Great question in the end, Triple talak should have been civil offence only. Criminalising a matter of mairrage dissolution selectively is arbitrary and discriminatary as per Article 14 of COI, SPECIFICALLY towards the males of one single community. You have a great legal aptitude, keep going

Very well explained...Yes you hve rightly discussed triple talaq in depth..certainly violates the fundamental rights of a woman..whimsical act..A wife is left to fend for her self so suddenly..Arbitration and reconciliation is a must..Good that the patriachial mind set has bn set right..such a sign of relief ..Despite the fact that honble supreme court has given the verdict on talaq e biddat..still talaqs were send via email,what's up .mail etc etc..Criminalisation of this kind of talaaq is a must becoz it will bring a strong message in society...
I hope that you are also aware that wife doesn't necessarily have to produce any conclusive proof that her husband gave her triple talaq. Which also means that an innocent husband can be arrested if wife simply calls up the police and makes a false claim.
FEW POINTS TO REMEMBER :- 1st of all Triple talak is not banned "Instant Triple Talak" is banned we should use specifically use later term because the former one creates misconception as u explained. 2. Triple talak through whatsapp or e-mail is not considered even in instant triple talak because triple talak requires atleast 2 witnesses from both the sides (Husband and wife) who verifies it. For example if husband is out of reach to his wife like in other country so 2 witnesses will reach him and verifies that he is giving talak to his wife, this also proves that instant triple talak cannot be given through phone calls. Opinion - The only wrong or injustice about this act is "cognizable offence" cause what if a fake report is filed ?? Which also give justice to the female but simultaneously partial to male. Do u agree??? I think it should come under civil offence Moreover, Husband and wife should know there rights. And Should go for Talak e Sunnat if required. Btw ur work is admirable 💝

As far as my opinion is concerned on this issue I think that though this law could be made civil offence coz it's the mattrt of marriage but it's also a grave matter regarding the rights of women. So for this reason, it should be criminalized as it's both un-Islamic & unconstitutional.
@@zakking6266 yes men have the right to choose too. But if u have made a contract (as what marriage is called in Islam, if I'm not wrong) u can't get away with it so easily. Talak-e-ahsan & Talak-e-hasan are comparitively better are better form of Talak if someone wants to get away with the contract of marriage. A girl who has left everything behind for you & your family deserve atleast 3 months as what the conventional Islam scriptures also prescribe. Moreover, Talak-e-biddat is also Un-Islamic as it was written & introduced later which shows that it was nothing but ab attempt to create masculine hegemony & make woman dependent on their husband for their survival. That's why I said it's a malpractice against the autonomy & rights of the woman. As far as the choice of man is concerned, we already have better choice of Talak-e-hasan & Talak-e-ahsan. I am not discussing whether it is Islamic or unislamic. All I am asking is why it is bad? What is wrong in breaking contracts? pleople/companies always break contracts. Also here breaking contracts doesn't include any supply chain things, it is all about relationships, so it can be broken without any time limit. Just like girlfriends boyfriends do. No body talks about breakups, why? Regarding self sufficiency of a women, government should do in this regard. Make womens self-sufficient/learned/skillful.

Marriage is an institution while love affair is not. Moreover, I'm not saying divorce must not be there. If u see things with the religious perspective, Talak-e-hasan & Talak-e-ahsan are already there. If u want to take legal path then u can file a divorce case in the court. But the court will also ask you to spend 6 months with each other so that a marriage can be saved. ( I hope u understand the importance of marriage in our society. It is an institution on which our society is built) Similar provision is there in the above mentioned two types of Talaks. As far as Talak-e-biddat is concerned, any person with sane mind would not agree to it coz it's clearly a malpractice. It's a decision taken in haste which affects the woman if the husband wants to remarry her. The girl has to go through halala. As far as your reference of contracts in corporate world is concerned, I don't find this analogy congruent from any dimension. It's like comparing a fish with a monkey. If u think psychologically also, u will find Talak-e-biddat isn't rational at all. It's a malpractice introduced by some people to enjoy the power. Nothing more than that.
