      The dog is noble, the animal that got shot dead because he didn't have reasoning wasn't. What kind of "father" pushes an elderly old man in front of their child? Why should I feel sorry or have sympathy for a woman whose ignorance and inability to acknowledge that she is wrong got her husband killed? Should I feel bad that they brought it upon themselves?

      Gregory Smith he is a civilian with the right to protect himself, weyher he was trying to pick a fight is not clear therefore not a fact. What is a fact is that whoever parked there, shouldn't have. The driver was confronted and decided not to cooperate in being civil. I mean that is why we have laws for handicapped persons, because we are civilized. At no point should a verbal argument escalate to physical violence, so again, the old man was talking to the driver. The husband, not knowing what's going on and physically assaults the OLD man. Mind you, he is old, and he just got pushed to the ground by a big strong black dude. Yes I can say he would fear for his life, because for him, he was doing what he thought was right. At no point was the old man wrong, he did everything correctly, but you'll argue that he shouldn't have shot him but that's easy for you.

    Dan Goldman is misstating Florida Law. The statute reads that there must be "reasonable belief", it does not mean "feelings." The belief must be reasonable.

    The initial aggression is to violate the mobility of the handicapped driver. As a society we have agreed to set aside parking spots for the disabled to improve the quality of their lives. In another interview the mother said that it is her right to park anywhere she wants to. This demonstrates either ignorance or arrogance. Many people who have an understanding of the intent of handicapped parking spaces are justifiably angered by abusively misusing that parking spot. Once upon a time, there was such a homogeneous culture against abusing the disabled, that confronting those who violated their preferred parking was not seen as aggressive, but heroic. The second act of aggression was a definitive battery against a person who was heroically confronting a callous act of oppressing the rights of the disabled. It is here that I will inject an assumption. It is a fair assumption that most Americans do not walk around in public while carrying a concealed firearm. Statistics bear this out. I believe that Mr. McGlockton assumed that Michael Drejka was unarmed, as most of us would. had he any belief that he could be shot in this confrontation, he would almost certainly not have committed a battery on a person who was merely vocalizing the majority position against oppressing the disabled. It was only when the gun was revealed by a man in an otherwise defenseless position on the ground, did Mr. McGlockton cease the aggressive pursuit, and begin to back up. In the presence of two adults who had demonstrated a willingness to act with brazen defiance of established laws to protect the disadvantaged, and to immediately pursue a course of violence against those in support of equality, Mr. Drejka pulled the trigger. Mr. McGlockton's confidence that America's anti-gun policies have disarmed the general public lead him to a fatal miscalculation. It was in fact most likely only a similar but opposite assumption that lead to Mr. Drejka's actions as well. had he been unarmed, he may not have had the confidence to confront lawless family in the commission of crime. It could very well be argued that the dis-arming policies of the 21st century lead to a man's assumption that his violence would go unchecked. After all, most victims of violence are left helpless to counter an attack in their own defense, which is all too common in the media, and a valid assumption of the aggressors of the American public.

    Not taking sides here at all. A person was assaulted and feared for his life. Very touchy subject. The attacker should have never escalated the situation. It is self defense. If you are in Florida and a CCW holder, you have to the right stand your ground if you fear your life is in danger.
    It is sad and unfortunate for both parties. I am responsible CCW permit holder. Think twice and walk away before assaulting someone.

    Here's what actually happened. Man A has conversation with a woman. The conversation can be described as a verbal argument or a debate. Man B physically attacks man A. ( note man A had no idea if man B knew the woman. Man A didnt see the assault coming as can be seen in the video ). Man A falls on the ground immediately pulls out a gun aims and shoots man B. Man B dies in the hospital 30min later. The end. Everything else is designed to make you emotional. These are just the facts.

    I'm handicapped and in a wheelchair. This is horrible. If someone is illegally parked in a handicapped place, let the police handle it. Photograph the license plate and call the police. No life is worth losing due to a parking violation. Period.

