    Denied as a secondary to ptsd in Oct 2020 filed an appeal and was denied by law judge 3/23 waiting on second law judge to see it which takes place no earlier then 90 days. Still waiting, but hopes not so high but still you never know.

    No nexus is needed if it is a secondary to a condition that's already service connected. However, secondary must be on your record. Sleep apnea can lead to many issues just like depression. Think about it, almost all people that commit suicide have depression. Are there people that have depression and don't commit suicide- of course! There's the kind of logic that screws your case. So. Besides learning secondaries and 38 CFRs you need to learn their logic ... sneaky games they play too!
    VA doctors will fill out VA DBQs if you ask them to. If they won't then start looking at other doctors that are vested and can't be as easily manipulated.
    The DBQs always ask if the doctor believes it is related to your service. If secondary, many doctors will agree, if they don't, take scientific articles or research you can easily find online. Good luck!
    BTW, they'll grant you more often after you're 55.

    Thanks you for that education on what "deferred" means. I'm slowly learning one process after another.

    Troy, Do yourself a favor and support the 3 pillars needed to win a claim not presumptive (burn pit and agent orange): 1- Time in Service (DD214 does this); 2 - Medical Evidence of your diagnosis from your doc (I absolutely do not seek VA letter to support my claim). This evidence should support that your underlying claimed condition or residual condition is chronic or persists, AND is proximately caused or aggravated related to your military service. Doctors can give you a more likely than, at least as likely as, which both show more than 50 % likelihood. GO TO A Private doctor, or public health clinic doctor to get this. Listen bro, having a nexus letter and medical evidence is huge and two of 3 pillars needed according to Title 38 which specifies diagnostic codes and criteria to get service connected. Any VSO worth their salt should guide you on what type of medical evidence is weighty.

    I’m waiting on deferred claim for diabetes and hypertension Medical opinion. Was exposed to nerve agents and chemicals including herbicides similar to agent orange. Denied for sleep apnea, which can be caused by TCE, which are used on a weekly basis to clean our weapons. Denied gets that developed in army but I have no proof can’t get buddy statements can’t find them too long ago and I know some of them are dead. Gerd diagnosed after got out.

    OTC and some of the VA raters have no desire to approve your claim. I submitted several claims with tons of evidence, and most of all, I have ern deferred with two denied. In my decision letter, I noticed a key QTC DBQ missing, including updated information I had uploaded to support my claim. It appears the VA rater and QTC intentionally left out these key documents to set my claim up for denial. In addition to one of my denials, the QTC examiner did not even conduct a C,&P exam in reference to the DBQ.She simply penciled whipped the document and sent it to the VA rater. This is why so many veterans have filed complaints against the VA and their 3rd party medical examiners to their Senators. I plan on filing a High Level Review because I have enough evidence to prove my claim. I am planning to get my two senators involved in my case. But make sure you understand the decision letter regarding your case.

    You must have/get overwhelming evidence. DBQ's, nexus letters, medical statements, blood work, etc... to improve your chances. Get civilian doctors if possible.

    I have bdd claim in process and already had CP exams for my carpal and tunnel syndrome. Now my doctor wants to do surgery before i retire on May 1. Should I pit idf surgery until after separate? Worried my claim will be rated at 0 or defer if VA finds out about surgery. Thanks, man..

    • @TroyPange1
      @TroyPange1  7 месяцев назад +2

      The surgery may be cause or reason for a rating if you’re still in service. Also especially if it’s from military medical. Google the eCFR for carpal tunnel syndrome. Also look up the DBQ for carpal tunnel. Here is something that I found and it may help: “Typically, the VA disability rating for carpal tunnel is 10%. However, depending on the severity of the condition and whether it's present in the dominant hand, carpal tunnel syndrome's rating can reach 70%. More severe carpal tunnel syndrome that involves paralysis tends to rate higher, while milder cases rate lower.”
      Since you’re about to retire I’m sure you’ll have other things to claim that are worth more as far as your ratings go. Like mental health conditions, sleep apnea, etc

      @@TroyPange1 oh yea..I have 5 or 6 claims that should be in the 30-50 range. Thanks the response, man. Just don't want to get surgery and lose my 10% for each arm. It could be difference between 100 and 90

      @shepatown 7 месяцев назад +1

      @@johnramos3335 I had L4/L5 laminectomy/discectomy surgery a couple years before discharge from the service. 40 years later, I can barely stand up, or walk from the post laminectomy/discectomy surgery syndrome. I'm wondering if I didn't have the surgery and tried alternatives to surgery what would have happened. It's a tough call.

    Awesome video, we are on the same page in building a veteran community. I was so frosted with the VA so I started a Non-profit so I could document my experience and help veterans navigate this system. Feel free to reach out. I have a few ideas and maybe we can collaborate.
