While the explanations are appreciated - you do very good work sir - as often as not, as I watch your videos delving into the labyrinthine aspects of legal procedure, I am overcome by a sense that this hyper-litigious system is inherently flawed and is very-likely incapable of generating just outcomes with any degree of regularity.
One has to appreciate legal terms needing to be properly defined by SCOTUS. That way we can all be on the same page when discussing such matters. I hope they aim to reach a better standard than "I know it when I see it."

An a non American, I find it somewhat amusing/amazing that you -can- could be convicted of a felony and be barred from voting however you -can- could still run for office. (EDIT - can changed to could for clarity. Also I am not suggesting anybody HAS been convicted just the notion.) [PS I AM amazed by all the likes and comments in 16 years of commenting on YT I have never got more than a dozen comments and a similar amount of likes. This was NOT for likes or comments.]
Trump was never convicted of a felony. Convicted means having been tried and declared guilty.

In exchange the US is strict about losing your right to cast a vote (not to be voted) at least as far as I know.
If you are convicted of a felony, you can loose your right to vote for a very long time (depening on the state).
In my country you only loose your right to vote in case of special crimes (manipulation of the election, treason, ...). Robbing a bank wouldn't result in losing your right to vote.
It prevents those in power from jailing their political oppponents as a means of stopping them from running in elections.
I am absolutely devastated that Trump's actions have smeared the previously perfect record of such a group so integral to this country's soul. I am, of course, talking about the cast of Home Alone 2
Every character in those first 2 movies were criminals with the possible exceptions of the old man, the bird lady, and Tim Curry's character

He also broke into a guest's room without knocking or probable cause and walked into their bathroom while someone was in the shower. Yes, it wasn't a person, but Tim's character didn't know that. He also actively ran after Kevin with the goal of capturing him.
Rob Schneider didn't need Trump's help, he's smeared his own record.

The charges in the document indictment are specifically focused on Trump lying to the Feds about returning the documents.
There is leeway where Trump can claim error or ignorance for prior mishandling, which worked for Clinton and Biden.

I feel like many Americans don't understand "the right to free speech". Yes, you're allowed to say anything your heart desires. You will not be censored by the state. But you will still face the consequences of your actions.

The classic example was yelling fire in a crowded theater (from the days curtains were flammable, and they used gas lights for the stage). If you cause a stampede and people get hurt, you are liable. There are plenty of other examples like fraud and defamation. If your speech causes harm, you are not protected.
Yeah and we've seen plenty of that lately too with active shooter and bomb threats. Even if the call was false, there's likely to be investigation and if it turns out the caller did it for a reaction even if they had no physical threat, they can still be arrested.

People's speech is used as evidence all the time. That doesn't mean the speech itself is criminalized. Most people have heard about Miranda Warnings "anything you say can and will be used against you in the court of law".

They've been saying this for a long time. They also claimed he can't be charged with obstruction because the government eventually did count all the elector votes and concluded Biden won and the meeting ended thus no obstruction!!

Regarding the analogy of the bank robbery, you can take it a step further. *Even if it's true* that your account has (or should have) $5,000 in it, you're not entitled to rob the bank. Even if there was election fraud, the "self help" remedy of more election fraud and obstruction is not permissible.

When I was a kid, people used to talk with pride about the peaceful transfer of power. About how no matter their differences, US presidents followed George Washington's example and put down the reigns of government when their terms were up, handing them off to their duly-elected successors. How far we've fallen.
You should check the 2008 discourse made by McCaim when he lost the election, is quite beautiful, I don't expect low of the one made by republican's candidate in 2012, but I didn't read to be sure
My high school US government textbook had, as its introduction, a short description of an election campaign between two (made-up) candidates. It concluded the summary with something to the effect of "at about two hours after the polls closed, [Candidate B] called [Candidate A] to formally congratulate him on the victory." And then noted that this was something unusual in the world that we take for granted in America: despite much talk by B during the campaign that the election of A would be a disaster, B never considered gathering his supporters to instate him anyway, establishing his own government elsewhere, or any number of other events that have happened in less stable democracies. B accepted that he had lost fairly and submitted to the will of the voters.
We are no longer in that America. However, we can still be in the America that, if a candidate DOES try one of those things, he will neither succeed nor be given the opportunity to try again.

