The Special Counsel Robert K. Hur wanted to indict but was told by Merrick Garland that the DOJ would refuse to indict, therefore he had to tell the truth in his report because his own reputation was on the line and needed to explain why Biden was not charged. This is from my aunt who was partners with him at Gibson Dunn just prior to his appointment as Special Counsel.

Your aunt needs to read the actual special council mandate for Robert Hur. He was given free rein to both investigate and prosecute. His official mandate did not require him to check with the rest of the DOJ before proceeding with prosecution.

Good point wweb. I don't see how the guy doing the special counsel has the authority to declare Biden not guilty by reason of mental defect. As you know, he said Biden willfully retain those documents, so this means they should have convened a grand jury to indict him. He can plead not guilty by reason of mental defect to the jury. The special counsel said he didn't think a jury would convict since Biden is so mentally off, but that's not for him to decide. If Biden committed a crime, which he said Biden did, then he should be indicted like they did Trump.
