4:46 our teacher told us that here it says women except Hindu, Muslim and Buddhist (i.e Christian) . In Christian after marriage husband and wife are considered as one legal entity. So to protect the property of wife if such condition is put forth then it will be valid.

Section 10 exception was there in British era.
So christian men could get benifit from it by imposing condition on their women by transferring them property for their benefit.
And women from other religion were given right to transfer property.
Basically a classic example from Britishers of male chauvinism.
SC revoked it and added christian women in this exception through landmark judgement of John Vallamattom & Anr vs Union Of India on 21 July, 2003.

Hindu Muslim and Buddhist are not included because they already have their personal laws which deals with this provision, so TPA will not overrule or overlap with those provisions 4:44

Addition: Section 11's exception is based on the English case "Tulk v Moxhay" which laid down the principle of Restrictive Covenants which is mentioned in S.40 of TPA

It should be noted that in section 11, the transfer of interest should be 'absolute', i.e. gift or sale. And so sec 11 does not apply to transfers such as leases or mortgages.

hello sir, i thoroughly love your videos, it really helps for fundamentals.
one thing i want to convey-
i just read in N. H. Jhabvala book the logic behind the exception of sec 10. it states that the exception embodies the doctrine of restraint in anticipation and is borrowed from english law, where such a restraint is recognized to protect a women against her husband. in India, it is intended that this exception should apply to those communities which follow english law. therefore, hindus, mohammedans and buddhists are not covered by this exception.
TPA came into existence in 1882 and that time britishers didn't wanted to interfere in the matter of non-christian and specially women of this land who were either hindu, Muslim or Buddhist

4:46 Reason : Hindu Succession Act, 1956 governs the inheritance of a woman's property if she is Hindu, Muslim, Buddhist, jain or a sikh. If she is Muslim then Muhammaden Law governs. And if She is christian, parsi or any other religion then it will be governed by Indian Succession Act,1925

The exception of Hindu Muslim and Buddhist women is given because they cannot alienate their property unilaterally since they are governed by their personal succession laws..
I think the exception to section 10 is because there already are personal laws for it. (Muslim law and Hindu law)
Transfer to woman for her benefit means - ki husband apni property apni wife ko de rha hai with condition ki jb uska Baccha ho jaega to vo property usko chli jaegi or tb tk uski wife uss property ka enjoyment ly skti hai but vo kise another ko property nhi de skti or ye condition void nhi hogi kyounki vo proptery de rha hai jb tk wife hai tb tk vo property carry karegi life time uske baad unborn child agr vo exsistance Mei aa jata hai to pr vo aesa ni bol skta ki wife pro. Nhi de skti kese ko agr aesa hua to vo absolute condition hogi and that type of condition shall be void under sec.10 ❤
Section 10 exemption for women could be for christian woman as the law was made by the Britishers , it could be to have control on such property as they could have interest in such property.

Reason behind a restraint for married woman except hindu, muslim or buddhist is to safeguard the interest of the married woman who could be easily exploited by their husband.

4:50 sir here I think (though I'm not sure,just saying) that since now hindu Buddhist women hold property as absolute owner (prior to HSA,1956- they used to hold property as a limited owner which vested on survivors upon her death according to rule of survivorship). Therefore, no absolute condition can be imposed.
But here again question arises
This Act enacted in the year 1882 and transfer to someone for the benefit of the woman - in these 2 cases ye upar wala reasoning baith nahi raha hai..