I like the examples of attempting to hire a hitman to off your spouse. You don't need the act of your spouse being offed to actually have happen to be guilty of soliciting the act to happen. Or the example of planning, with others to rob a bank. Even if you aren't robbing the bank in person or the get-away driver, the act of "being in on the plot" is criminally punishable.

As an Australian, I find it amazing that primaries are covered by federal electoral law. America is such an entrenched two-party system that internal party processes are covered by electoral law.
As long as guns and abortion are polarizing issues America will continue to be a two-party system.

To be clear, I'm a supporter of one of Australia's two major parties. Australia is also a two party system - only Liberals or Labor will ever form government. But the idea of the system being so entrenched that internal party selection matters are a matter of federal electoral law is wild.
EDIT: Australia has preferential voting and minority governments are absolutely a feature of our system. Liberals need at least The Nationals to hold government. Labor usually wins in its own right, but might need Greens or Independents. Canada isn't really a multiparty or 3 party system. Sure the NDP have beaten the Liberals, but they will never form government, similar to The Greens in Australia. It's a bit closer than Australia (The Greens have never come close to out-polling Labor, but on the other hand The Nationals have provided Prime Ministers).
If US had compulsory voting like Australia…things might be easier. We need voting sausages too.

The mental state issue is so difficult because Trump doesn't _believe_ one way or the other. The truth is entirely irrelevant to him. He wants so desperately to be glorified, admired, respected, and empowered that it just doesn't matter what actually happened, what the rules are, or what he has to do or say to achieve those goals. He is indifferent to reality.
The mental state issue (if we are talking about whether he really believes the election was stolen) is a non issue. Like the video says, the only important thing is to show that he intended to overturn the election through illegal means, and it looks like they’ve got evidence proving that stacked up all the way to the moon

Remember how over the last two years there have been a lot of complaints about how the Justice Department has spent too much time going after the low level foot soldiers from Jan 6 while ignoring the guys at the top who set it up and were directing it? Now we see the government's long game strategy. Lots of the nuance defence arguments that T-p might want to use have already been used and rejected multiple times. I presume at least some of them went through an appeal process so that by now there is a fair amount of case law written by multiple judges from multiple jurisdictions that the current Judge can refer to when making rulings.
I'm one of the real critics of Garland. I've hated the slow walk but I think you're correct about case law. Mr. Smith has built what is probably the most solid case in the history of this country.

88 felony charges that could result in a total of 641 years in prison. And he's STILL admitting crimes on camera almost daily, with motive provided. He clearly is not sane.

If you say something like "I'm going to kill X person" and then X person is murdered, that's pretty bad for you. You can't hide behind "oh but free speech". It's still evidence against you.
It's not that. It's simply that one of the narrow exceptions to freedom of speech is the commission of crimes. If I plan a bank robbery, I cannot claim that my planning of a crime is protected under freedom of speech. If I enter the bank and yell "give me the money or I kill you", again that is not protected under freedom of speech. If I talk a bank employee into defrauding the bank, that is not protected under freedom of speech. Etcetera.
The American constitutional concept of freedom of speech was a mistake

just wanted to drop in and say my dad, who is a government tax attourney in CA and who is pretty far left (somewhere between demsoc and socialist, myself being an anarchosyndicalist commie) and has spent a lot of his career going up against huge corps who commit tax fraud and teaming up with environmental lawyers to get companies to stop engaging in environmental crimes, absolutely LOVES your content. he really likes seeing other lawyers who are not right wingers and who actually stand up for good values and really care about what they do, because he very much does. i look up to him a LOT for what he's done and his principles regarding corrupt companies and the two of us love watching your content together and discussing the state of law as a profession.

If a judge rules that they have reasonable concerns that Trump is dangerous or violated terms of release he goes to jail until the judge is satisfied that he will behave.
So, yes, and it's a very low standard of proof. If you're free on personal recog, don't jump online to trash-talk witnesses, jurors, prosecutors, or judge.