      The guy dying had NOTHING to do with a parking space. He's not the police, he should have let it go. Maybe he has a disabled relative? Maybe it was a bad day, who knows, but nothing he did was illegal or violent. The black man died because he assaulted a stranger without provocation. PERIOD.

      I'm talking about why the shooter decided to confront the driver. But ultimately it makes no difference what the disagreement was about. The man chose to initiate force against someone who was not being violent. He escalated the situation and paid with his life. The parking spot is irrelevant.

    As soon as the woman saw here boy friend approaching she got out of the car, this was going to be a two on one fight. The guy pushes the old guy to the ground before knowing what was going on and was approaching him pulling up his pants until he saw the gun, then he stopped in his tracks and realized this guy was armed and he wasn't going to be able to continue his attack. the old guy was on the ground after be violently pushed and was fearful of being attacked again by both of them so he defended himself.

    The guy with the gun appears to have been looking for trouble and found it. His false bravado was boosted by the fact that he had a gun. The guy was backing away when he saw the gun, so he should not have shot him. The guy with the gun both started it and finished it. He should be charged with at-least manslaughter for instigating the situation. The guy should not have shoved him, but there is no audio as to the severity of the argument between the girlfriend and the guy with the gun, and I cannot judge a guy who instinctively defends his wife and kids. Based on the letter of the law "stand your ground" applies, but based on the spirit of the law this instigator should face charges, if the facts bear out he indeed instigated, and has a history of instigating....

      steve b There is a big difference from playing a game, and assault, i think everyone involved handled it wrong. But no, you can't go knock someone down violently and tell them you are just playing tackle football, that is ludicrous. Would i have pulled out my firearm and shot, probably not, but i was not in this man's shoes, or know what he was thinking. It is really sad that things went down like they did, cause the whole thing could have been avoided. The white guy could ave gone inside and complained to the manager or clerk, and let them deal with it. The girl friend could have moved the car to another location instead of arguing. The black guy could have been more civil and asked the guy what the problem was, and diffused the situation. So, all parties could have acted differently and the boy friend would still be alive. I think we are losing that civility and respect for one another. and it is really sad. Just a note, the boy friend had a police record, dating back at least 10 years, that included assault and drugs.

    This situation didn't escalate when the gun was pulled, it escalated when the guy decided to violently put his hands on another person. He made a terrible decision that simply cost him his life. The only laws that were broken was when the guy decided to commit a felony assault and when they parked in a handicap space without the proper handicap sticker.
    At one point within this confrontation, the guy with the gun had to deal with the lady, which exited her car, the guy that assaulted him, and some other dude that was in route, but fled when he saw the gun fire, This guy was lucky that he had a gun, I'm sure he would have been beaten severely had he not had a gun.
    The aggressor only backed away when he was confronted with the gun.By then it was too late. He could have confronted(verbally) the man that was yelling at his lady and still stood up for her honor/protection, yet he felt that violence was his best course of action. I guess he was wrong.

He backs away but the man on the ground was faced with not only the one who assaulted him but the woman had got out of the car and the 3rd guy coming out of the store approaching which means 2 and possibly 3 on 1.     The lawyer got this completely wrong. Florida statue 776.012 (2) States "A person is justified in using or threatening to use deadly force if he or she reasonably believes that using or threatening to use such force is necessary to prevent imminent death or great bodily harm to himself or herself or another or to prevent the imminent commission of a forcible felony. A person who uses or threatens to use deadly force in accordance with this subsection does not have a duty to retreat and has the right to stand his or her ground if the person using or threatening to use the deadly force is not engaged in a criminal activity and is in a place where he or she has a right to be." So, three criteria have to be met: 1.) A reasonable fear of 2.) Imminent threat of 3.) Serious bodily harm. Of course that is subjective but the alternative "self defense" law is equally subjective and based on "reasonable" fear. The lawyer essentially states "anyone can just claim they felt fear after the fact and get away with murder" which is hogwash. Again, the fear has to be justifiable and reasonable. Hardly an objective panel.

