In today’s episode of Figuring Out, we have Priya Jain in conversation with Raj Shamani.
She is the founder of Finology and runs a RUclips channel with more than 3 Million subscribers where she teaches everything around legal things and law in a simplified version.
In this episode we started with understanding the ‘Patanjali Scam’, what all the wrong practices Patanjali was doing for a long time, how it was saving itself for years, and how its scam was revealed. We then talked about how laws are made, who is included in this process, and how they are executed. We then discussed the ‘Delhi Liquor Scam’ and how Arvind Kejriwal is connected to it. Why he is arrested and why he is not getting bail and other allegations on his party. She also talked about the Electoral bond and what all things are going wrong and her views on the issue.
Towards the end, we discussed the MLA immunity case, how bribes used to be given earlier in parliaments to ask certain questions in the discussions, and electoral freebies. Then we talked about why India has no national game, language or father till now. She also shared about the adoption rights of different types of couples, Hindu marriage law, and the difference between court marriage and registered marriage. We ended our conversation by talking about her teenage love story with her now husband. For more such episodes don’t forget to subscribe to our channel.

In the 18th Lok Sabha polls for Inner Manipur Parliamentary Constituency and some segments of Outer Constituency were marred with alleged booth capturing and proxy voting by armed miscreants.
This as the State is in deep turmoil due to the conflict between the Meiteis and Kukis that began on May 3 last year.
While armed miscreants allegedly threatened polling agents of the Indian National Congress candidate Dr Angomcha Bimol Akoijam, shots were fired injuring an elderly man during the poll hours.
Alleged incidents of booth capturing, proxy voting, destroying EVMs and firing of guns were reported in several polling stations.AND PM himself and BJP is Openly Campaigning in the Name Of Hindu Muslim Communalism Hate.. before 2014 everyone was living peacefully and after 2014 Hindu khatre mein hai😅✌🏻.
The first PM of India had a huge vision for India and now only vision is ram mandir😂. The first PM made Bharat heavy electrical limited, he built the best universities which are still the top rank universities of India like Indian Institute of Technology and Indian Institute of Management in India, All India institute of medical science, he made oil and natural gas corporation, he made Bharat atomic research center, he made defense research center organization, he made multiple industries and made India an Industrial state in no time.
We also had an IT revolution in the 90s. Rajiv Gandhi is called the face of modern India. Years later Narsimha Rao brought liberalization and opened our doors to world economy. Manmohan Singh is called the best economist India had till date, because of him India was the only country to not get affected by global Recession.
After 2014 we see govt selling national assets and giving contracts to people who buy electoral Bonds we see that we only have religious hatred because of the current govt which is extremist, we see the voice of opposition being suppressed, since last 10 years every month the economy has just been falling and the unemployment has just increased, the 100 smart cities were supposed to build in 2017 what happened to it no one knows, electric stations were supposed to be built in 2018 across every Indian oil petroleum station no idea when will that happen, and the metro was supposed to be running by 2016 but still it's under construction, only when the state elections happen Modi visits that state and does a launch event for the metro but after that day it is still not operational, 1987 India and China had the same size of economy today China is at 16 trillion and India barely at 3 trillion, India has lowest economy, highest inflation and highest unemployment in 45 years, India has seen the worst of its life in the last 10 years with the rise of hate crimes, lower rank on press freedom index, rise of polarization, rise of poverty, rise of hunger according to hunger index, rise of religious divide, worst country for environment among 180 countries, rise of inequality, rise of debt, decreased rank on happiness index.

Things i learnt from this amazing podcast 👇
Indian National sport : Not hockey
Indian national language : Not hindi
Father of the nation : Mahatma gandhi ( honorary title )
Political parties who know when and how to utilise the laws, win.
Lastly, supreme court only reviews laws. Parliament brings new laws.
Doing great job Raj, keep going. ❤️
Almost forgot, Court marriage is alternative to traditional marriages whereas marriage registration is just a certificate.

One most important about law and justice system of India is that it’s very very flawed. For example, when we go to the lower courts, the case should be decided/ disposed off then and there. The length and years of delay in giving a verdict is not worth at all. Very few people have the time and energy and resources to follow it up.
If you have not had a chance of court dealings you should enquire and will know it’s so painful and disappointing.
This is one major reason for the piling up of thousands, lakhs .. cases in India.
So also the police system needs addressing and major changes in our country.
You are doing great job. I’m a senior citizen and I’m getting so much of knowledge and educated from your episodes. Thank you

Yes Every ad is misleading in one or other way but patanjali misleaded Indians at the peak time of carona when lacks of people were dying... They sold about 250 cr coronil kit in just a few days claiming they can 100% cure carona and they claimed the same about other diseases which are not even curable.... They took advantage and defamed our ayurvedic medicine.

