this as:
1. A way to stay relevant in the press (paid interviews)
2. A promotional tactic for an upcoming book
3. An avenue for sourcing
I have an issue with both ladies, tbh. They have not demonstrated a history of truth-telling. One spins lies more than the other.
PH never met Dad. Big Lie. To the world. Account was hacked? Now we learn it was legitimately suspended. And, I just discovered she claims her book was tampered with which is why it’s unavailable. Likely not the truth as she has a published and OS’s debacle has instructed the public that this is close to impossible to happen.
So…I find myself not believing a word espoused from any member of this family.
The patterns are all there. They play coy with the truth. The reserve of trust is empty.

Basically… THE LAW IS AS ASS… I went through a legal battle with hard evidence on betrayal, lies, theft and cheating but the law only saw the opposing pity play.

I agree with you Pluto. It was iffy from the start. The fact that they let Samantha refile let's you know she was on shaky ground. I know people don't want to hear this, but Meghan was within her lived experience & felt an only child. I grew up with all 6 of my siblings but always felt like an only child. I was the youngest. The fact the people are holding on to this case like it's a lifeline amazes me because it's a weak case. Nothing nefarious going on with the judge. It's just a weak azz case.

Agreed, MM is adept at skating very close to the edge but she is careful to not cross over. She says enough to do the damage without putting herself in danger of legal ramifications.

Weak case plus weakish lawyers?
This always seemed a ridiculous law suit to me.
I'm no fan of meghan but the comment about growing up without siblings has to be taken in context of how it was said.
She was talking about her pregnancy and said she was pleased Archie had a sibling as she grew up an only child.
She did grow up an only child. By the time she was three both her siblings were adults. How much does anyone really remember before the age of 7?
Having a sibling your own age is very different. You play, argue and laugh and cry with them.
Samantha had no evidence to support her claims.
The lawyers shouldnt have encouraged her, the judge should have knocked it on the head sooner, but ultimately Samantha is to blame. She came out firing with her nasty book before meghan was even married, all for money. She came to London banging on the Palace gates demanding an audience and did interviews, for money.
The whole family are just vile attention seekers and money grabbers and now is the time to just go away.
Look to the Middletons, who after 20 years, and a fair bit of abuse, have never spoken out.

I don’t know what the statutory definition of defamation is in the US but here in the U.K. defamation occurs to someone when a statement lowers him/her in the estimation of right-thinking members of society .
Reputationally , Samantha would have prove that she had suffered quantifiable harm from her half sisters words.
Meghan suffers the most reputationally from her own parole in my opinion , as it’s always very quickly debunked and makes her look foolish generally speaking