      Jose Bauzo Stand Your Ground means: If you are in fear for your life, you have the legal right to use deadly force to terminate the threat.
      The white man was violently shoved to the ground. Not just pushed. He was literally forced to the ground. Which, in Florida, is felony assault. So, now he is on the ground, likely stunned and obviously in a position of weakness. His assailant does appear to back off momentarily, but we don't have audio and cannot hear what the black man is saying.
      The greater point being: If the threat still exist and you are in fear for your life, under Florida Statutes, that is all that is necessary to meet the criteria of the law.
      Key words: Fear For Your Life.
      Even if the black man appears to back off, he is still a threat in the mind of his victim. The use of deadly force in this instance, is indeed justified.
      Could the white man just have waited? Perhaps, but he was knocked to the ground violently. In my view, that meets the Stand Your Ground Law and the use of deadly force. If you really are carry/ conceal in Florida, you ought to review your states statutes regarding this matter.

      bro dough Wrong. He is advancing on the man he slammed to the ground. That man was just violently assaulted, thrown to the ground and sees his assailant advancing. The time between hitting the ground, getting his bearings, pulling his gun and firing was MAYBE 2 seconds. We can sit and second guess all day about how we would've handled it, but we weren't in it. He did what he needed to do to neutralise the threat and the law agrees.

      Interesting that your comment was that the "black man" could've had a gun instead of just the other man...the perception of the big scary black man is my issue with this law...never mind that the guy with the gun was the instigator of this incident!

    The litmus test needed to meet the criteria for Stand Your Ground was met.
    The black male violently shoved the white male to the ground. Which under Florida Statutes, is felony assault.
    The white male was forced into a position of weakness. He is on the ground. Presumably stunned. He observes the black male standing there and even though on video it appears the black male backs down, he really didn't. Instead, the black male does a half turn, but then turns back to his victim, who is still on the ground. In that brief second or two, the white male pulls out his gun, points it at the black male and discharges one round into the black males chest. The black male, then turns to run back into the convenience store.
    Stand Your Ground literally means just that. If one is in fear for their life, they have every legal right to the use of deadly force.
    The white man was on the ground. The black man was still on his feet walking within mere feet of his victim.
    I don't know about any of you, but me, I would've done exactly the same thing. The key words: In fear for your life!
    I might add, not everyone can defend themselves physically. As in boxing, martial arts etc. Not everyone can physically handle the stress of a fist fight. The white man obviously was in fear for his life and after the violent way in which he was shoved to the ground, his assailant still capable of more attacks, he did exactly what needed to be done.
    The black male. Well, only he knows why he acted the way he did and he's dead!

      John Smith That is not true. There are many instances where someone shoved, not pushed, but shoved another person to the ground causing everything from concussions to permanent brain injury and broken vertebra to actual death.
      If you actually examined the video carefully, you can plainly see the force the black male used on the white male to literally knock him straight to the concrete. Such forces are enough to cause the above type injuries or death depending on how fast, how far, how hard one strikes the surface of the ground. I was blindsided by a skateboarder once, while standing with my bicycle. The force of which, knocked me to the pavement and nearly broke bones. The other guy was no where near as hurt and this was an accident and not intentional. The greater point. The black male shoved this white male violently to the pavement. The white male was obviously unprepared and likely stunned. Fearing for his life, he drew his gun and discharged one round into the black male.
      The key words: In fear for my life
      If you cannot understand that, perhaps you need to experience, first hand, what its really like to be blind sided, knocked to a hard surface violently and have your assailant stand over you while you're on the ground in a position of weakness. Maybe then, you will regain a fresh perspective of why one placed in such a situation, if armed with a gun, might react in the manner that the white male in the video did.

      Its crazy to me how easily accessible guns are to get, but this is the states, so it's not a surprise. There should be thorough background checks before anyone is able to purchase a weapon.

    Sadly a situation that could have been provented. Think before you put your hands on anyone and think before your shoot. The problem nowadays is short tempered and aggressive people. This could have been solved by simply holding a conversation and parking in the right spot. Lesson learned for everyone.
