He was not completely at fault if you ask me, should the manufacturer had labelled his product it would have been a guide to the plaintiff.. And I doubt the defendant was punished for that purpose per se. He neglected the complaints of a client which could have been a grave problem at hand not only for the said plaintiff but the society at large.. I think you missed the point then. Let me put it in a clearer perspective for you. Imagine you buy a drug, and there is no manual to usage, you just know that it can cure a particular illness. And somewhere along the line, it turns out that the side effects are different for people with different blood groups than AB, and then you, in particular, are not AB but O. The outcome will be that it might heal your sickness, but then give you three more. In this case, when you find out, it becomes a big issue because the manufacturer took away your choice to still use the drug irrespective of the side effects you will have. So then they are liable. However, if on the other hand, there was a manual that stated everything, and you did not read it and went ahead to take it, then the manufacturer is not liable. Another type is that you know that there are some drugs that when they are in the system, you are not supposed to consume foods with some specific minerals or elements. They might react with the drug and then become poisonous for you. In the same sense, if the manufacturer does not state this and then you happen to have a reaction, they are liable for a sue. But if they put that in the manual, and then you decide not to read it, and then something happens, there is nothing you can do. But the most important part of this whole issue is that, even after the product is on the market, the companies are still using the feedback from the users as data to better the products. So in this case, when someone comes to you with a complaint, you take that as a serious issue because imagine if its a vaccine, and 1000 people were injected with it, and each person was given fanta. And it comes out that someone got a bad reaction after the vaccination when they took the fanta, it becomes a big issue. You would have to look into the reason why it happened, make a broadcast telling people not to take fanta after the vaccination, till your research is done. That's how it works. So bottom line, the fact that he has no labels, no manuals, no instructions, he is liable on all accounts. He didn't provide instructions for use, neither did he provide any restrictions to use. It's actually dangerous for him to do that cause anybody at any time can take him to court and win. Just like he was rightfully found guilty today.
