Those letters are useless and just waisting of time. Those bastards employers know that they didn't pay wages and you not gonna motivate and scare them with that piece of paper

its not to scare them, its to let them know you're starting a papertrail in the event you pursue legal action.

if they're brazen enough to steal an employee's wages they're not scared to begin with....

@@lizjo7213 Can corroberate this. I've started an enormous paper trail. My former company told the dept of labor that I was paid all that was owed but even the DOL was laughing like NO.

    This is disgraceful.
So if you work hard but are not good at writing a formal complaint, these rich people get away with stealing from there staff that are on minimum wage.
There should never be unpaid wages.
    Shame on them.

US Department Of Labor Hours and Wages file claimed with them it is free and anonymous. It takes about 6 months to get your money once investigation starts. An inspector will go through all the companies payroll records. It's a simple phone call.

Can this be used for Lyft drivers since we're technically, not employees?

Hello there, apologies for the delay. Unfortunately, we are unable to respond to your particular question, because it would involve providing legal advice, which we are not permitted to do.
If you feel you are owed money for work, contract the labor department in your state, or the U.S. Department of Labor's Wage and Hour Divison:
      www.dol.gov/agencies/whd
Keep in mind that the federal government is currently in the midst of revising its definition of an independent contractor:
      www.dol.gov/agencies/whd/flsa/2021-independent-contractor
There are other demand letters with more general purposes that can potentially be used, such as:
      Demand Letter for Payment:
      eforms.com/demand-letter/payment/
      Hope that helps!

Question: what if the employee was not paid correctly? Then to top it off, the Human Resource manager instructed me to reach out to ADP. Then ADP states to reach out to former Hr. Department. I have Emails with this information
    Thank you for your advice.

Hello there. Unfortunately we are not able to answer your question directly, because doing so would involve providing legal advice. If you are still confronting this issue, consider consulting with a local attorney. Best of luck!

ADP has nothing to do with it. They send out what payroll sends them. You can reach out to your state's Wage and Hour Division of the Dept of Labor and initiate a wage claim.

What if the employer refuses the letter?

    • @eFormsOfficial
      @eFormsOfficial  2 года назад

Hello there, apologies for the delay in responding. While we are unable to provide legal advice about your particular situation, workers whose employers refuse the request in an unpaid wages demand letter usually have several options. Depending on the labor laws in your state, you may be able to seek help from a state or federal agency. You can find links to state laws about wages here:
      eforms.com/demand-letter/unpaid-wages/#state-required-time-limits
Or seek help from this federal agency:
      www.dol.gov/agencies/whd
      Best of luck.

@@HK00088 probably but you only can sue for 2 years unless you can show willful disregard, which would increase to 3 years. You can look at Attorney Ryan's content and that is usually helpful.