    @nitinr19 Месяц назад +82

Mere bhai, first of all I really appreciate that you got really amazing guests on the show.
There are few points you need to understand as you mentioned as a common man.
    1. If you say that tender was given based on 12 checkpoints and a company who gave money and only get the information to complete all the compliance, but the company is compliant anyways. Now here is the problem, issuing tender is like an exam. Where all the company are on the same page where all have taken same subjects with same curriculum. In exam no one knows the question paper. Now if one company gives money to the person who is setting the question paper, and company learn everything which is supposed to come in exam. At the time other companies don’t know the questions. Now it is an unfair examination where cheating happened which gives a company an unfair advantages over other companies who were also deserving to come first. So it is unfair, un-constitution, cheating and Bribery. We can not say that company was compliant so what is the problem.
    2. In case of electoral bond, your example that a company is giving some amount to different state and central government as political donation. So who will you accuse that the company gave money to get some advantage. Now no blanket straight answer. One needs to see things case by case basis when they give money to which party and before and after that time what all unfair advantages company got. Because one needs to track and prove the traces of corruption case by case to accuse any company.
    3. As you mentioned that if a company has 100cr revenue and giving 400 cr donation. So party will not know how the company is giving money and what they do. I agree they will not know the financial state of a company. But we need to understand that the electoral bond scheme was created to encourage this act and encourage black and shell companies by amending the companies act where earlier companies can donate maximum 7% of their average last 3 year revenue only to do the donation. Because company is setup to do the business and not only to donate to political parties. With the electoral bond they amend the company act and now company cans donate any amount. No max cap. So the problem was here.
    4. I agree with the point of ma’am that system should be in a way where political parties should be unaware of the funding source they do not need to know who gave them money. They want to know who donates the money because then only a political party can validate the transfer and give unfair advantages to the company when in power. Now your question is what’s the solution? Well there are solutions that we need to talk about, but no one wants to talk. If all the political funding comes to only ECI and they only distribute without disclosing the source, it could be done.
    5. The bigger question. How we can possibly solve the problem of political funding and corporate advantages that they get and put the government and system clean. Well there are ways, we need to understand the need of these donations. 1st which is usually quoted by political parties that they need money to run election campaigns, if no money how they will do the campaigns and reach out to people. So the need is to reach out to people. If all the funding only goes to ECI and they only allocate the money to parties based on need (candidates, place, population etc. multiple factors) and any other direct funding to political parties should be very transparent. And why the parties really need to spend 100s of millions in political rallies and distributing money, liquor etc, if the need is only to communicate the promises. The money ECI get as donations should be used to inform all people equally. Parties have manifestos where they talk about what they will do good for people and what good they really have done to people when in power. What are the agendas of party in the election. ECI should I that as part of communication. May be just one example is literally sending a combined manifesto copies to each home to communicate them. This will help ECI also to create a level playing field for parties to participate in elections. It will also help people to make better choice on what agendas they should vote. Uneven distribution of political funding creates problem in conducting unbiased and fair elections and level playing ground for all the parties. Why Modi or Any Gandhi needs to go to door to door. Limit individuals campaigns to constituency and very local level so they know these are the people who are going to elect based on the votes and they can also connect with people to understand their problems.
There is one very fundamental problem in corporate political funding. It should be actually banned. Why there is a need for a company to donate to a political party. What business they have with politics. A companies work is to do business and create revenue and a government work is to help companies by working on fundamentals of infrastructure and society. The only reason for a company to donate to a political party is either to get the unfair benefits form party when they are in power or do unlawful unethical work without any legal interruption. If a corporate is really willing to to support nation by supporting parties, the only donation and tax benefits they should get when they donate PM finds, MLA funds, State funds, fund in government schemes where their support is directly utilised by normal people and to create public policies and execute public work. We need major reforms in entire political systems and the political ecosystem so government can function for the people and nation. Currently political parties are formed only to get the monetary and power benefit and not to do things for human and nation welfare.

Electoral Bond as a scheme is a forward looking policy.
But the way it was implemented has all the hallmarks of misuse.
Ideally, companies should be able to donate a certain maximum percentage of profit.
Secondly, the dispersal should be based on the strength of each party. So companies don't directly donate to a party, but to the pool.

