Rather, SC can ask WHY CAJEriwal was NOT responding to the 2nd or 3rd Summons , if not the first. SC can see the history.
Can any any investigating agency foresee a time to gather sufficient event to arrest an accused.? Is their a right time for the investigator to arrest? How does it help ED? Election is an incidental regular event in any democracy . Who does not know elections are there after every five years? In any case AAP party has a very small electoral weight in terms of seats in the Lok sabha. If Kejriwal was so particular about elections why did he refused attendence 9 times.? Willfully lost almost two months! Whose advantage? He could have complied with soft options . It also can be argued that the accused knew his involvement and somehow he wants to prevent arrest.. Presumably the court decisions, just before the arrest , is pertinent . If ED has power to arrest ,no where it is restricted by time or events. The argument comes out of a presumption that politics is behind the arrest.

ED lost its credibility. they sent notice to poor farmers in remote village in Tamil Nadu under PMLA. Later withdrawn. The FM must step down and does not fit to a minister. Last year few ED officials were arrested in Tamil Nadu for taking bribe. The ED never sent any notice to opposition parties and CBI questions only opposition parties. Can we deny government involvement of ED and CBI ?
