  • Republican Texas Governor Greg Abbott pardons Daniel Perry who was convicted of fatally shooting a BLM protester during a Black Lives Matter demonstration in the summer of 2020. John Iadarola and Brett Erlich break it down on The Damage Report.

    Gov. Greg Abbott of Texas on Thursday pardoned a man who was convicted of fatally shooting a protester during a Black Lives Matter demonstration in the summer of 2020, fulfilling a promise he made last year amid pressure from conservatives.
    The decision immediately followed a pardon recommendation from the state’s Board of Pardons and Paroles, whose members are appointed by the governor. Lawyers for the man, Daniel S. Perry, argued that he had acted in self-defense against the protester, who was carrying an AK-47-style rifle.
    Mr. Perry was sentenced to 25 years in prison in an emotional hearing last year in which prosecutors presented evidence of racist online comments he had made and said that psychological experts had found him to be “basically a loaded gun.” As the pardons board considered the case, lawyers with the Travis County district attorney, José Garza, met with the board to argue against a pardon.
    Under Texas law, a recommendation from the board is necessary before the governor can grant a pardon.

    Stop it Brett. There are tons of liberals in Texas. Please stop the "everyone in Texas" talk. Look at the vote counts. We detest Abbott. We detest the gun situation. We work our butts off to defeat these politicians. Trump has normalized generalizing, and name calling so all of his followers copy that and do the same. Let's not have the liberals do this too, because it makes us (Texas liberals) defensive, like I am being right now. If I ever state this, folks come on and tell me to move from my state. I've lived in Texas my entire life (and I'm old). This odd confusion around freedom in this state has been going on for a very long time. In 1989 I wrote an op ed piece for a newspaper defending a group of Wiccans who one of the local Baptist churches was trying to force out of town. What these Baptists were doing by using the city government to violate the Wiccan's First Amendment rights was disgusting.
    One night at 2 a.m., one of these "Christians" broke into my home with a gun and attempted to kill me. I had a shotgun handy, he had a handgun, so he is dead and I'm alive. Because it is Texas, there was never a question of who was in the right and I hand no legal problems as a result. The interesting thing is that, even back then, a lot of folks wrote the newspaper trying to make me the bad guy, seemingly suggesting that if I didn't want to be attacked I should just not express my opinion in the newspaper. I've carried a gun every day for years, now.
    I have no problem with guns. I grew up in the 1950s and 60s when everyone had guns. Loaded guns were hung on the wall on open racks. Got my first .22 rifle when I was seven. But my dad drilled gun safety into me so well that I should never point a gun at anything I did not intend to kill, that I was never able to point even a toy gun at someone. I do have a right to protect myself, and the only way to do so is with a gun. These confrontations happen so fast that all law enforcement can do when they arrive is investigate your murder.
    Abbott was clearly wrong in pardoning this guy. Guns should always be defensive, not offensive tools. Sadly in Texas we now seem to be living in a wild west that didn't actually exist here outside of John Wayne movies.

    • @havable
      @havable 14 дней назад

      @jamespowers8826 14 дней назад

      @@havable It's a simple calculation for me. Had I not had a gun at hand when the guy broke in, I would be dead today. Here's the stats. There are 466 million guns in the U.S. in 2024.
      There were 18,874 firearm related homicides in the U.S. in 2023. Approximately 0.0041% of the 466,000,000 guns in the United States were used in murders in 2023. Guns are not a significant problem in the U.S.

    If I was a reporter,,,,, I would dig a little deeper. Did Abbott get a donation from this mans family for the pardon. Is he related to Abbott some way??? I ask because Abbott usually does not care about people unless there is something in it for himself.

      They also put a woman in jail for firing a warning shot instead of killing her ex who was violating the protective order. If she'd have killed him, Stand Your Ground still would not have applied because she's black.

    If Foster had seen Perry drawing a firearm in a crowd and been the shooter instead of the victim, his chances of being found guilty despite raising a self-defense argument would be about the same as what actually occurred; the only significant difference between the actual and hypothetical scenarios being tried in court is Perry's social media activity prior to being in the situation where he shot and killed Foster suggests he was seeking confrontation which makes the bar for defense counsel that much higher to prove (self-defense is an affirmative defense, it requires admitting to the act and intent to commit it as well as testimony or presentation of evidence to support that the defendant was in a situation that justified use of lethal force and was not the party to initiate violence).

    In some cases the stand your ground or self defense laws are for good. Like on my case if my ex came back and wanted to try and kill me again I could stand my ground and not be charged for anything that happens to my ex during the attack.

    • @havable
      @havable 14 дней назад

      They only apply Stand Your Ground if you're white and shot a person of color. Trayvon was the one who had Stand Your Ground rights, because he was the one being suddenly tackled in the night with no explanation. But his murderer got to have "stand your ground" rights. And yes, his murderer was also a person of color, but the racial hierarchy places the murderer higher on the "chain" than the child he murdered because of their respective skin colors.

    The last protest of the Vietnam War that saw looting and arson was at Ohio State University, where the National Guard returned fire into the protesters. Something most people didn't learn about Ohio State despite the investigation's findings.
    The public attitude was "Do it more!" as most people wanted the "Mostly Peaceful Protests" with looting and arson being excused to end.
