    The problem is when chat reporting came out whilst almost everyone disliked the chat reporting system we understood that at least we could stay on older versions to avoid this garbage. Now mojang has banned once using video evidence theres nothing stopping them from doing it again. If you believe the bans here were justified or not this is a concerning step in the wrong direction.

    Fit actually reached out to me to ask for my take on the situation and most of what you have outlined was actually covered in my response to him, even with sources cited. I'm not too sure why he ended up publishing the video as it was because he could've kept the same points while keeping the same message in the video simply by explaining why each part matters and by not messing up the "hacked version" definition.
    I don't think it is unreasonable to discuss the reference of a "hacked client" in the response from Microsoft but there should've been an explanation as to why. In my opinion, if the "harm" mentioned in the response was enough to ban someone, they don't need to add the mention of a hacked client at all since that doesn't actually strengthen their case and just makes people question why it was mentioned. If they were simply banned for "harassment" and that was the response back, I doubt this would be as big of a deal.
    The reason I think these bans are surprising is because like you and Fit mention, the 5c members that were banned may not have actually been breaking the EULA. While Microsoft has in their contract that they can just terminate people's accounts for any reason, it isn't commonly used and it isn't useful to people if they start doing so for things outside of the EULA. If I tell you that you can't do X and Y but then ban you for doing Z which wasn't defined, you'd be wanting answers too.
    Notably, it is actually against Xbox's community standards to "cheat" in their games. The problem with that is the description for "cheat" is far too vague, to the point where you could argue that upgrading your computer or installing a performance enhancing mod would fall into their definitions. While this means they might have broken those community standards by using a hacked client, it again isn't useful to someone if your definitions are as broad as these are. How are we to work within the rules if the rules aren't clearly defined? This part which wasn't mentioned in Fit's video was actually mentioned to him in my response and simply adding this context would've made the explanation of hacks vs mods make far more sense than it does currently.
    I will add that it might actually be illegal to have clause like that in the country that some of these members reside (I'm not a lawyer and this is based on reading consumer guidelines in Australia). In Australia a contract that has the ability to be terminated by the entity selling a product has to clearly define what can cause that termination or change in services. There are case studies discussing situations where phone companies had almost exactly the same wording regarding termination of services that were found to be too vague to be enforceable. The problem is of course that no one is going to try taking a multi trillion dollar company to court over a Minecraft account.
    This is a really complicated situation, sorry for the wall of text!

      Your message adds some interesting context to the whole situation.
      I do agree with you that refrencing "Hacked Clients" in their response was confusing and concerning.
      They really should have been more thoughtfull and clear with their wording.
      Like I said in the video I dont personally think "Hacked Client" was their focus but there is no way for us to know.
      It is concerning regardless IMO.
      I also agree with your second point, if I was banned for no reason I would want more answers.
      I think the clause in their TOS is more to cover them in a senario like this, but it is concerning to see them flexing that power.
      One of the 5c members said something like "Microsoft should fix their game instead of banning us for tinkering with it" and I do agree with that to a certain point.
      For your third point I once again agree, "cheat" is way too vague of a description.
      As far as I know there is no good way to even enforce this rule with a game like Minecraft where mods are run client side, Unless Microsoft switched to a server side only modding system they should leave server owners to set and enforce their own rules. (Just to clearify here I dont think switching to a server sided modding system is fesable or a good idea eaither, I was just making a point.)
      And your last point is very interesting!
      I have no idea myself on how that works esspecially when the owner of a software is in a different country to the user.
      It would honestly be an amazing story to see someone taking Microsoft to court over a banned account but that likely wouldnt go very far... xD
      I do miss the old days when Microsoft or Mojang was Less involved
      and had warnings like "join this server at your own risk".

    A really great take! While I have some concerns about Mojang, I think too many people think of Mojang as a singular entity. I mean, imagine anyone's current workplace and all the idiots that work there - the mistakes that are simply due to human error. The differing reasons for the ban can easily be chalked up to this. It's not like Mojang made an official public announcement on the subject, it was just a response from a couple employees. That being said, you made some really good points that I hope will bring people some ease.

      Yes, I am also concerned. It is scary to see them flexing a power they have had for years but never used previously. I also fully agree that the different and confusing responses are likely due to human error. :o

    When Mojang says, "...we'd appreciate it if you didn't use Mods for griefing...", I feel like this implies that both Mods and griefing are perfectly fine on their own. So nobody should worry about being banned for griefing, unless they hack their way into someone's private server to do so.

    I cba to rewatch both videos but out of no where my brain went like: Microsoft EULA also applies to minecraft, so if there's nothing in Mojang's eula about something but Microsoft has that something they will get punished

    Interesting points. Although your 3rd point was not really a point against Fit and more just an analysis of the EULA I still found it Interesting. But I must say, if I remember correctly, there were false bans due to the use of video evidence, which is not ok from Microsoft.

    well to be honest i was part of 5th column my discord got deteminated but i can say yeah a lot happend inside of group I joined while i was playing on 5b5t the group played there than moved on 9b and 2b after almost 2 or 3 months as i said my discord account is determinated. Not sure what happend after but i was there when the grieff starts to happening i was a part of some grieffs but mostly of small server didnt know what happend after i lost account i couldnt get to group again because i lost contact with owner. My minecraft accounst is still without ban because i was only at start when the bot was created.

    so my view on the whole situation, its a mess.
    start off yes hacked clients might not be against EULA but there is an unwritten rule that unless otherwise specified (or implied) you dont use a hacked client on a server, take the video where fit visited the vatagan minecraft server, he started using jesus mode and got banned, but you do the same thing on 2b2t its just another day on the oldest anarchy server in minecraft (yes i had to get that bit in) as for the faked screenshots and such yes it is possible, especially if you get a world download, just fire up a server on a local network turn auth off and get a client that you can change your username and you could easily make photos/videos showing someone destroying something in minecraft, say for example someone downloading the world for a hypixel loby then setting it up to look like popbob destroyed it which knowing the internet would go viral (especially in 2023) the ban reasons, well AFAIK you can only list one ban reason in game and honestly from what i know of 2B2T microsoft could shut down that entire server with one fell swoop (all the racism, sexism, homophobia and other 4channery) just based on chat messages, but the thing that i think makes the 5th collums bans more fair is the fact they managed to get IP addresses of private servers (which for all you know could be ran on local hardware so pushing doxing) and basically 2bing on a not 2b server

    Prudentially what Microsoft did is right because of the TOS and EULA but morally its wrong because they didn't actually have a good enough reason to ban them (due to the players not violating the EULA )
    But we can't argue with Microsoft because they can do whatever the hell they want with Minecraft accounts anyways

    So you mention how mojang shouldn't manage the content that is on the servers, but then proceed to say that they should manage the players that are doing this stuff I see this as a double standard and a dangerous line of thinking when it comes to what we should allow as content on a server. but if you can live with racist and hateful servers, then fine have your cake