It added, "The ED case also reveals that he was involved in his personal capacity as well as convenor of AAP." The court further mentioned that the "material included statements of hawala dealers, a member of AAP, etc." Justice Swarana Sharma upheld his arrest and subsequent remand, holding that ED was able to place enough material, including statements of approvers and AAP's own members of Goa. I seen when MH car goes to Gujarat Hawaldar jump on the road to stop car. Similarly if GJ car comes to Maharashtra, Hawaldar stop the car. Do hawaldar have right to do that without finding any mistake. And they ask various things so they can get one fault to loot us. In a case of alleged corruption, a first in India that a political leader that too a CM and deputy CM has been arrested for alleged corruption which do not allot tenders (with their signatures at all) and no bureaucrat or an officer- (high or low ranking) has been arrested who actually notify the policy and allot tenders especially in Delhi liquor case where the services remained with the BJP. It is also to be noted that LG appointed by Modi ji, who sanctioned and made amendments in the liquor policy, which were duly accepted by Delhi government, has neither been arrested nor issued any notices or included in inquiry in any manner. It's first time happening in India and against all the set principles of jurisprudence where the inquiry begins with the officers who notify the policy and allot tenders.

If the job of the SC is to review the laws created by the Parliament, then can you explain why the Wafq Act was not reviewed by the SC, the The Places of Worship Act, the clauses of the SC/ST Atrocities Act where a person can be jailed just on the complaint of an SC/ST without any investigation into the facts of the case and the worst part is that there is scope for bail under this Act. If this is worst, can you believe that there is no scope of punishment to the person who has falsely accused a person under the SC/ST Act.

Excellent podcast. Priya Jain has extraordinary communication skill and plesant personality to convince anyone/drive home a point of view.
The following points may be noted.
    1. Indian judiciary and that too Supreme Court is fountain head of all problems in India. Collegium and Reservation system has deprived judiciary of unbiased talented judges.
Virtually it has become paradise of lawyer politicians to settle score against each other utilising politicised judges.
In the process bigger slice of time of the court is dedicated to settling bickering between politicians or businessmen as big money is involved.
Otherwise the court time could have been used for justive delivery to common citizens for whom these institutions were designed. It never happens as common citizens cannot afford justice from higher judiciary due to prohibitive cost of hiring a pleader.
"JUSTICE DELIVERY SYSTEM IN INDIA AND PLIGHT OF COMMON CITIZENS NECESSIATING A JUDICIAL REFORM" should be content of a series of podcasts to awaken all against such INJUSTICE IN INDIA.
Suggested Judicial reform can be as follows.
    (a) Abridgement of all law including constitution.
    (b) Elimination of Colleagium system.
    (c) Elimination of Reservation System for recruitment of judges.
    (c) Standardising fees of advocates.
    (d) Time bound judgement.
    (e) Creating separate law department in government to resolve the conflict of common citizens cheaply. It would reduce the pressure of cases on judiciary and also make it redundant as it is near impossible to reform Judiciary in India due to presence of lawyer politicians in every party.
    2. Patanjali: it is a fact that the Pharma and Healthcare mafias are behind the case against Patanjali.
Because people of India have an opportunity for an alternative inexpensive treatment and preventive medicines to stay healthy. Patanjali has affected the business of pharma companies who charge unlimited money for medicine and private medicals who treat patients with unwanted expensive methods to mint money.
Besides yoga Patanjali is proving healthy fmcg products for which people of India are saving money and preventing disease. Coronil was a simple traditional preventive medicine of India which saved life of people including my humble family members.
CONTRIBUTION OF PATANJALI TO ECONOMY THROUGH YOGA, AYURVEDIC MEDICINE, FMCG PRODUCTS TO PREVENT DISEASE AND KEEP PEOPLE OF INDIA HEALTHY AND WEALTHY should be content of a series of podcasts.
    3. Electoral Bond was a feasible solution of financing political parties legally without affecting anyone. The problem arose when BJP got lion share of Electoral Bonds and party workers of opposition and their god fathers could not collect money for themseves in name of party.
OPPOSING ELECTORAL BOND IS INTENDED TO CONTINUE THE PARALLEL ECONOMY. IT IS LIKE CREATING PROBLEMS OUT OF SOLUTION. It may be another content of podcast.
    4. "PARLIAMENTARY SYSTEM IS UNSUITABLE FOR INDIA. PRESIDENTIAL FORM OF GOVERNMENT IS MORE APPROPRIATE AS MP, MLAs HAVE NO SAY IN GOVERNMENT EXCEPT WASTE TAXPAYERS MONEY" should be another content of podcast.
    5. "INCOME TAX IS UNWANTED DOUBLE TAXATION. WHEN CONSUMPTION TAX LIKE GST IS THERE, INCOME TAX IS CONTRADICTORY DOUBLE TAXATION POLICY".
    THINK OF THESE CONTENTS
