One more difference between Talaq Ahsan and Talaq Hasan is that in first case the couple can remarry as there is a single pronounciation of the word "Talaq" but for remarrying there must be new Nikah and new Mehr while in case of Talaq Hasan the term "Talaq" is used thrice after some gaps thats why the couple can never remarry.

Talaq in Hasan also they can remarry if the woman has married to some other person and after some time if she also got divorced from him. Please correct me if I am wrong.
@@waseemsherani1073 you are right but people got it confused with the so called Halala which is completely prohibited in Islam....If a woman marries another guy after having Talaq Hasan she doesn't have any intention to get divorced from current husband so that she could go back to previous one.... Prophet Muhammad PBUH have strictly prohibited such things

But who will give maintenance if husband goes to jail, how sending husband to jail gonna make anything better for the wife ?

@@YGLAW i think Gaurav here you need to change the perspective. The logic behind criminalization is the same as behind Sati or Child Marriage. To discourage society and put a fear in the heart it was important otherwise mere making it invalid would have not been effective. What can state do for the women if her husband has given her triple talaq? Untill she doesn't go to court she can't get any relief. State had no authority to restitute the marriage (if not criminalized).
And the question Who will give her maintenance?
It's from her property same as in the case of dissolution. She can get under section 125 crpc.

Forcing Someone to jump in fire does not equate to saying 3 words and never i have seen enforcement of child marriage punishment, also child marriage is not void, it is voidable and punishable.
I dont support punishments which are unreasonable, instilling fear is not the purpose of law, we dont follow deterrent theory and it has been proven to not work also.
I oppose this because throwing a person in jail for giving triple talaq to his wife in no way improves the condition of the wife.
Desertion of wife is basically the same thing but it is not criminally punishable under other laws, only a ground for divorce.
So if you desert your wife and you are a hindu its okay.
BUT
If you say 3 words and desert your wife and you are Muslim, you should be in jail.
No logic in that.
Neither this government nor any in the past had the guts to bring UCC, that would actually solve all the problems in Family Law but no why do that just Criminalize Triple Talaq to appease the crowd without stirring up a big drama.

So you mean there should be no punishment for rape or murder or anything? Although your views are impressive but are too idealistic which will lead to a anarchistic society. Punishment are important and they work. It was the concept of punishment in all religions specially Hinduism where the law od karma and paap-punya was the deciding factor behind rule based order in the Indian Society for so long without any constitution and even till now many of virtues are govern be religious affinity not Law.
For us being male it may be a punishment for "just" 3 words but them it's destruction of whole life a relationship they cherished for long, the love, the emotions all get shattered in just a single moment.
And if you talk abt Hindu society tbh there was never even the concept of divorce in them. You won't find any specific word for Divorce.
And as u r talking abt UCC...just wait.

But punishment for Triple Talaq is valid as it would create fear in the minds of Husband before giving such kind of Talaq.
Otherwise just making it only unconstitutional, no one would have taken it seriously.
It has been proved that people dont stop committing crimes just because punishment is harsher, The punishment should serve a purpose other than fear also, If fear worked there would not be any rapes in India.
@@YGLAW yes, that's true. But some laws are made with rewards while some are made with punishment.
Otherwise what will be the need of Indian Penal code or CrPC, etc.
In case of rapes, people don't report that much.
And in case of Triple talaq punishment will work, we can't compare rape crime with triple talaq.
Not every crime is same.
Just like murder and theft are not same.
@@nitrawlani Because the whole purpose of banning triple talaq was to protect the wife from being arbitrarily abandoned by her husband, how will the wife be empowered if the husband is in jail, who will pay for her expenses and maintenance if the husband is in jail. Also you cant compare it with IPC because IPC is for crimes, if those criminals are not imprisoned then they pose a danger to the society, so imprisonment in that case serves an essential purpose of protecting the society, In triple talaq imprisonment doesnt make sense, Just banning triple talaq or making it a civil wrong and then creating strong protections regarding maintenance of wife would have been a lot more helpful for the Muslim Women.
We are not a dictatorship that every matter is solved by fear, the punishment should make sense with the goal we want to achieve, If no one takes any thing seriously without fear of jail then we should keep imprisonment for every wrong. Littering, not wearing your seat belt while driving, playing loud music at night, watching a pirated movie, everything should attract jail time. right?
@@YGLAW that's what I meant to say that punishment should not be in terms of jail but in monetary terms which should be transferred to wife (which is maintenance or whatever name is suggested)
And not comparing it with IPC, was just giving example that there are laws which induce fear so that a person does not act like that.
And maybe a minor jail term of 3 to 6 months be introduced if a person tries triple talaq more than once.
Also strong laws and procedures should be made to help wife to get maintenance and proper check should be put in place.

Wife using husband power to divorce is more technical than what you mentioned ai 11 minute. There are some areas where women on her own power can divorce, in such some part of mehr (gift/property) by husband becomes less. But when wife uses husbands powers of divorce, you have to give her full mehr etc. example in west when husband cheats on wife, she can say he cheated so more property is given to wife. But if normal divorce, so it's half etc.. so reason of wife using husband power is a little more technical.

Criminalisation to Triple Talaq is necessary
If it was just invalid it would have been practised , but since there is legislation backing its criminality it definitely creates bar to perform that even silently as there would be penal repercussions for that and judiciary has clear cut law to punish offenders.
Laws are meant to be harsh otherwise there is no point in having them.

Wrong. It's not as if the Men have used their power judiciously. There are women everywhere on this planet, with equal right to divorce. No such flood of Divorce can be seen in any community just because women have the same right. This is simply an illogical reasoning to cover up the harsh patriarchy that prevailed in Islam.

@@AkshatTiwari-eg2fw no its not, because islam is the ONLY religion in the world that gives women a right to a divorce. Hindus got that through the law, NOT religion. This is just one example to show how progressive islam is. The process for a woman is quicker and simpler than talaq. In talaq it takes a man three menstrual cycles before he can rid him self of a woman. If he had four wives, until one of the wives is not out of her waiting period, he cannot marry a fifth time. In khula the woman has to wait for one menstrual cycle. And just like any other religion, islam does not make it ridiculously easy for a woman to take a khula. The reason has to be justifiable in the eyes of God, and those reasons are when she is not getting the rights that God ordained her husband to provide to her. Her simply fancying another man, and she wants a change, that is not sufficient reason in the eyes of God. However, in the law it is reason enough. These days courts are handing out khula to millions of women, even without the husband being a party to the proceedings.

Mera point yeh tha ki agar triple talaq se wives affected thi kyunki they were helpless after the triple talaq, how would jailing the husband would help them, if the husband goes to jail they will be helpless again, if the husband is in jail who will give maintenance?
rather than making it a criminal offense a person practicing triple talaq should be penalized by ordering him to give heavy maintenance to wife aur invalid kar dete buss, ki koi fark nahi padega triple talaq se, Ab husband 3 baar bolee talaq ki 50000 baar din bhar talaq talaq karta rahee, kya fark padta hai, wife can always go to court.
Law ka point problem solve karna hota hai in my opinion.

You are only considering 3 words but not the situation of woman fr whom the word is pronounced. In my opinion criminalisation must required as a result no one will attempt to do so and the right of a muslim woman will be protected in some extent
