Basic Structure of Constitution & Keshwanand Bharti Case Explained | IN NEWS | Drishti IAS
‘Basic Structure of Constitution’ Doctrine was propounded by the Indian Judiciary on 24th April 1973 in Keshavananda Bharati case to put a limitation on the amending powers of the Parliament so that the ‘basic structure of the basic law of the land’ cannot be amended in exercise of its ‘constituent power’ under the Constitution. Basic structure though is not exactly defined but through its contents which have been provided by the judicature clarifies a scope defining the frame or the structure of the constitution. Some of its constituents are Rule of law, Sovereignty, liberty and republic nature of Indian polity, judicial review, Separation of power, secularism, and Republic nature of India etc.

-मूलभूत सिद्धांत का तात्पर्य राष्ट्र के आदर्शो से है जिसके आधार पर राज्य अपने लक्ष्यों को प्राप्त करते हैं।
सर्वोच्च न्यायालय द्वारा "संसदीय लोकतंत्र (प्रतिनिधित्व लोकतंत्र), मौलिक अधिकार(संसद इसमें संशोधन कर सकते है),पंथ निरपेक्षता, न्यायिक समीक्षा" को इसमें शामिल किया गया है जबकि संविधान संशोधन के समय उसकी समीक्षा करके सर्वोच्च न्यायालय द्वारा यह देखा जाएगा कि संशोधन मौलिक सिद्धांत को प्रभावित करता है या नहीं।
अर्थात भारत की लोकतंत्र, संप्रभुता,पंथ निरपेक्षता,मूल अधिकार, लोकहित और कल्याणकारी राज्य निर्माण के विषय वास्तु को इसमें देखा जा सकता है।
-मूलभूत सिद्धांत पहली बार 1973 में अस्तित्व में आया था जबकि अब तक न्यायालय द्वारा 16 बार संविधान संशोधन की समीक्षा में इसका प्रयोग किया जा चुका है। ये सिद्धांत संविधान के लक्ष्यों को प्राप्त करने के लिए आवश्यक हैं जिससे एक लोकतांत्रिक कल्याणकारी राज्य की गरिमा बरकरार रहे।।

ब्रिटिश कोलोनियल सिस्टम अस्थाई न्यायिक प्रणाली बाधा नही दे सकता है alien rules of laws British colonialism judiciary temporarily incorporated in constitution for time being liable to be revoked by President of India.
जनता और राजनीतिक दल महागठबन्धन प्रतिनिधिमंडल सामुहिक बिबेक से विचार विमर्श कर सम्विधान का सुधार करेगे।

Basic structure ko Indira Gandhi ne emergency lagake khatam kar Diya... Ab jo basic structure hai usko har CJI ke hisab apni-apni vyakhya karte Hain. Today there is no clarity on what is basic structure is?

Jin logon ne supreme court mein jakar appeal Kari supreme court ne kar. The the and maintaining 1977 by morarji Desai gov. But no action taken on those judges and politician who kill the basic structure of constitution. Even today the basic structure is not clear...what it is...no definition only depends upon the than Judges.