I think his point was that the DOJ had 3 years to investigate this, and want to have a trial in nearly 2 months. Which gives the defense less than that amount of time to review discovery and prepare a defense. Also, considering their client is the clear frobt runner for the other major political party of the US so close to an election cycle - their client is probably a bit busy.

She dealt with him in an earlier case. When the House Judiciary Committee was holding its hearings last year they subpoenaed some documents and trump tried to withhold them. The matter ended up in front of this judge, and in her ruling she said, "we have presidents, not kings, and Mr. trump is no longer president." And then she ordered him to hand over the documents. Those same documents ended up in the hands of Jack Smith.

I've heard Jack Smith talk twice, *maybe* three times.
He knows to keep his mouth shut, not only because it'd be bad for the trial but also because you should always listen to a man of few words.
Smith has prosecuted war criminals, public corruption and election cases, and gangsters who killed cops. He has a highly developed death stare that Trump is afraid to face. His office says "we speak through our court filings", not through the news cycle.
The need for a government protection order request highlights the need to address the defendant’s continued threats of harm.
If that somebody was a witness and you were telling them you'd sue or sic the cops on them if they testified, then yeah that's a crime. Direct physical violence is not the only way to intimidate or threaten someone.

This idea has been brought up before in a video mentioning the first amendment here on this channel. What are you allowed to say, and does that language ever cross a threshold where it’s not protected speech anymore? The classic anecdote has always been shouting fire in a crowded theater, which would probably be covered as free speech and allowed for a variety of reasons.
The deal is it’s impossible to cover every scenario, and some carry vastly different amounts of weight. It’s an extremely frustrating situation to be in. There has to be a line, but it’s impossible to cleanly draw one.

No. There are provisions of the law that allow for objections by congress. There is no provision for the president to ask the vice president to overturn the election.
You would probably have to prove they did so without any actual concerns, want to score political points, etc. And that they only wanted to falsely flip the election.
If the objections/delays are made through the appropriate legal systems, even if very shady, it's legal. That's why Trump's numerous insane lawsuits never have and probably never will result in any criminal charges (though the feelings of the BAR Association are a different matter), because, while completely baseless, they were carried out through the proper channels. If he and those around him had done everything out in the open, it would probably be harder to make these charges stick.

While the casting of the vote inside the chamber cannot be questioned, the conspiracy that organised the voting against certification of election results would be subject to these laws.
It would send a message to politicians that they are not above the law and must act with integrity. The only Republicans coming out of this not covered in the stink of Trump's corruption are the likes of Pence, Romney and Liz Cheney who refused to go along with this and fully repudiated the idea that the election was fraudulent.

The whole "understanding the state of mind" of a defendant makes sense for most people, but there has to be a point at which this concept becomes irrelevant, without which a bad actor deliberately making themselves willfully ignorant is a valid defense. For example, someone with lots of power who has free access to the best legal advice in the country should have a duty to learn correct information relevant to their circumstances. Especially when there is a large selfish incentive to break the law to further their own power. Willful ignorance like this should be yet another criticism of such a defendant's behavior rather than a defense.
I don’t know about the states, but in Canada, ignorance of the law is never a defence. You can’t argue your way out of an offence by claiming to not something was unlawful.
At the very least, using such a defense should also limit your options in the future. "Sorry, sir, you can't run for a second term now that a court of law has declared you incapable of rational thought"

There are plenty of other countries better than America, but it's hard to move, it requires a lot of money, and in some cases you need to learn a new language. Objectively, America is not the best country to live in. Other countries have higher happiness and quality of life metrics, they live longer, they have better literacy and education statistics, they have less homelessness and unemployed...there are so many ways that America is objectively worse than many other countries.

Why would people go through so much and then do so little?
Aside from making money for large companies and individuals with the tax cuts etc. and promoting people to the Supreme Court, the Republicans seemed to work on a platform of denial, whether this is stupidly blocking all legislation brought by Democrats or denying rights to trans/illegal immigrants. It’s not as if they took the chance to ACHIEVE or CHANGE just TAKE and DENY
I’d be more sympathetic to Republicans if they had some point to their deceit and aggression
